FINDINGS,DELIBERATIONS AND DETERMINAi96%hold Town Clerk MEETING OF JULY 21,2011 ZBA FILE: 96483 NAME OF APPLICANT: Michael and Ellen Carbone SCTM#1000-70-12-34 PROPERTY LOCATION: 1580 North Bayview Road, (adj. to Goose Creek) Southold,NY SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated June 14, 2011 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP: This application has been reviewed under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action is CONSISTENT with LWRP policy standards and therefore is CONSISTENT with the LWRP. PROPERTY FACTS/DESCRIPTION: The subject property is improved with a 2 story framed house with a one story section and an attached one story garage. It has 120.00 feet of frontage on North Bayview Rd., 200.77 feet on the east property line, 211.58 feet on Goose Creek and 79.55 feet on the west property line as shown on the survey dated May 19, 2011 prepared by Peconic Surveyors. BASIS OF APPLICATION: Request for Variance from Article III Code Section 280-15 and the Building Inspector's May 20, 2011 Notice of Disapproval based on an application for building permit to construct an accessory garage at 1)front yard setback of less than the code required 40 feet. RELIEF REQUESTED: The applicant proposes to construct a 506 square foot x 18 ft high accessory garage at 8 feet from the front property line at the closest point, (northwest corner) on a waterfront bulkhead parcel, where the Code requires 40 feet. The existing attached garage is proposed to be converted to habitable residential space. AMENDED APPLICATION: During the hearing, the applicant was asked to bring the plan into more conformity with the code. On July 8, 2011 the applicant's architect submitted a revised site plan increasing the front yard setback of the proposed accessory garage to 12 feet at the northwest corner and increasing to 21 feet at the northeast corner. ADDITIONAL INFORMATION: The front yard line of this subject parcel has a continuous row of tall evergreens except where the driveway accesses North Bayview Road. There is also a guardrail, roadside of the tall evergreens, adjacent to proposed location of the proposed accessory garage. The applicant has received a Southold Town Board Paget—July 21,2011 ZBA Pile46483-Carbone CTM1000-70-12-34 of Trustees wetland permit #7569 dated June 22, 2011 for the proposed accessory garage. In 2001 the applicant received a variance for a bulkhead setback of 38 feet to demolish an existing dwelling and construct a new one. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on July 7, 2011, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law &267-b(3)(b)(1). Granting of alternative relief will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The location of the proposed accessory garage, as amended, will not be visible to nearby properties as it will be screened from roadside view by the existing tall evergreens. The adjoining vacant parcel to the north of the proposed garage location is also owned by the applicant. Accessory garages in front yards are a common amenity in the applicant's neighborhood where there are many waterfront properties. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The existing dwelling is located on a nearly triangular shaped parcel with a bulkhead providing no feasible location for an accessory garage other than locating it within the 40 foot front yard setback. 3. Town Law 4267-b(3)(b)(3). The variance granted herein for a 12 foot front yard setback is mathematically substantial requiring a 70% or 28 foot variance from the Code required 40 foot front yard setback. However, the proposed setback increases to 21 ft at the northeast corner due to the irregular shape of the subject lot. 4. Town Law 4267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The proposed location of the accessory garage is landward of the existing dwelling and will be located in an area presently being used for vehicular parking. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of alternative relief for a 12 foot front yard setback is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an accessory garage in a front yard while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Schneider, seconded by Member Goehringer, and duly carried,to DENY,the application as applied for and to, GRANT ALTERNATIVE RELIEF for a 12 foot front yard setback, as shown on the amended Site Plan dated July 7, 2011, prepared by Frank W. Uellendahl, R.A. Conditions: The accessory garage shall not be habitable. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses,setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minions in nature for an alteration that does not increase the degree of nonconformity. Vote of the Board: Ayes. The distance between the two structures is now set at 4 feet which leaves 6 inches of space between the gutters and still allows comfortable access to the creek facing lawn. The relocation of the garage increases the setbacks towards the road from 8' to 12' and from 17' to 21' respectively. The property contains an area of 22,804 sq. ft. and is improved with a single-family dwelling, as shown on the October 7, 2000 survey map prepared by Anthony W. Lewandowski, L.S. , BASIS OF APPLICATION: Building Inspector's June 28, 2001 Notice of Disapproval for the reason that applicants' proposed new dwelling will be less than 75 feet from the existing bulkhead as shown on the survey prepared by Stanley J. Isaksen dated March 23, 2001. AREA VARIANCE RELIEF REQUESTED: Applicant is proposing to remove the existing dwelling structure in its entirety and build a new dwelling as shown on the survey prepared by Stanley J. Isaksen, Jr. dated March 23, 2001. The setbacks at the closest points to the existing bulkhead are 38 feet at the northwest comer and when using the scale furnished, at approximately 52 feet from the center comer point of the dwelling. ADDITIONAL INFORMATION: At the public hearing held October 25, 2001, the agent for the applicant clarified that the proposed dwelling location will not be closer to the bulkhead than the existing footprint, and the Board of Appeals may rely on the corrected information, by applicant's agent, that the existing closest setback from the bulkhead is 38 feet, not 40 feet as originally stated in the application. REASONS FOR BOARD ACTION The Board of Appeals held public hearings on this matter on October 18, 2001 and October 25, 2001, at which time written and oral evidence were presented. Based on all testimony, documentation, personal observations by Members of the Board, and other evidence presented, the Board finds the following to be true and relevant: 1. Grant of the area variance will not produce an undesirable change in the character of the neighborhood or detriment to nearby properties. The proposed location of the new house will rt be closer to the bulkhead than that which exists, 38 feet, from the existing dwelling's footprint. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The location of the new dwelling will not be a further increase in the true existing setback, and in fact will, in part, be a further distance from the bulkhead than the dwelling to be removed. 3. The proposed variance will not have an adverse effect or impact on the physical or environmental conditions in the neighborhood because the variance will permit the new dwelling to be located in the same footprint area (except for portions that are being moved somewhat landward of the footprint). 5. The difficulty has not been self-created and is related to the existing nonconforming footprint and layout of the land. In considering this application, the Board deems this action to be the minimum necessary and adequate for the applicants to enjoy the benefit of a new dwelling, after removal of the existing dwelling with deck, and that the grant of this variance will serve the character of the neighborhood, and the health, safety, welfare of the community BOARD RESOLUTION: Now, therefore, on motion by Member Dinizio, seconded by Member Collins, it was RESOLVED, to GRANT the variance requested, for location of a single-family dwelling, to replace the existing dwelling, in a location shown on the survey map dated March 23, 2001, with the condition that the setback not be closer than 38 feet, at its closest point to the bulkhead.
