SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type I1 category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated March 8, 2011 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP: This application has been reviewed under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action is CONSISTENT with LWRP policy standards and therefore is CONSISTENT with the LWRP, this is due to the mitigating factors imposed by the Board of Trustees. PROPERTY FACTS/DESCRIPTION: The subject property is improved with a two story framed house and garage, it contains 14, 330 sq. ft. of buildable area. It has 100 feet along Sound Drive, 363.51 feet on the western property line, 124.62 on Long Island Sound and 285.04 feet on the eastern property line as shown on the survey dated Revised June 16, 2011 prepared by John C. Ehlers, LS. BASIS OF APPLICATION: Request for Variances from Art. XXII Section 280-116A(1), Art. XXlll Section 280- 124 and Art. III Section 280-15F and the Building Inspector's Dec. 9, 2010, Updated February 25,2011 Notice of Disapproval based on an application for building permit to construct alterations/additions, accessory in-ground swimming pool and decks at; 1) less than 100 foot setback from top of blufffor alffadd, 2) less than the minimum code required side yard setback of 15 feet, 3) less than the code required combined side yards of 35 feet, 4) Accessory structures proposed location other than the code required front yard on water front property. RELIEF REQUESTED: The applicant proposes to construct additions and alterations, an in-ground swimming pool and decks requiring variances for setback to the bluff of 39 feet where the code requires 100 feet, single side yard setback of 11 feet where the code requires 15 feet and combined side yards of 24 feet where the code requires 35 feet and an accessory swimming pool in a side yard location where the code requires a rear yard or in the case of water front properties a front yard location. AMENDED APPLICATION: During the hearing, the applicant was asked to bring the plan into more conformity with the code. On July 6, 2011, the applicant submitted a revised survey by John Ehlers dated June 16, 201 l Page 2 - July 21,2011 ZBA File#6461 - Henson increasing the proposed bluff setback to 55 feet, eliminating the single side yard setback variance, and increasing the total side yards to 28 feet, thereby bringing the plan into more conformity wifl~ the codes. ADDITIONAL INFORMATION: The applicant has obtained a wetland permit and coastal erosion hazard permit #7414 from the Southold Town Board of Trustees dated October 10, 2010. On November 4, 2010 the NYSDEC issued a letter of no jurisdiction for this proposal. The Board requested comments from County of Suffolk Soil and Water, in a letter dated May 4, 2011, it states they find the bluff to be in stable condition, they suggested a rain garden for storm water runoff and the applicant should allow the pool water to sit in sunshine for two days without adding any chemicals or to use an additive to de-chlorinate the water before draining. They further stated in summary that there are no natural resource concerns. As requested by this Board the applicant submitted a prior decision #5523 dated June 3, 2004, in which the Board granted a 5 foot side yard setback for a swimming pool in the side yard ora neighboring home. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held public hearings on this application on May 5,2011 and July 7, 2011, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-b(3)(b)(1). Grant of alternative relief will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The house has existed in its current location since 1970; the applicant reduced the amount of relief requested. Similar variances have been granted by this board within this neighborhood. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than the area variances as applied for. The board proposed reducing the need for a side yard setback on the proposed porch and the applicant has agreed to eliminate the need for any variance on this portion of their project. The Board also requested that the existing deck on the rear (waterside) of the house be reduced or eliminated and the applicant has responded by eliminating the existing deck in favor of a masonry patio on grade which resulted in an increase in the existing bluff setback from 39 feet to 55 feet. The placement of the swimming pool would require a variance in almost any location proposed on this property due mostly to the proximity of the house to the top of bluff 3. Town Law §267-b(3){b)(3). The variance granted herein for the proposed swimming pool is substantial and represents a 100% variance from the code requirement that prohibits accessory structures in the side yard. However, the board finds that placing the swimming pool in the side yard reduces impact on the bluff and the applicant has no room for the swimming pool in the front yard. The bluff setback of 55 feet is substantial, representing 45% relief, however, the entire house is within the 100 foot setback and any addition to the rear or side of the dwelling will require a variance.. The proposed combined side yard setback of 28 fi, as amended, where the code requires 35 fi is deficient by 7 feet and is not substantial since the proposed westerly single side yard setback in the area of new construction has been changed to be conforming, and the existing house has a non- conforming easterly single side yard that cannot be altered without demolition. 4. Town Law §267-b(3){b){4) No evidence has been submitted to suggest tbat a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The mitigation factors imposed by the Town Trustees have reduced the environmental impact. The side yard location of the swimming pool is more environmentally sound then placing the pool in the rear yard, which is closer to the top of the bluff. 5. Town Law §267-b(3)(b)(5). The difficulty has not been self-created. The difficulty is created by the pre- existing non-conforming location of the dwelling. Page3 July 21,2011 ZBA File#6461 - Henson 6. Town Law §267-b Grant of alternative relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a swimming pool, screen porch, additions/alterations and rear yard patio while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Dinizio, seconded by Member Schneider, and duly carried, to; DENY~ as applied for, and GRANT ALTERNATIVE RELIEF, as noted below: The setback from the bluff will be 55 feet, the single side yard setback request is eliminated, as shown on the survey dated Revised June 16, 2011 prepared by John C. Ehlers, LS. Before applying for a building permit, the applicant or agent must submit to the Board of Appeals for approval and filing, two sets of the final architectural drawing conforming to the alternative relief granted herein. The ZBA will forward one set of approved, stamped drawings to the Building Department. Failure to follow this procedure may result in the delay or denial of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is dc minimis in nature for an alteration that does not increase the degree of nonconformity. The site was evaluated for potential natural resource concerns with regard to alterations to the home, and the installation of an in-ground swimming pool and deck. The home sits on the high point of the property and there is a gentle slope north towards the bluff edge and also south towards the road, The bluff is well vegetated; no active erosion was observed on the bluff face. The toe of the bluff is not protected by a bulk head but high tide does not reach the bluff toe and no erosion was observed at the toe. It appears as though the majority of storm surges do not reach the bluff toe either, At the ti me of this site visit the bluff was in stable condition, There are existing gutters on the home which outlet directly on the ground surface. The site plan calls for a drywall to infiltrate the roof runoff. Please be aware that rain gardens are an aesthetically pleasing, environmentally friendly method to manage roof runoff and should be considered as an alternative to drywells, A rain garden is a shallow depressiorl generally about 6 inches deep that allows roof runoffto infiltrate slowly into the ground over a 24 hour period. A rain garden can be planted in the sun or the shade but should always be planted with native plants. A property constructed rain garden retains and infiltrates approximately 30% more runoff than a grassed lawn, As a general rule of thumb, for every 6 square feet of roof, 1 square foot of garden is required. A helpful reference iS available from the Un~versity of Connecticut and can be found at htt p://www.sustainability.uconn.edu/pdf/rainga rdenbroch.pdf It is also noted on the site plan that a dr/well is proposed to drain the swimming pool. While we do recommend draining pool water into a dry well, if chlorination is the method of disinfection it is also recommended to de-chlorinate the water before discharging it into the drain. High concentrations of chlorine such as that from swimming pools can be toxic to the environment. This can be done quite simply by allowing the water to sit for 2 days in sunlight without the addition of chlorine or bromide. Alternatively an additive can be used to chemically de-chlorinete the water. It is recommended to consider healthier more environmentally friendly alternatives to chlorine disinfecting such as saltwater, ionization, and oxidation. in summary there are no natural resource concerns regarding the proposed construction at the subject property. The granting of the requested relief from §280-116(A)(1) for the proposed deck and porch additions to the waterside of the existing 2-story dwelling will not have an adverse impact on neighboring properties or the character of the community, as the developed shoreline community along Sbund Drive is characterized by two-story dwellings located similarly nonconforming distances from the bluff, including the only developed parcel to the west and the four neighboring properties to the immediate east. The project will not create any significant change even to the character of the subject property, as the proposed deck will maintain the existing minimum bluff setback on the east side of the house, and the proposed porch will be constructed substantially in place of an existing attached garage on the west side of the house, where the separation distance between the house and bluff is maximized. Four feet of minimum side-yard relief is required pursuant to §280-124(B) in order to reduce the existing nonconforming 14' side-yard setback to 11 feet where 15 feet is required, which in turn creates the need for relief to reduce the existing nonconforming total side yard of 27 feet by an additional 3 feet to 24 feet where 35 feet is required. Although the overall side-yard relief required is not negligible, the additional encroachment relative to what exists is limited to 3 feet. And because this additional encroachment is limited to the west side of the property, the easterly adjacent property is not affected by the change whatsoever; and the westerly adjacent property is vacant. Therefore, the additional encroachment will not create a significant change to the site, to neighboring properties, or to the character of the community. The relief necessary from §280-15(F) to situate the proposed swimming pool in a side yard also will not create a detrimental impact to the character of the community or neighboring properties. At least four of the bluff-front properties along Sound Drive have swimming pools located in the side yard, including the one located three properties to the east and one located farther to the east that was constructed with the benefit of variance relief(Case No. 5523). Due to the proximity of most of the existing dwellings to the bluff along this developed shorefront, the need to situate a swimming pool in a side yard is not unusual. 2. All of the requested relief is necessitated directly or indirectly by the proximity of the existing dwelling to the bluff. Specifically, the owners want to maximize the connection of the house to the outdoors and to the water as part of a renovation that will improve the dwelling for use as a permanent waterfront home on Long Island Sound. If not for the dwelling's proximity to the bluff, they would achieve that benefit by constructing the porch and deck onto the rear side of the house and locating the pool between the house and the water, all in conformance with traditional zoning requirements. But because of both the regulatory and practical need to stay as far from the bluff as practicable, the ability to maximize the use and views of the waterfront side of the house are constrained, resulting in a pressure to place to the side of the house structures that would otherwise be more desirably located to its rear. And in order to maximize the waterfront exposure of the porch, its width must be maximized, resulting in the need for side-yard setback relief; and the pool gets pushed into a defined side rather than rear yard. In either location (rear Mary_ Beth Henson "Area Variance Reasons" Page 2 of 2 or side), the structures would require area variance(s), so the owners are pursuing what we believe to be the less significant relief, i.e., side setback and yard relief and minimized bluff setback relief as opposed to significantly more substantial bluff setback relief, as would be required if all structures were proposed to the rear of the house. Consequently, the chosen design seeks the minimum relief necessary to achieve the desired benefit where the benefit cannot be achieved except by area variance relief. The relief requested from §280-116(A)(1) is mathematically substantial (61 feet) but not substantial relative to existing conditions because the renovated principal structure will not encroach any further upon the bluff than the existing principal structure. Also, because the minimum bluff setback will continue to be established by an unroofed deck, the use nearest to the bluff will also remain unchanged. The expansion of roofed structure will occur on the westerly side of the house, which is the side of the house located farthest from the bluff. The side-yard setback relief required from §280-124(B) for that expansion (porch) is arguably minor (4 feet or 26% relief) and creates only 3 more feet of an encroachment than existing conditions. Because the pool would be located no closer to the side yard than the dwelling and because the pool's designated location in a side yard is primarily the result of the roadward protrusion of the proposed conforming front-yard addition, the yard relief for the pool pursuant to §280-15(F) is not substantial. With respect to the physical and environmental conditions of the property and surrounding neighborhood, the project will not create any significant change to the developed nature of the property, and as a result of the incorporated mitigation measures, there will be a net improvement to the ecological condition of the site and adjacent waterway. Specifically, the existing minimum setback from the bluff to the principal structure will not be diminished; the only structure located closer to the bluff, a detached hot tub, will be permanently removed; and lot coverage will increase only minimally by 335 square feet. Existing lawn greater than twice this area will be removed in favor of a 10' wide nonturf buffer adjacent to the bluff. The property's ability to reduce and absorb runoff adjacent to the bluff will be further enhanced by the introduction of a drainage system of leaders, gutters, and drywells to capture and recharge roof runoff. The project is located landward of the jurisdiction of the New York Slate Department of Environmental Conservation but has been approved by the Town of Southold Trustees pursuant to the Town Wetlands Law. The project was also deemed by the Trustees to be consistent with the Town's LWRP after the Town's LWRP Coordinator similarly recommended that the project be deemed consistent as designed. 5. The difficulty with locating the proposed expansion without necessitating variance relief is not self-created due to the nonconforming location of the existing dwelling. With over 100 road ends terminating at creeks, bays, inlets, or Long Island Sound, as well as all of the lawns and homes lining our miles of shoreline, 100's of thousands of gallons of storm water runoff enters our wetlands every year. Carrying sediment that prevents sunlight from reaching aquatic plants, nutrients from animal waste and lawn fertilizers that promote algae blooms detrimental to shellfish, and bacteria and other biologicals that in high doses can be harmful to swimmers, storm water runoff is one of the Trustees main public safety concerns. So important, in fact, that Southold has a Storm Water Management Code. Southold Town's Chapter 236 provides an outline for how people need to deal with storm water runoff from their properties. For example, new construction or renovation is required to contain any potential runoff to the wetlands from the construction by installing hay bales and silt fencing. This acts as a barrier and keeps our wetlands clean. Another example in Chapter 236 is that every building must have provisions to collect and disperse, ON-SITE, at least a 2 inch rainfall. This is usually handled by installing gutters, leaders and drywells to the home. The Trustees also have a standing policy of requiring pervious non-turf buffers along bulkheads and at tops of bluffs that help keep run off from entering the wetlands and prevents erosion to bluffs. These are important measures to keep our wetlands safe and clean! Before deciding to renovate or build, the Town Trustees urge you to check our website and the other department's websites to make sure what you are planning to do meet the Town's Codes. These codes have been developed for the good of all citizens. And the wildlife all around us too!
