SCTM# 1000-111-7-3 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. PROPERTY FACTS/DESCRIPTION: Subject property is improved with a single family dwelling. It has 100.00 feet of frontage on Haywaters Road, 250.00 feet along the north property line, 100.00 feet on the east property line and 250.00 feet on the south property line as shown on the survey last dated 5-12-2011 prepared by John C. Elhers, LS. BASIS OF APPLICATION: Request for Variance from Article XXIII Code Section 280-124 and the Building Inspector's March 28,2011 Notice of Disapproval based on an application for building permit to construct a screen porch addition to a single family dwelling at 1) side yard setback of less than the code required 15 feet. RELIEF REQUESTED: The applicant proposes a screen porch addition to the rear of the dwelling at 12 feet from the side property line where the code requires 15 feet. ADDITIONAL INFORMATION: The existing dwelling was granted a variance in 1958 (Appeal No. 120) for a garage addition at 5 feet from the side yard and another variance for a rear deck addition in 2003 (Appeal No. 5240) at 12 feet from the side property line. The deck addition was never constructed. The proposed screened porch is noted at 12 feet from the side property line, the dwelling currently exists at 4.5 feet from the side property line. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on July 7, 2011, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The existing one story dwelling is 19 ft. high to the roof ridge and the proposed screened porch on the rear of the dwelling is only 17 ft. high to the ridge. Therefore, it, and the proposed adjoining deck, will not be visible from the street. Also, the rear and side yards of the subject property are heavily screened by mature evergreen trees. The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant could reduce the size of the screen porch addition and achieve a conforming side yard setback. However, the existing siding and doors on the rear elevation of the house were located to accommodate the eventual construction of a deck based upon the side yard variance that was previously granted. Removal and relocation of these features would be a cost burden to the applicant. 3. Town Law l~267-b{3)(b)(3). The variance granted herein is mathematically substantial at a requested relief of 20% from the code. However, the proposed setback of 12 ft., is more conforming than the 4.5 ft. side yard setback of the existing house and maintains the setback previously granted by the ZBA. 4. Town Law §267-b(3){b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The proposed screened porch will meet the onsite drainage code. 5. Town Law §267-b(3)(b}(5). The difficulty has been self-created. However, the existing dwelling is situated 4.5 feet from the side property line. The proposed porch is requested at 12 feet from the side property line and the configuration of the rear door is such that the proposed location is most cost effective. 6. Town Law §267-b. Grant of requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a screen porch while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Goehringer, seconded by Member Weisman (Chairperson), and duly carried, to GRANT, the variance as applied for, and shown on the survey last dated 5-12-2011 prepared by John C. Elhers, LS. And the architectural drawings dated revised 5/6/2011, pages 1 of 3 and 2 of 3, prepared by Donald G. Feller, Architect. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Depa~nent of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action.
