SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated June 8, 2011 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP: This application has been reviewed under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action is CONSISTENT with LWRP policy standards and therefore is CONSISTENT with the LWRP, provided that the upgraded sanitary system is relocated greater than 100 feet from the wetlands, drywells are installed for storm water runoff and a hay bale line is in place during construction. PROPERTY FACTS/DESCRIPTION: Subject property is improved with a one-story framed house and three detached cottages; each of which has a pre Certificate of Occupancy. The subject lot has 284.24 feet along Peconic Bay Blvd., 238.99 feet along the western property line, 175.93 feet along the northern property line and 218.35 feet along the eastern property line as shown on the survey dated March 17, 2011 prepared by Peconic surveyors. BASIS OF APPLICATION: Request for Variance from Code Section 280-123 and the Building Inspector's May 19, 2011 Notice of Disapproval based on an application for building permit for additions/alterations to a non- conforming building at; 1) a nonconforming building containing a nonconforming use shall not be enlarged unless the use of such building is changed to a conforming use. RELIEF REQUESTED: The applicant proposes to construct an addition and do alterations to the cottage closest to the northern property line in order to add one bedroom and one bathroom. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on July 7, 2011, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: Page2 July 21, 2011 ZBA File#6481 - D'Addario CTM: 1000-1264-172 1. Town Law §267-b(3}(b)O~. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The proposed expansion of the subject cottage will not result in any appreciable increase in the use of the property because the entire lot is a residential compound containing 4 legal dwellings that are used by a single family. The subject cottage has been in its location and use since prior to zoning. The proposed addition is approximately 260 square feet and will not be seen from the street or adjacent properties 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance because the code does not permit the expansion of a pre- existing non-conforming structure without a variance. 3. Town Law §267-b(3)(b)(3). The variance granted herein is not substantial and represents an increase of less then 9% of the total living area on this lot. The proposed expansion will be limited to one bedroom with bathroom 4. Town Law §267-b{3){b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant testified that as a result of construction on this cottage the septic system will be upgraded to meet today's more stringent standards and rain water run offwill be controlled by installing a drainage system ofdrywells. 5. Town Law ,li}267-b(3)(b){5). The difficulty has been self-created. The request to increase the degree of non- conformity is a self created hardship. However, the Board finds that allowing the proposed modest increase in the livable area of the subject cottage to accommodate a growing family will have a negligible impact on the coverage of the entire lot and therefore a variance is warranted in this instance. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an enlarged family cottage while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Dinizio, seconded by Member Weisman (Chairperson), and duly carried, to; GRANT, the variance as applied for, and shown on the survey dated March 17, 2011 prepared by Peconic Surveyors and Architectural plans dated April 5,2011 prepared by Mark K. Schwartz, AIA labeled A-1 & A-2. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department ora building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity.
