SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this
application and determines that this review falls under the Type II category of the State's List of Actions, without
further steps under SEQRA.
SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk
County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its
reply dated June 8, 2011 stating that this application is considered a matter for local determination as there appears
to be no significant county-wide or inter-community impact.
LWRP: This application is not subject to review under Chapter 268 because the variance relief requested does not
involve features that relate to a regulated natural feature or a bulkhead or other shoreline.
PROPERTY FACTS/DESCRIPTION: Subject property is a vacant lot zoned R-80 it contains .92 acres. The lot
has 150.00 feet of frontage on Hill Crest Drive North, 225.00 on the eastern property line, 149.02 feet on the south
property line and 289.99 feet on the western property line as shown on the survey dated 5-11-11 prepared by
Robert B. Holzman, LS.
BASIS OF APPLICATION: Request for Variance from Code Section 280-13 based on an application for building
permit to build a sports court on a vacant lot, and the Building Inspector's March 2, 2011, Amended April 18, 2011
Notice of Disapproval stating that the use of a sports court is not permitted on a vacant lot (without a
principal dwelling).
RELIEF REQUESTED: Accessory structures are not permitted on a vacant lot without a principal dwelling. The
applicant proposes to construct a 30 ft. x 50 fl accessory "sports court" structure on a vacant lot without the benefit
of a principal dwelling.
ADDITIONAL INFORMATION: The subject pamel is presently vacant, unimproved, heavily treed and vegetated.
The subject parcel adjoins another parcel owned by the applicant that is improved with a residential dwelling and
an accessory swimming pool. At the public hearing, the adjoining property owner to the south of the applicant's
dwelling parcel had testified in opposition to granting the requested variance.
FINDINGS OF FACT/REASONS FOR BOARD ACTION:
The Zoning Board of Appeals held a public hearing on this application on July 7, 2011, at which time written and
oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and

surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant
and makes the following findings:
1. Town Law §267-b(3){b){1}. Granting of the requested variances will produce an undesirable change in the
character of the neighborhood or a detriment to nearby properties. There are no parcels in this neighborhood, which
contain an accessory structure that is not accessory to a principal dwelling. What the applicant proposes is
uncharacteristic of the neighborhood.
2. Town Law §267-b{3}(b}(2). The benefit sought by the applicant can be achieved by methods feasible for the
applicant to pursue, other than an area variance. There is area in the rear yard of the applicant's adjoining property,
which has a principal dwelling, to construct the subject sports court without the need for a variance. The applicant
may also merge the subject parcel with his adjoining improved parcel and then construct the proposed sports court
in the proposed location as an accessory structure in a conforming location without the need for a variance. The
applicant could also apply for a lot line change to add the portion of his adjoining unimproved lot he wishes to use
for the location of a sports court and then construct said sports court as of right.
3. Town Law §267-b(3)(b)(3). The variance granted herein is substantial. The request represents a 100%
relaxation of the code. A granting of the requested variance would effectively require a change of use from
residential R-80.
4. Town Law §267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential
community will have an adverse impact on the physical or environmental conditions in the neighborhood. It has not
been shown that residential sports courts and their use pose any adverse impact to the physical or environmental
conditions in a neighborhood. However, the applicant stated at the public hearing that the clearing of trees and
some re-grading on the subject parcel would be necessary to create an open fiat area in which to locate the
proposed sports court and to provide access from Hill Crest Drive North for construction equipment.
5. Town Law §267-b(3)(b)(5) The difficulty has been self-created. The applicant purchased the parcel after the
Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the
limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase.
6. Town Law §267-b. Denial of the requested relief is the minimum action necessary and adequate to preserve
and protect the character of the neighborhood and the health, safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under
New York Town Law 267-B, motion was offered by Member Schneider, seconded by Member Horning, and duly
carried, to
DENY, the variance as applied for.
Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or
survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action
does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the
Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action.
The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of
nonconiBrmily.

Southold Town Assessors' Office, or Real Property Office at the County Center, Riverhead. If
you know of another address for a neighbor, you may want to send the notice to that address as
well. If any letter is returned to you undeliverable, you are requested to make other attempts to
obtain a mailin,q address or to deliver the letter to the current owner, to the best of your ability,
and to confirm how arran.qements were made in either a written statement, or durin.q the
