SOPER II, 2244 Las Casita Drive, Wellington, Florida 33414, party of the second part, WITNESSETH, that the party of the first part, to whom ancillary letters testamentary were issued by the Surrogate's Court, Suffolk County, New York on June 24, 1994 (835 P 1994) and by virtue of the power and authority given in and by said last will and testament, and/or by Article 11 of the Estates, Powers and Trusts Law, and in consideration of Three Hundred Thousand and 00/100 ($300,000.00)-------------------------------- --------------------------------------------------------------------------dollars, paid by the party of the second part, does hereby grant and release unto the party of the second part, the distributees or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being in th at Fishers Island, Town of Southold, County of Suffolk and State of New York, being more particularly bounded and described as set forth on Schedule A hereto, said plot, piece or parcel of land also being known and designated as Lot 4-H in Block 17 on the Map of Fishers Island Development Corporation, which Map was filed in the Office of the Suffolk County Clerk on September 25, 1991 as Map No. A421. SUBJECT TO an easement for pedestrians and vehicles granted by the party of the first part as appurtenant to and for the benefit of the premises adjoining the subject premises on the southwest known as Lot 4-G in Block 17 on the Map of Fishers Island Development Corporation, said easement and certain rights to relocate the same being more particularly described in the deed recorded in the Office of the Suffolk County Clerk on March 15, 1996 in Liber 11766 page 262 and on Schedule A hereto. BEING AND INTENDED TO BE the same premises as those described as "THIRD TRACT" in the deed to Roger S. Firestone, dated October 26, 1953 and recorded in the Office of the Suffolk County Clerk on November 2, 1953 in Liber 3605 page 37• TAX MAP DESIGNATION Dia. sec. Blk. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances, Lot(,): and also all the estate which the said decedent had at the time of decedent's death in said Premises, and also the estate therein, whirls the party of the first part has or has power to convey or dispose of, whether individ- ually, or by virtue of said will or otherwise; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the distributees or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. Coast and Geodetic Survey Triangulation Station "Chocomount 2" (which said "Choconnount 2" monument is located on the sunmmit of the highest hill on Fishers Island, N.Y. about two and one-quarter miles West of the Eastern end of Fishers Island and lies South 79 degrees 29 minutes 46 seconds East of North Dumpling Light in Fishers Island Sound); and RUNNING THENCE Nath 43 degrees 36 minutes 20 seconds West, 284.88 feet to a point; THENCE North 62 degrees 42 minutes 10 seconds West, 34.88 feet to a point; THENCE North 11 degrees 16 minutes 50 seconds East, 186.40 feet to a point; THENCE North 48 degrees 05 minutes 34 seconds East, 111.14 feet to a point; THENCE South 45 degrees 6 minutes East, 324.46 feet to a point; THENCE South 21 degrees 46 minutes 40 seconds West, 277.26 feet to a poipt; and THENCE North 68 degrees 56 minutes 20 seconds West, 20 feet to the monument set at the place of BEGINNING.
