CONANT, JR. and ELLEN R. CONANT, his wife, residing at 123 N. Bemiston, St. Louis, Missouri 63105, parties of the first part, and ELLEN R. CONANT, TRUSTEE UNDER THE INDENTURE OF TRUST OF ELLEN R. CONANT dated June 17, 1996, residing at 123 N. Bemiston, St. Louis, Missouri 63105, parties of the second part, WITNESSETH, that the parties of the first part, in consideration of Ten Dollars ($10.00), lawful money of the United States, and other good and valuable consideration paid by the parties of the second part do hereby grant and release unto the parties of the second part, and to their heirs and assigns forever, an undivided one-half (1/2).interest in the following property: �e See Exhibit A TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises. TO HAVE AND TO HOLD the premises herein granted unto the parties of the second part, heirs and assigns forever, AND the said parties of the first part covenant as follows: FIRST, That the parties of the first parties seized of the said premises in fee simple, and have good right to convey the same. SECOND, That the parties of the second part shall quietly enjoy the said premises; THIRD, That the said premises are free from encumbrances; FOURTH, That the parties of the first part will execute or procure any further necessary assurance of the title to said premises; FIFTH, That the parties of the first part will forever warrant the title to said premises. SIXTH, That the grantor, in compliance with Section 13 of the Lien Law, covenants that the grantor will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and that the grantor will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. EXHIBIT A ALL that certain lot or parcel of land at Fishers Island in the Town of Southold, Suffolk County, New York, bounded and described, as follows : BEGINNING at a stone monument set on the North- easterly line of the land of the Grantors, said monu- ment being One thousand seven hundred fifty-seven and seventy-eight hundredths feet North of a point which is Five thousand four hundred eight and thirty- five hundredths feet West of another monument marking the U.S. Coast and Geodetic Survey Triangulation Station "PROS" and thence along said Northeasterly line North 46 degrees 58 minutes West Thirty-five feet to a point, being the POINT OF BEGINNING and being the Northeasterly corner of the parcel hereby described; and running thence South 43 degrees 02 minutes West One hundred feet to a point; thence South 39 degrees 24 minutes 10 seconds East Thirty- two and fifty-eight hundredths feet to a point; thence South 19 degrees 25 minutes. West One hundred ninety- two and seventy-one hundredths feet to a point which point is One thousand five hundred one and sixty-two hundredths feet North of a point which is Five thous- and five hundred forty-five and fifty-six hundredths feet West of said PROS monument, said last three courses abutting the right-of-way hereinafter des- cribed; thence leaving said right-of-way and running the followin four courses along land owned by the Grantors, (11 North 53 'degrees 41 minutes 50 seconds West Eighty-seven and ninety-eight hundredths feet to an iron pipe, (2) North 39 degrees 26 minutes West Seventy-three and sixty-four hundredths feet to a point, (3) North 50 degrees 38 minutes West One hun- dred sixty and forty-six hundredths feet to an iron pipe, and (4) North 50 degrees 38 minutes West Seventy- two feet, more or less, to the shore of Fishers Island Sound; thence following the meanders of said shore- line in. a Northeasterly direction, Three hundred sixteen feet, more or less, to a point at the inter- section of the Northeasterly line of the land of the Grantors and the shore of said Fishers Island Sound; thence South 46 degrees 58 minutes East Three hun- dred seventy-three feet, more or less, to the point of beginning; containing 2 . 45 acres, more or less; TOGETHER with the riparian rights, if any, and the right, title and interest of the parties of the first part, if any, in and to the lands now or formerly under water and the shores, beaches and uplands immediately in front of and adjoining the premises above described; SUBJECT, HOWEVER, to the rights, if any, of the United States Government or New York State, to change or alter the shore line of Fishers Island Sound adjoining the above tract to establish harbor, bulkhead or pierhead lines and to take land now or formerly under water without compensation; TOGETHER, also with a non-exclusive easement for ingress to and egress from any above described tract over the right-of-way leading to Reservoir Road, said right-of- way being bounded and described as follows : BEGINNING at a point at the most Northerly tip of a private road of the Grantors known as Reservoir Road, said point being One thousand two hundred ninety-five and four hundredths feet North of a point which is Five thousand six hundred ninety-three and forty hundredths feet West of said PROS monument; and running thence North 29 degrees 46 minutes East Thirty-one and thirty-four hundredths feet to a point of curve to the right having a radius of Two hun- dred and eight feet, the direction of which radius at that point is South 60 degrees 14 minutes East; thence following the arc of said curve a distance of Eighty-seven and seventy- three hundredths feet to a point of curve to the left having a radius of One hundred eighty-one and seventeen hundredths feet, the direction of which radius at that point is North 36 degrees 04 minutes West; thence following the arc of said curve a distance of One hundred eight and forty-nine hun- dredths feet to a point; thence North 19 degrees 25 minutes East Twenty-nine and ninety-nine hundredths feet to a point, which point is One thousand five hundred one and sixty-two hundredths feet North of a point which is Five thousand five hundred forty-five and fifty-six hundredths feet West of said PROS monument;
