WITNESSETH,that the party of the first part, in consideration of Ten Dollars and other valuable consideration paid
by the party of die second part,does hereby grant and release unto the party of the second part, the heirs or successors

BEING AND INTENDED TO BE the undivided one—third ( 1/3 ) interest in and
to the same premises acquired by the party of the first part by deed
from Scribner L. Fauver , Trustee , dated January 10 , 1996 and recorded
in the Office of the Suffolk County Clerk .

TOGETHER with all right, title and interest, if any,of the party of the first part of, in and to any streets and roads
abutting (lie above-described premises to the center lines thereof; TOGETHER with the appurtenances and all the
estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein
granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the
said premises have been encumbered in any way whatever,except as aforesaid.
AND the party of the first part,in compliance with Section 13 of the Lien Law,covenants that the party of the first part
will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund
to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment
of the cost of the improvement before using any part of the total of the same for any other purpose.
The word "party"shall be construed as if it read"parties" whenever the sense of this indenture so requires.

All those certain plots, pieces or parcels of land, with the
buildings and improvements thereon erected, situate, lying and
being at Fishers Island in the Town of Southold, County of
Suffolk and State of New York, bounded and described as follows:
PARCEL NO, 1
BEGINNING at a point, marked with an iron, on the Westerly line
of the 20 foot right of way shown on the Plan hereinafter
mentioned, leading Northerly from the highway leading to the
Peninsula, sometimes called Peninsula Road, said beginning point
being on the dividing line between the herein conveyed tract and
Lot # 32 , as shown on Said Plan;
RUNNING THENCE Southerly, along the Westerly line of said 20 foot
right of way, 130 feet to a point marked by another iron, said
point being the Northeasterly corner of Lot # 35 as shown on said
Plan;
THENCE Westerly, along the Northerly line of said Lot # 35, as
shown on said Plan, on a line forming an interior angle of 77
degrees 16 minutes, 164 feet, more or less, to the shore of Great
Harbor;
THENCE following the meanders of said shore, in a general
Northwesterly, Northerly and Northeasterly direction, 135 feet,
more or less, to a point, being the Southwesterly corner of Lot
# 32 as shown on said Plan;
THENCE Easterly, along the Southerly line of said Lot # 32 , as
shown on said Pian, on a line at right angles to said Westerly
line of said 20- foot right of way, 111 feet, more or less, to
the Westerly line of said 20 foot right of way, at the point of
BEGINNING; containing thirty-eight hundredths of an acre, more or
less.
Being Lots 33 and 34 as shown on a certain map entitled "Plan of
Peninsula at Fishers Chandlerd owny Palmer bEngrs Charles
Frances
G. Thorp, by Norwich, Conn.
1913", and filed in the Office of the Clerk of the County of
Suffolk on March 11, 1913, File No. 223 .
TOGETHER WITH all the right, title and interest, if any, of the
party of the first part in and to the shores and land under the
waters of Great Harbor in front of and adjoining said premises.
PARCEL NO. 2
Lots No. 35 and 36 as shown on plan of Peninsula at Fishers
Island and owned by Charles W. Hedge and Frances G. Thorp, made
by Chandler & Palmer, Engineers, Norwich, Conn. 1913 (revised
October 1951 - July 1953) and filed in the Office of the Clerk of
the County of Suffolk March 1913 , File # 223 - bounded on the
North by Lot # 34, on the South by Lot 37, on the West by Great
Harbor, on the East by Private Road.
