HomeMy WebLinkAboutL 11805 P 289 DISTRICT SEC nON BLOCK LOT ® = M �0121 0] 0 12QUITCLAIMDEED 21 20 THIS INDENTURE made this 22nd day of November, 1996, between MARY JEAN PELHAM, residing at 56 Irene Drive, Vernon, Connecticut, party of the first part, and THE PELHAM FAMILY LIMITED PARTNERSHIP, c/o Mary Jean Pelham, residing at 56 Irene Drive, Vernon, Connecticut, party of the second part, WITNESSETH, that the party of the first part, in consideration of ONE HUNDRED SEVENTY-FOUR THOUSAND DOLLARS ($174,000) paid by the party of the second part, does hereby remise, release and quitclaim unto the party of the second part, the successors and assignees of the party of the second part forever, All that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being in Fishers Island, Town of Southold, County of Suffolk and State of New York, being bounded and described as follows: BEGINNING at a monument on the easterly side of Montauk Avenue; said monument being located 1736.25 feet North of a point which is 666.11 feet West of a monument marking the United States Coast and Geodetic Survey Triangulation Station "Pros"; RUNNING THENCE North 44 degrees 53 minutes 10 seconds East along land now or formerly of Fishers Island Utility Company, Inc., 139.19 feet to an iron pipe on land now or formerly of John R. Hellier; THENCE South 23 degrees 53 minutes 10 seconds East along last mentioned land and along land now or formerly of Frances and Arthur Greenleaf 107.10 feet to a monument on lands now or formerly of Hannah S. Ladd; THENCE South 46 degrees 06 minutes 40 seconds West along last mentioned land 123.50 feet to a monument on the easterly side of Montauk Avenue; THENCE North 31 degrees 46 minutes 20 seconds West along said avenue 100.00 feet to a monument at the point or place of beginning. TOGETHER with such rights, if any, as the party of the first part may have in and to the 12-foot wide right of way from the above described premises to the shore of Great Harbor, said right of way being more particularly described in prior instruments of record, including those recorded in the Office of the Suffolk County Clerk in Liber 7846 page 551 and Liber 296 page 496. BEING AND INTENDED TO BE same premises title to which was acquired by Dorothy A. Adams by deed from Shirley H. Hall dated November 7, 1966 and recorded November 21, 1966 in Liber 6072 page 78 and by deed dated May 7, 1975 and recorded May 23, 1975 in Liber 7846 page 551. ALSO BEING AND INTENDED TO BE the same premises title to which was acquired by Mary Jean Pelham by deed from Neil E. Hansen, ancillary executor at Dorothy A. Adams, dated October 31, 1994 and recorded November 10, 1994 in Liber 11701 page 897. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to.said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the successors and assigns of the party of the second part forever. AND the party of the first part, in compliance with Section 13 of the Lien Law, hereby covenants that the party of the first part will receive the consideration of this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose.
