BEING AND INTENDED TO BE the same premises acquired by the party of the first part in three parcels by deeds, dated January 27, 1982, October 8, 1987 and May 31, 1993, respectively, and recorded in the Office of the Suffolk County Clerk on February 4, 1982, February 29, 1988 and June 28, 1993, respectively, in Liber 9138 page 515, Liber 1055O.- page 425 and Liber 11634 page 737, respectively, the party of the second part having also been a grantee in the second deed above mentioned. The description set forth on Schedule A hereto is a perimeter description of such three merged parcels. TOGETHER with all right, title and interest, if any. of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part. the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party, of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. Gary Party of the Second Part: Prudence G'bb Gary Deed Dated: F�ruq r1 , 1995 ALL that certain plot, piece or / parcel of land, with the buildings and improvements thereon erected, situate, lying and being in the Town of Southold, Suffolk County, State or New York, being a portion of Fishers Island, hereinafter called "Park", lying Easterly of the following line, viz: BEGINNING at the Southeasterly corner of land owned by the United States, known as the Fort H.G. Wright Military Reservation, Mount Prospect Tract, on the shars of Block Island Sound or the Atlantic Ocean and running thence Northerly following the East boundary of the said land of the United States to the Southerly line of East End Road sometimes called Oriental Avenue) and which point is the Northeasterly corner of land of the United States; thence crossing the East End Road and following the same course as the last to the shore of West Harbor or Fishers island Sound; said lot or parcel of land being bounded and described as follows: BEGINNING at a stone monument set on the Southerly side of a former road forty feet wide, said monument being 354 .97 feet North of a point which is 473 .31 feet East of another monument marking the U.S. Coast and Geodetic Survey Triangulation Station "Chocomount 2" (which said "Chocomount 2" monument is located on the summit of the highest hill of Fishers Island, N.Y. about two and one-quarter miles West of the Eastern end of Fishers Island and lies South 79 degrees 29 minutes and 46 seconds East of North Dumpling Light in Fishers Island Sound) ; and RUNNING THENCE South 7 degrees 28 minutes and 30 seconds West 240.80 feet to an iron pipe; THENCE South 13 degrees 04 minutes and 40 seconds West, 127 . 42 feet to a monument; THENCE South 2 degrees 40 minutes and 40 seconds West, 20. 00 feet to a point; THENCE South 87 degrees 19 minutes and 20 seconds West, 140 . 00 feet to a point on the easterly side of another road 40 feet wide; THENCE along the Easterly side of said road, North 12 degrees 16 minutes and 20 seconds West, 121. 16 feet to a stake marking a point of curve to the left whose radius is 108 . 65 feet and the direction of whose radius at that point is South 77 degrees 43 minutes 40 seconds West; THENCE Northwardly, still along the Easterly side of said road (and following the arc of said uuive) , 78.71 feet to a monument; THENCE North - 20 degrees 46 minutes and 15 seconds East, 220. 82 feet to an iron pipe set on the Southerly side of the former road first above mentioned; THENCE North 5 degrees 13 minutes 30 seconds West, 41. 09 feet to a monument on the Northerly side of said former road at a point of curve to the right having a radius of 296. 42 feet and the direction of whose radius at that point is South 17 degrees 33 minutes and 17 seconds West; R F C a R D E D U.h 0 mnr EDWARD P.ROMAINE 11717 K626 THENCE Eastwardly along the Northerly side of said former road (and following the arc of said curve) , 118 . 61 feet to a point of a curve to the right having a radius of 553 . 34 feet and the direction of whose radius at that point is South 05 degrees 22 minutes and 10 seconds West; THENCE continuing Eastwardly and following the arc of said curve, 107 . 67 feet to a monument; THENCE South 42 degrees 37 minutes 27 seconds West, 44 . 97 feet to the monument at the point of BEGINNING. / TOGETHER with an easement for ingress and egress from the said / premises over and along such private roads connecting the said premises with the public highway.
