Adoption of Meeting Minutes: · ACCEPTANCE OF MEETING MINUTES FROM JUNE 7, 2011 MOTION made by Sam McCullough, seconded by Maureen Cullinane, to accept the LPC meetin9 minutes from June 7, 2011. Motion carried: 6/0 Land Preservation Applications and Inquiries: · SCTM#1000-74.-2-22.1 (Spartan Holding Co.) Review new Open Space application Manny Sfaelos, landowner, submitted an LPC application for the sale of 9.63 acres near the intersection of Henry's Lane & Route 46 in Peconic. Landowner offered property to Town for approximately $500,000. LPC reviewed the proposed project and found that it is a Iow priority for preservation and they are not interested at this time. It was suggested that Mr. Sfaelos contact the County preservation program if he is interestin9 in pursuin9 preservation. SCTM #1000-75.-6-3.1; 3.2; 3.3 (John Scott) Review inquiry re: potential Open Space purchase John Scott, landowner, has expressed an interest to Ray Huntington for the sale of his approved 3-lot subdivision at the corner of Wells Road & NYS Rt 25, in Peconic for preservation purposes. The Committee discussed the worthiness of preservin9 this property including its proximity to Richmond Creek, scenic values, and drainage values. Members noted that there are drainage issues in the area, and although preservation would eliminate potential impacts by preventing development of the lots, it would not eliminate the existin9 drainage issue. Ray Huntington was directed to repor~ back to Mr. Scott requesting that Mr. Scott make a formal application to LPC including a specific offer price for the proper~y and to note that LPC showed little interest in this project at this time due to current fund availability but would consider a bargain sale if landowner is agreeable. SCTM# 1000-107.-5-1.1 (Swain) Review request to revise building envelope Louis Caracciolo (contract vendee to fee tile of Swain proper~y) presented his reasons for requesting a revised building envelope location to be centered along the southerly boundary of the proper~y, leaving '140' of preserved farmland on either side of the revised building envelope. This revised location from the southeast corner that contains a natural drainage area would have a lesser visual impact for neighboring proper~y owners. LPC was not in favor of the proposed relocation, mainly because it left a difficult piece to farm behind the proposed Reserved Area. The area behind includes a drainage swale with an existing erosion problem. After much review, LPC members suggested to Mr. Caracciolo, if he would consider relocating the building envelope in the southwesterly corner of the proper~y with 260' road frontage along Mill Lane. This location includes a swale also, but it is more likely, with building set-backs, not to impact development or farming This building envelope would be '120,000 sq ft, or 3 builder's acres. Mr. Caracciolo was agreeable. MOTION made by John Sepenoski, seconded by Eric Keil, to approve the relocation of the '120,000 sq ft building envelope to the southwesterly corner of the proper~y, with approximately 260 feet running along Mill Lane, and being 460' deep. Motion carried: 6/0 ADDITIONS TO AGENDA: · EDSON Property Survey, title and environmental reports are all in. Slight change was made to shape of Reserve Area resulting in the Reserve Area being just over 5 acres, and slightly reducing the size of the development rights easement area. Project is expected to close on August 3, 20'1'1. · STEIN Property Oysterponds Historical Society that inherited the proper~y is ready to present its preservation plan to the committee for review and are scheduled to attend July '12th LPC meeting. NEW SUFFOLK WATERFRONT FUND Property New Suffolk Waterfront Fund that recently purchased this waterfront proper~y from Peconic Land Trust is ready to present its preservation plan to the committee for review and are scheduled to attend July 12th LPC meeting. SHERWOOD HOUSE VINEYARDS LPC members have taken note that Sherwood House Vineyards is operating a retail business that is in violation of the terms of the recorded development rights easement. MOTION made by Allan Connell, seconded by Maureen Cullinane, that a letter be sent from the Committee to the Southold Town Board (copy to Damon Rallis, Zonin9 Inspector) that steps be taken to stop Sherwood House Vineyards from operatin9 a retail and non-agricultural production use while in violation of the Town Code and the terms of the recorded development rights easement. Content of the letter should include: It has come to the attention of the Land Preservation Committee that Sherwood House Vineyards recently re-opened the retail tastin9 room within the Easement area. The operation of the retail tastin9 room violates the terms of the recorded development rights easement and LPC request that action be taken to immediately stop Sherwood House Vineyards from operatin9 the retail tastin9 room within the Easement area. Be it noted, that on July 6, 20'10, the Land Preservation Committee 9ranted approval of deer fencin9 installation around the property subject to: The landowners receivin9 approval from Peter Harris, Superintendent of Highways, in regard to the landowners' request to locate part of the fence within the Town right-of-way alon9 Elijah's Lane; and · Resolution of the violation of the Easement with respect to the retail and non-agricultural production uses of the property occurrin9 within the Easement area. These conditions have not been satisfied and the deer fencin9 was installed without proper approval. Motion carried: 6/0 Applications & Inquiries for Uses or Structures on Preserved Property: None ADDITION TO AGENDA: · DOROSKI FAMILY LIMITED PARTNERSHIP Property Melissa received a telephone inquiry from Pat Moore, attorney for a potential buyer of the property on which the Town had purchased a development rights easement. The potential buyer is a wholesale flowers distributor and wants to build a 30,000 to 40,000 sq ft solar-powered barn for truck & equipment storage, nursery stock refrigeration, plantin9 & pottin9 operation, business office includin9 bathroom, alon9 with an $0,000 sq ft hot house, an irrigation well, and Ioadin9 docks. LPC will review further once formal Request for Agricultural Structure on Preserved Lands is received. LPC requested application to include a business plan showin9 why such a large barn is needed. Stewardship and Management: None General Land Preservation Items: AG PRODUCTION DEFINITION / EASEMENT Mary Wilson, Esq., Stephen Searl & Melissa Spiro to present information HOLD - Melissa recommended that a special meetin9 be scheduled to discuss this agenda item. She will be in contact with LPC members to arrange such a meetin9. Next Regular Meeting: o The next regular meetin9 will be held on July 12, 2011 at 7:00 p.m. in the Annex Executive Board Room. o Meetin9 scheduled for July 26, 20~1~1 will be cancelled.
