PARSONS, residing at 2 Brunswick Garden, London W84AJ, England, HARRIS B. PARSONS, Jr. , residing at 56 Cottage Street, Wellesley, Massachusetts 02181, C. REYNOLDS PARSONS, residing at 134 South Street, Medfield, Massachusetts 02052 and J. GEDDES PARSONS, residing at 102 Prospect Street, Providence, Rhode Island 02906, as Tenants In Common, parties of the second part, WITNESSETH, that the party of the first part, in consideration of One Dollar ($1 . 00) lawful money of the United States, paid by the parties of the second part, does hereby remise, release and quitclaim unto the party of the second part, their heirs and assigns forever, an undivided 20 .58% interest in and Lo ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being at Fishers Island, in the Town of Southold, County of Suffolk and State of New York, and described as : BEGINNING at a point on the northeasterly side of a private road which point is 3485 .35 feet north of a point which is 2820 . 94 feet west of a monument marked in the U. S . Coast & Geodetic Survey Triangulation Station "PROS" ; thence running north 430 34' 30" west 127 . 00 feet along said side of said private road; thence running north 290 39' 30" west 58 . 93 feet to the intersection of said private road with another private road; thence running along the southeasterly side of said other private road north 190 27' 30" east 96 . 66 feet to the intersection of another private road; thence running along the southwesterly side of said last mentioned private road south 510 58' 55" east 210 . 00 feet to a point; thence running south 370 37' 45" west 132 . 57 feet to the point or place of beginning. TOGETHER with all right, title and interest, if any, of the party of the first part of, in and to any streets and roads abutting the above-described premises to the center lines thereof, TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises, EDWARD P. A RECORDED sAN 11 1995 CLERK 0 UFFOLK SCOUNTY -2- THIS DEED, together with (i) a deed from the party of the first part to the parties of the second part dated December 18, 1992 and (ii) a deed from the party of the first part to the parties of the second part dated January 27, 1993 gives to the parties of the second part a 79 .42% undivided interest in the property. TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, their heirs and assigns forever. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose . The word "party shall be construed as if it read "parties" whenever the sense of this indenture so requires .
