Hill to Boisseau Avenue for its craft fair and retail sale, on Saturday~ August 20~ 2011

Southold School District to use certain roads for a 5K race in Southold~ on November 5~
2011 beginning at 8:30 AM, provided they file with the Town Clerk a One Million Dollar
Certificate of Insurance naming the Town of Southold as an additional insured and contact Capt.
Flatley upon receipt of the approval of this resolution to coordinate traffic control. The
preliminary route for the 5K: beginning at the Elementary School parking lot onto Oaklawn
Avenue to Route 25, east to Youngs Avenue, to Calves Neck Road, to Harper Road, Hill Road,
Wells Road, back to Oaklawn Avenue, to Pine Neck Road to Main Bayview Road to Main Road,
Jockey Creek Drive back onto the Sonthold School property. Support is for this year only, as the
Southold Town Board continues to evaluate the use of town roads. All town fees shall be
waived for this event

WHEREAS, the Town Board of the Town of Southold held a public hearing on the question of
the purchase of a development rights easement on a certain parcel of property owned by
Frederick Terry Revocable Trust and Ethel Terry Revocable Trust on the 7th day of June, 2011,
at which time all interested parties were given the opportunity to be heard; and
WHEREAS, said property is identified as part of SCTM #1000-19.-1-8.4. The address is 32210
Main Road (NYS Route 25), Orient. The property is located within two zomng designations, R-
80 (17.88± acres) and R-200 (17.44+ acres) and is situated at the southerly side of Main Road
(NYS Route 25), approximately 330 feet easterly from the intersection of Main Road (NYS
Route 25) and Old Main Road in Orient, New York; and
WHEREAS, the development rights easement comprises a part of the property consisting of
approximately 33± acres (subject to survey) of the 35.32± acre parcel. The exact area of the
development rights easement is subject to a survey acceptable to the Land Preservation
Committee and the property owners; and
WHEREAS, the easement will be acquired using Community Preservation Funds. This project
may become eligible for partial funding from a grant proposal submitted to the United States
Department of Agriculture - Natural Resources Conservation Service (USDA-NRCS). The
purchase price is $86,000 (eighty-six thousand dollars) per buildable acre for the 33± acre
easement plus acquisition costs; and
WHEREAS, the property is listed on the Town's Community Preservation Project Plan as
property that should be preserved due to its agricultural and scenic values and for the protection
of fresh and saltwater marshes and wetlands; and
WHEREAS, the purchase of the development rights on this property is in conformance with the
provisions of Chapter 17 (Community Preservation Fund) and Chapter 70 (Agricultural Lands
Preservation) of the Town Code, and

WHEREAS, the proposed action has been reviewed pursuant to Chapter 268 (Waterfront
Consistency Review) of the Town Code and Local Waterfront Revitalization Program
("LWRP") and the LWRP Coordinator has recommended that this action is consistent with the
LWRP; and
WHEREAS, the Land Preservation Committee has reviewed the application for the acquisition,
and recommends that the Town Board acquire the development rights easement; and
WHEREAS, the Town Board deems it in the best public interest that the Town of Southold
purchase the development rights on this agricultural land; and,
WHEREAS, the Town Board of the Town of Southold classifies this action as an Unlisted
Action pursuant to the SEQRA Rules and Regulations, 6NYCRR 617.1 et. Seq.; and,
WHEREAS, the Town of Southold is the only involved agency pursuant to SEQRA Rules and
Regulations; and,
WHEREAS, the Town Board of the Town of Southold accepted the Short Environmental Form
for this project that is attached hereto; now, therefore, be it
RESOLVED that the Town Board of the Town of Southold hereby finds no significant impact
on the environment and declares a negative declaration pursuant to SEQRA Rules and
Regulations for this action; and, be it further
RESOLVED that the Town Board of the Town of Southold hereby elects to purchase a
development rights easement on agricultural land owned by Frederick Terry Revocable Trust and
Ethel Terry Revocable Trust, identified as part of SCTM #1000-19.-1-8.4. The proposed action
has been reviewed pursuant to Chapter 268 (Waterfront Consistency Review) of the Town Code
and the LWRP and the Town Board has determined that this action is consistent with the LWRP.

SUPERVISOR RUSSELL: Again, thank you to the Terry family. It is nice to know that the
Terry farm is going to stay the Terry farm. Thank you.
COUNCILMAN KRUPSKI: And this actually, it is good timing because the Peconic baykeeper
was in today at our work session and he talked about the impacts of nutrients and other things in

the Bay and on the eco-system and everything and apparently, the agriculture isn't the big
offender. Now they realize it is all the septic systems that are putting not only nutrients that go
down the drain and where does it go? It gets mainlined into the aquifer and it ends up in the Bay
and by preserving a large block of farmland like that, you are really helping to preserve the
resource of Hallock's bay and the wetlands there. So it is really important that we do that.

COUNCILMAN TALBOT: RESOLVED that pursuant to the provisions of Chapter 17
(Community Preservation Fund) and Chapter 70 (Agricultural Lands) of the Town Code, the
Town Board of the Town of Southold hereby sets Tuesday~ June 7~ 2011~ at 7:32 p.m.~
Southold Town HaH~ 53095 Main Road~ Southold~ New York as the time and place for a
public hearing for the purchase of a development rights easement on property, owned by
Frederick Terry Revocable Trust and Ethel Terry Revocable Trust. Said property is
identified as part of SCTM #1000-19.-1-8.4. The address is 32210 Main Road (NYS Route 25),
Orient. The property is located within two zoning designations: R-80 (17.884- acres) and R-200
(17.444- acres) and is on the southerly side of Main Road (NYS Route 25), approximately 330
feet east from the intersection of Main Road (NYS Route 25) and Old Main Road in Orient, New
York. The proposed acquisition is for a development rights easement on a part of the property
consisting of approximately 334- acres (subject to survey) of the 35.324- total acres.
The exact area of the acquisition is subject to a Town-provided survey acceptable to the Land
Preservation Committee and the property owners. The easement will be acquired using

Community Preservation Funds. This project may become eligible for partial funding from a
grant proposal submitted to the United States Department of Agriculture - Natural Resources
Conservation Service (USDA-NRCS). The purchase price is $86,000 (eighty-six thousand
dollars) per buildable acre for the 33± acre easement plus acquisition costs.
The properties are listed on the Town's Community Preservation Project Plan as property that
should be preserved due to its agricultural and scenic values and for the protection of fresh and
saltwater marshes and wetlands.
FURTHER NOTICE is hereby given that a more detailed description of the above mentioned
parcel of land is on file in Land Preservation Department, Southold Town Hall Annex, 54375
Route 25, Southold, New York, and may be examined by any interested person during business
hours.
I have a copy that it was posted in the Suffolk Times on June 2, 2011. And I have notice that it
was posted on the Town Clerk's bulletin board on May 25, 2011. And a letter from the LWRP
coordinator, "The proposed acquisition is for development rights, the action has been reviewed
to chapter 268 of the LWRP program policies. Based upon the information provided on the
LWRP consistency assessment form submitted to this department as well as the records available
to me, it is my recommendation that the proposed action is consistent with the policy standards
and therefore is consistent with the LWRP." And that is it.
SUPERVISOR RUSSELL: Would anybody like to comment on this particular public hearing
with regard to acquisition of development rights on this parcel?
COUNCILMAN KRUPSKI: There is a map here if anyone would like to take a look at it. You
can see the parcel is located on the south side of the Main Road. If you look to the west, towards
Narrow River, it is surrounded by (inaudible) DEC open space. The state has purchased quite a
bit of property to the south also. So that to the east and to the north, most of the farmland has
been preserved through either county or town development rights program, so this is really one
of the last parcels in that area and it makes up quite a nice block of active farmland. And it
protects not only farming forever (inaudible). I would like to thank the Terry family, it is really a
great piece.
SUPERVISOR RUSSELL: It certainly has been a piece that has been at the top of the town's
priority list for a long time. I want to also thank the Terry family. This preservation program
works because of people like you and your willingness to work with the town and protect this in
perpetuity. Would anybody like to comment? (No response)

MARIE DOMENICI: Made Domenici, Mattituck. First I want to say, Scott, welcome back.
SUPERVISOR RUSSELL: Thank you.
MS. DOMENICI: I just have a question and this has been brought up at other meetings. The
thru traffic signs that we pulled down off of Aldrich and the last time we talked about this to see
where the DOT was with saying here is thru traffic. Have we made any strides in that area?
SUPERVISOR RUSSELL: Those signs are down now. It took a while but.
MS. DOMENICI: The signs are down but see, people who have driven that route for years will
automatically turn down there and if we put up thru trucking signs on the Main Road, that would
at least alleviate some of that tracking traffic through the residential communities. And we
spoke about this, I guess ....
COUNCILMAN TALBOT: Yes, Bill had the suggestion on that, the wording on that sign. I
guess he has seen it before.
COUNCILMAN RULAND: Well, thru truck traffic should use Route 25.
COUNCILMAN TALBOT: Yes. Something simple.
MS. DOMENICI: Right. Isn't that the DOT's domain?
SUPERVISOR RUSSELL: Yes. What we will do is we will refer it to the Transportation
Commission and have them contact the DOT and ask for that as a recommendation.
MS. DOMENICI: Okay. And the other question I have is, you are considering doing something
at the dump with gas or something. Can you give me something?
COUNCILMAN TALBOT: We are listening to all options.
SUPERVISOR RUSSELL: The gasification plant?
MS. DOMENICI: Yes.
SUPERVISOR RUSSELL: That is basically, it is very new technology. The town is just, the
gentleman approached the town with regard to possibly constructing a facility there, it would
basically, it is a gasification plant that would take all of our solid waste, gasify it, turn it into
electric and t hen feed the energy grid for LIPA. It is available for a substantial amount of tax
credits etc. for the investors because it is part of the alternative and renewable energy resources
that LIPA is desperate to add to its portfolio of energy. There is a long way to go, there is a lot
of nuts and bolts that we need to find out as a Board. Our due diligence is to determine whether
it is feasible, whether it is economically feasible, what is the scope and what is going to be the

framework under which we would allow this to be built there. There is a lot, we still plan on
meeting with these individuals and finding out more about it.
MS. DOMENICI: Now if we bum that gas there, is that going to have any impact on the
environment in a negative way? Because as it stands right now, Suffolk County, for 12 years in
a row has gotten an F for air quality.
SUPERVISOR RUSSELL: Right.
MS. DOMENICI: And I would have concerns, only if it has a negative impact.
SUPERVISOR RUSSELL: Of course. I would speak to that, in terms of the technology, there is
no emissions with, this isn't the incinerators that we are talking about from the old days. This is
new technology, heavily filtered. The emissions are nil. In fact, all the tracks that we are putting
on the road daily to get our garbage off of Long Island probably collectively and cumulatively
produces far worse in terms of air quality. You have to remember that we are trucking all of our
garbage out of town. They are headed to West Virginia, they are headed to Pennsylvania, they
are headed to other states for landfilling purposes. And from what we understand, this
technology does not produce emissions like the old incinerator plants.
MS. DOMENICI: So now are you also going to consider solar or wind ....
SUPERVISOR RUSSELL: That was all part of their presentation. What we did was we drafted
a letter telling them we are interested in what they have to say, we are not authorizing or signing
anything and that we have encouraged them to reach out to principal agents that they are going to
need the cooperation of, LIPA with regard to their interest in terms of getting this up and running
and feeding it to the grid and secondly, the DEC which actually regulates all uses in and around
the landfill because of the cap and we had sent that letter out, so we are inviting them to go sit
down with the powers that be to discuss the feasibility.
MS. DOMENICI: Okay. So then okay, so I am okay with that, as it stands now. As long as
them, like I said, no environmental impact then I certainly would support it ....
SUPERVISOR RUSSELL: We are looking at it as better for the environment. From an
economic standpoint, it is, you know, four to five million per megawatt for the construction of
the facility. That is a pretty substantial construction number. I don't think the town envisions
spending that money. From what has been presented to us, the investors are there because of
again, the tax credits and the federal initiatives for returnable and renewable energies. Those are
the types of things we are looking at though.
COUNCILMAN ORLANDO: We actually had three contractors come before us for the solar
panels on the landfill.
MS. DOMENICI: I remember.

COUNCILMAN ORLANDO: And they gave us a great presentation and we say yes, please
come but they never seem to come back so they must be hitting some sort of bumps in the road.
SUPERVISOR RUSSELL: I can tell you what, LIPA actually, the way LIPA has structured
their RFP's in the past, they basically said look, we have pressure from federal and state to
expand our renewable and alternative energy portfolio. Right now, I think they are supposed to
be at 2015 they are supposed to have about 20 % of their energy being from renewable sources
and they are about 8 %, so they have a long way to go. So LIPA would issue these RFP's in the
past, $50 million RFP and then you would see you know, BP and these people winning these
bids that sort of scattered alternative and renewable energies throughout the county. I think
LIPA has gotten a little bit sharper and they say, you know, every time we do that, we are
capping our own potential here because if we issue a $50 million RFP we know we are only
going to get a $50 million project. What they are doing now is they are changing their business
plan and they are allowing for more of that open door, bring your ideas to us type of approach.
That is where they are going with it, they recognize the east end as a huge potential in terms of
renewable and alternative energy sources, so they have a lot of interest in locating things out here
and again, they have created a more open door policy so the idea is, you bring your ideas to us.
And then we will vet these ideas and try to get these things situated.
COUNCILMAN TALBOT: Marie, there was also part of it was, we were talking about how
much energy we could create there but they don't let municipalities comingle their meters. They
do allow agricultural land to do it, you could have a piece of property and generate 100 kilowatts
of energy and then share it onto your other piece of property. We had, I brought up myself and
Councilman Krupski was there at another meeting, we asked the guys from LIPA, how come you
don't allow the municipalities do this when it directly would affect the taxpayers with a direct
savings? They haven't gotten to that point yet, to me that is the biggest thing. They should let
the municipalities marry their meters, then it would be a homerun for us because we have the
land there at the landfill to do it, plenty of acreage. If we put up wind turbines, you know, it is
70 feet approximately above sea level at that point and you could throw up wind turbines there as
well as solar panels and then if we could comingle our meters, you know, it would be a homerun
for everybody. Every taxpayer in town.
MS. DOMENICI: So who do you have advocating for ....
COUNCILMAN TALBOT: Well, we have been doing it with the five east end towns or the four
east end towns, Shelter Island had been on board with it...
SUPERVISOR RUSSELL: We worked with the Suffolk County Planning Commission, I
actually met with Kevin Law directly on it on several occasions. Of course, Kevin had since
moved over to I think the ....
MS. DOMENICI: The Long Island Association?
SUPERVISOR RUSSELL: Yes, the Long Island Association. But the idea was, we have an
application now for 100 kilowatt wind turbine and it is a very attractive idea and it is for a

private property in Cutchogue. This is almost a $300,000 almost $400,000 project. For the town
to spend that kind of money, we need to show the taxpayers that the benefits are there in terms of
the reduced cost to us, in terms of our electric consumption. But ill am only allowed to offset, if
we are only allowed to offset the consumption on site, we are just simply not consuming enough
from any one site that would make that type of investment justifiable to the taxpayers. If they let
us put it at the Peconic school, and they allowed us to mingle the meters of the Peconic school
and the rec center and they highway department and the police department, then we see the
benefits. We can spread the benefits out over four different accounts. If I just put it up at the
Peconic school and we are just using it to offset the electric you know, the Peconic school, even
when it is up and running which will be soon, is not going to consume the kind of electric that
would justify a $400,000 or $500,000 investment.
MS. DOMENICI: Right. If they allow the meter consolidation, then that would be much
better ....
COUNCILMAN KRUPSKI: Yes, right. And right now the energy industry, the way it is
physically put together, the bigger the structure, taller and the bigger the system, the more
efficient for your dollar for the amount of electricity generated. So you really don't want to put a
small system up even as, because there are a lot of systems in town, people can take a look at
them and see what they are like. So the town doesn't really need to put a small one up just to
show piece it.
MS. DOMENICI: Right.
COUNCILMAN KRUPSKI: Because it wouldn't pay.
COUNCILMAN TALBOT: Part of that group was the East End towns, Suffolk County
Planning Commission, the gentleman from National Grid and people from the industry. So that
was, it was a pretty good mix of people there. We have had five meetings so far.
SUPERVISOR RUSSELL: What Suffolk County has done is they have taken the initiative and
said look, let's get the towns to start adopting these encouraging pieces of legislation for
alternative and renewable energies. But let's make sure the town's are preparing similar
legislation, so when you apply in East Hampton you don't have a different experience as when
you apply in Southold. Chris is actually been representing the town at these meetings through
the Suffolk County Planning Commission to bring consistency to those codes of the East End, so
that you are facing similar issues in each of the towns. Not every code is going to be the same
because it isn't a one size fits all but they are going to be as similar as they can be, so that the
technology and the companies that are out there to roll out these alternative and renewables will
know in advance that the landscape is similar in each of the towns.
MS. DOMENICI: Does the Town of Southold participate in the clean energy task force
meetings at all?
SUPERVISOR RUSSELL: We don't have a representative right now at the clean energy task

force right now, no.
MS. DOMENICI: And the reason why I say that is because they have different municipalities
represented there so you have, you know, the town supervisor from this town and that town and
there is a lot of collaborations going on there and they have, they keep track of all of the
accomplishments of all the towns and they also list the towns that do not participate and there is
only two, so that, I mean, I know you need the resource for that but it is a good way to ....
COUNCILMAN TALBOT: Are you talking about green energy and stuff?.
MS. DOMENICI: No, it is called the clean energy task force meeting and it is held at Malloy
College in Farmingdale, they have like a quarterly meeting.
COUNCILMAN TALBOT: They did through us under the bus in that.
MS. DOMENICI: Did they? Oh, yes. Well, that is what I ....
COUNCILMAN TALBOT: Yes, but Southold has been very, very proactive. I think we
have ....
SUPERVISOR RUSSELL: A gentleman from Southold attended one of the meetings last year
and was proud of the fact that they actually mentioned Southold with its wind energy code.
COUNCILMAN TALBOT: I think we have more wind turbines than anybody out here. Sure.
SUPERVISOR RUSSELL: And we just changed the code again to accommodate and we are
making, you know, again, that industry evolves along with public mindsets and we are evolving
the code with the industry.
MS. DOMENICI: And just a reminder, who should I follow up with, with the traffic thru signs?
SUPERVISOR RUSSELL: You can, if you send an email to me, I will forward it to Chris and
the Transportation Commission.

JOHN BRADY: Hi, John Brady. Concerning solar panels, why do we increase the assessed
valuation.9 Why can't we not increase the assessed valuation if we put solar panels on the roof?.
SUPERVISOR RUSSELL: Actually, the, first of all, any real property improvement that adds to
the value has to be assessed by state law. But solar panels, whatever they add to the assessment
are 100 % exemptible, so that if you assessment goes up $800, your exemption is automatically
$800 under real property tax law of the State of New York, so any assessment increase is just on

paper, you don't actually pay more taxes for it.
