Evans Voter [] [] : [] [] [] Town Clerk's Appt Scott Russell Voter [] [] [] [] [] Supt Hgwys Appt [] No Action Comments regarding resolution 377 COUNCILMAN RULAND: I need to recuse myself as my wife is an employee of Family Service League. 2011-378 CATEGOR~ DEPARTMENT: Budget Modification Human Resource Center Programs for the Aging Enhancements Fiscal Impact: iVYS Office for the Aging -Grant In Aid - These program and building enhancements/improvements are May 24, 2011 Southold Town Board Meeting Minutes Page 4 being funded through a NYS Grant Program for Senior Center Improvements. This law shall be known as the "Prevention and Control of Noise Pollution Law of Southold Town." {}200-2. Purpose. The gentle pace of life in the Town of Southold has traditionally provided a respite from the noise and turmoil which has become an integral part of life in the city and suburbs and which has even encroached into many resort areas on the East End. Crafting of regulations that are uniquely appropriate for the Town of Southold are aimed to protect this rural, almost nostalgic way of life while providing an atmosphere for businesses to flourish. The May 24, 2011 Page 28 Southold Town Board Meeting Minutes existence of unreasonably loud, unnecessary disturbing or unusual noise within the Town has become an increasingly, significant problem during recent years. Such noise pollution which is prolonged, unusual or unnatural in its time, place and use is harmful to the peace, welfare, comfort, safety, convenience, good order and prosperity of the inhabitants of the Town of Southold. It is the public policy and findings of the Town Board that every person is entitled to noise levels that are not detrimental to life, health and the enjoyment of his or her property. The provisions and prohibitions hereinafter enacted are in pursuance of this policy and these findings and for the purpose of protecting and promoting the public health, comfort, convenience, peace, safety, welfare and prosperity of the Town of Southold and its inhabitants. §200-3. Statutory authorization. This chapter is enacted pursuant to § 10 of the Municipal Home Rule Law to promote the public health, safety and general welfare of Town citizens through regulations intended to govern noise pollution within the entire Town. §200-4. Definitions. As used in this Chapter, the following terms shall have their meanings indicated. AIRBORNE SOUND - Sound that reached the point of interest by propagation through the air. AMPLIFIED SOUND - Sound which has its volume increased by electronic means. CHARITABLE EVENT - An event whose sole purpose is to raise money for a specific charity or non-profit organization. COMMERCIAL SERVICE EQUIPMENT - All engine-powered or motor-powered equipment intended for infrequent service work in inhabited areas, typically requiring commercial or skilled operators. Examples of commercial service equipment are chain saws, log chippers, paving rollers, etc. CONSTRUCTION DEVICE - Any powered device or equipment designed and intended for use in construction. Examples of construction devices are air compressors, bulldozers, backhoes, trucks, shovels, derricks and cranes. dB(A) - The A-weighted sound level in decibels, as measured by a general-purpose sound-level meter complying with the provisions of the American National Standards Institute specifications for sound-level meters, properly calibrated and operated on the A-weighing network. DECIBEL ("dB") - The unit for measuring the volume of a sound based upon the pressure level of a sound. For the purpose of this chapter, the standard reference pressure stated herein will be used to assure a consistent and standard reference for measuring sound. HOMEOWNER'S LIGHT RESIDENTIAL OUTDOOR EQUIPMENT ~ All engine-powered or motor-powered garden or maintenance tools intended for repetitive use in residential areas, typically capable of being used by a homeowner. Examples of homeowner's light residential outdoor equipment are lawn mowers, garden tools, riding tractors, snowblowers, snowplows, etc. May 24, 2011 Southold Town Board Meeting Minutes Page 29 NOISE POLLUTION - Airborne or amplified sound which: A. Causes temporary or permanent hearing loss in persons exposed; or B. Is otherwise injurious, or tends to be, on the basis of current information injurious to the public health or welfare; or C. Disturbs a reasonable person of normal sensitivities; D. Exceeds standards or restrictions established herein; or E. Interferes with the comfortable enjoyment of life and property or the conduct of business. The following are deemed to interfere with the comfortable enjoyment of life and property or the conduct of business: 1. Yelling or shouting that disturbs the quiet, comfort or repose of person or persons residing or occupying an adjacent or neighboring property. 2. The using of, operating of or permitting to be played, used or operated, any radio, receiving set, musical instrument, phonograph, television set or other machine or device for the producing or reproducing of airborne or amplified sound in such a manner as to disturb the peace, quiet and comfort of the person or persons residing or occupying an adjacent or neighboring property. PERSON - An individual, association, firm, syndicate, company, trust, corporation, department, bureau or agency or any other entity recognized by law as the subject of rights and duties SOUND-LEVEL METER - An instnnnent for the measurement of noise and sound levels including a microphone, amplifier, an output meter and frequency weighting networks which comply with standards established by the American National Standards Institute (ANSI) specifications for sound-level meters. § 200-5. General prohibition. No person or persons owning leasing or controlling the operation of any source of noise on any lot or structure within the Town shall permit the establishment ora condition of noise pollution. Except as provided in §200-6, the use of amplifiers, speaker or other machines or devices capable of reproducing amplified or airborne sound from the premises, dwelling or building within the Town shall be considered noise pollution and shall be prohibited at all times. § 200-6. Standards. No person shall create or cause to be emitted any noise pollution which when measured on a sound-level meter at or beyond the property line closest to where the noise is generated or from the property line of a complaining property owner exceeds the following standards: A. Sunday through Thursday: (i) from 7:00 a.m. to 7:00 p.m. airborne or amplified sound in excess of 65 dBA; and (ii) from 7:00 p.m. to 7:00 a.m. airborne or amplified sound in excess of 50 dBA. B. Friday and Saturday: (i) from 7:00 a.m. to 11:00 p.m. airborne or amplified sound in May 24, 2011 Page 30 Southold Town Board Meeting Minutes. excess of 65 dBA; and (ii) from 11:00 p.m. to 7:00 a.m. airborne or amplified sound in excess of 50 dBA. § 200-7. Exceptions. A. The provisions of §200-5 and §200-6 shall not apply to the following: 1. The intermittent or occasional use between 7:00 a.m. through 9:00 p.m. of homeowner's light residential outdoor equipment with mufflers or commercial service equipment, provided that such activities and such equipment and their use comply with the other provisions hereof. 2. Construction activities between 7:00 a.m. through 7:00 p.m. and the associated use of construction devices or the noise produced thereby, provided that such activities and such equipment and their use comply with the other provisions hereof. 3. Noise from agricultural equipment. 4. Noise from church bells or chimes used. 5. Noise from snowblowers, snowthrowers and snowplows when operated with a muffler for the purpose of snow removal. 6. Non-amplified noise generated from lawful athletic or recreational activities, events, or facilities. 7. Non-amplified noise-organized activities sponsored by any school district, private school or fire district or department within the Town of Southold. 8. Noise from municipally sponsored celebrations or events. 9. Noise from lawful fireworks displays, parades, and other charitable and special events held in accordance with all pertinent provisions of the Southold Town Code. 10. Noncommercial public speaking or public assembly activities conducted on any public space or public right-of-way. 11. Emergency construction or repair work. 12. Noise from the activities of any fire department, ambulance squad or similar emergency or rescue organization in carrying out their official duties. 13. Noncommercial amplified sound that does not exceed the noise Standard established in §200-6 of this chapter. 14. Emergency stationary and mobile signal devices. 15. Audible exterior burglar alarms in operation for 15 minutes or less. § 200 - 8. Enforcement. The provisions of this chapter shall be administered and enforced by the Southold Town Police Department and the Southold Town Office of Code Enforcement. § 200- 9. Penalties for offenses. A. Any person who shall violate any provisions of this chapter shall be guilty of a violation punishable by a fine not exceeding $500; and upon conviction of a subsequent offense, punishable by a fine not exceeding $2,500. If the violation is of a continuing nature, each one hour period of violation of any provision of this chapter shall constitute an additional, separate and distinct offense. I have a notice that it was posted on the Town Clerk's bulletin board on April 27, that it was printed in the Suffolk Times on May 17 and we have a couple of letters here. One is from Martin Sidor, chairman of the Planning Board. "Thank you for the opportunity to provide comments on the proposed amendments to the town code referenced above. The Planning Board has reviewed the proposed amendments to Chapter 277 to allow for larger wind turbines and supports this change. We have also reviewed the proposed changes to Chapter 280 to clarify accessory apartments in accessory structures and supports that amendment as well." From Jennifer Andaloro, the Assistant Town Attorney "The proposed action has been reviewed to New York State Department of Environmental Conservation regulation 6 NYCRR part 617 as was referenced by Councilman Krupski, that is in consultation with Principal Planner Mark Terry, the action as proposed is a Type II action, therefore not subject to SEQRA review" and a letter from Andrew Freleng, Chief Planner Suffolk County, "Pursuant to the requirements of Section A 14- 14 through A 14-25 of the Suffolk County Administrative Code, the above referenced application which has been submitted to Suffolk County Planning Commission is considered to be a matter for local determination as there is no apparent significant countywide or intercommunity impact. A decision of local determination shall not be construed as either an approval or a disapproval." One more, "The proposed local law has been reviewed to Chapter 268, Waterfront Consistency Review of the Southold Town Code and the LWRP policy standards. Based upon the information provided to this department as well as the records available to me, it is my recommendation that the proposed action is consistent with the LWRP policy standards and therefore is consistent with the LWRP. Would anybody like to comment on this particular proposed local Frank Wills, Mattituck, Energy Committee FRANK WILLS: Good aRemoon, my name is Frank Wills, I live in Mattituck. Aside from that, I am a member of the Renewable and Alternate Energy Commission of the town committee. The Town. We had quite a discussion about, this is the wind turbines, and if my recollection is correct, the limit that is under those discussions was 100 kilowatts. I am surprised to see now that it has been raised to 125. Maybe I am wrong but part of my memory still works. But I was wondering how come? COUNCILMAN TALBOT: Well, at the initial outset, it did come out as 100 and then we had discussed it and it went back to you guys and it was raised to 125. SUPERVISOR RUSSELL: I think what happened is there was an understanding that may or may not have been correct, that Riverhead's was at 125, so we wanted to be consistent and go to 125. to be candid, the machines are at 100, then they will go larger. I don't think the 100 versus the 125 matters much in terms of what is at the current market. You could probably correct me if I am wrong but 100 seems to be the sweet spot in terms of economic viability for these. So as long as we are coveting what the needs of the local industry are. COUNCILMAN KRUPSKI: And we didn't want the town to be the one to limit the energy production. MR. WILLS: Okay. Supervisor Russell SUPERVISOR RUSSELL: (No response) Would anybody else like to comment on this particular local law? Closing Comments Supervisor Russell SUPERVISOR RUSSELL: That would conclude the business of the agenda. Would anybody like to comment on any issue before the Town Board? Ann? Anne Murray, East Marion ANN MURRAY: Ann Murray from East Marion. A couple of things. First I want to thank you on behalf of the East Marion Community Association for finally putting a noise ordinance to a public hearing. As you know, we have been hoping that this would happen for a couple of years now and I am very grateful to see that. We will probably make some comments at the public hearing and encourage our members to do so as well and the second thing is, I am also glad to see that you are acting on the Factory Avenue problem. I know it is not an East Marion issue but I sympathize a lot with those folks. It has been a terrible problem for a really long time so I am really happy to see that you are acting on it. SUPERVISOR RUSSELL: The Town Board will, you know, the Police Chief just informed us today that he is retiring. We just literally found out in the afternoon of the work session. The Town Board will look at its options over the next couple of weeks. MS. MURRAY: Am I correct that the Town Board is effectively the sort of Police Commission? SUPERVISOR RUSSELL: We are the Police Commissioners. Yes, that is right. MS. MURRAY: So you appoint the Police Chief?. SUPERVISOR RUSSELL: Yes. MS. MURRAY: Okay. Thank you very much. SUPERVISOR RUSSELL: Okay. Mr. Meinke? Howard Meineke HOWARD MEINKE: Hi, my name is Howard Meinke, I live in Laurel. I just wondered, what is the most recent attitude here about the KACE property? That is apparently rearing its ugly head again and seemingly it is up to the town to allow Greenport to be able to take over some property. Is there any sense that the town is going to do that? SUPERVISOR RUSSELL: I don't think there is any support from this Town Board or any previous Town Board to allow for the annexation of that property. It is a matter of litigation, we did have a discussion in executive session. I can't discuss the details of executive session but I can tell you, I think I speak for the entire Board when I say there is absolutely no support to allow for the annexation of that environmental property into the Village. MR. MEINKE: Thank you. SUPERVISOR RUSSELL: Would anybody else like to comment? Pete? Supt. of Highways Peter Harris PETER HARRIS, SOUTHOLD TOWN SUPERINTENDENT OF HIGHWAYS: I just have a few things I would like to, a couple of questions but first I would like to make a statement. I would just like everyone in Southold Town to know that as of yesterday afternoon, the spring leaf and brush cleanup had been completed from Orient to Laurel. And I would only ask that the good people of Southold, if they see anyone depositing anymore debris out on the sides of the road, please contact the code enforcement officer. It was approximately six to seven weeks to get it done and it was, we were hoping to have it done prior to Memorial Day so people that have families out, barbecues whatever, they didn't have to look at the ugly mess still laying out in front of their homes. It has been completed, we had a lot of inclement days that we still were out there and we were able to complete it, so please, it is over. So please, I mean, I already know that there is stuff out, has been put back out but it has got to come to a point in this town where May 24, 2011 Page 44 Southold Town Board Meeting Minutes this town has got to put their foot down. We give them the service and to just assume that a week and a half after we have been through, that you are just going to put another pile out and say they will be back, sorry, we have got a lot more things to take care of now. So that is the first thing. My first question is on 408 and, about the standard decibels of airborne amplified sound. Friday, Saturday 7:00 AM to 11:00 PM. Does this mean that if a neighbor has a barking dog, that that dog can bark until 110:00 at night? SUPERVISOR RUSSELL: The current code actually already speaks to barking dogs. And owners are required under the current code to silence barking dogs. MR. HARRIS: Is there a time frame, Scott? SUPERVISOR RUSSELL: At any time. There is no specified, you are not allowed to have your dog barking to the injury of neighbors at any time. MR. HARRIS: I understand dogs bark but sometimes neighbors aren't so neighborly, that they, maybe they don't, out in the way back back they have got the dog and the house is up in the front, yet everybody else is being serenaded so, okay, thank you very much for that answer. My second thing is that I listened in earnest on 413 and it seems like a lot of legal stuff. Could someone explain that to me, can you kind of explain that to me in general, can you kind of explain that in general terms. COUNCILMAN ORLANDO: You don't want all the tax lot numbers again. MR. HARRIS: No, I don't need all the numbers, I just, you know, I was trying to follow it and it just seems like I was trying to grasp it because I didn't get a chance to really read it prior to the meeting. But if maybe Martin or someone up on the Board could just .... COUNCILMAN KRUPSKI: The storm damage, the day after Christmas, which wiped out part of Town beach parking lot, it also wiped out part of the shoreline next to Soundview Avenue. But the Town beach, the Town owned the property right up to the Sound, which is state property. At Soundview Avenue, the Town owned 66 feet of roadway but to the north, to the Sound side of that, there are those other and maybe Mr. Orlando can read those tax parcels again, but there is all those tax parcels there that are privately owned between the road that the Town owns and Long Island Sound. So in order to do restoration work on the bluff, in order to protect the roadway, the town has to get easements from those individual property owners to put, it is going to be a very minimal structure, but to put sand down also to protect the road. MR. HARRIS: Okay. So are, I mean, I understand because we blocked the road off as it is to protect the traveling public at this time. Are we going to put some type ora hardened structure at the base, is that part of the plan? COUNCILMAN KRUPSKI: The current plan is for a row of either two or three boulders high at the base. It is sort of an unconsolidated boulder revetment. Not a bulkhead. May 24, 2011 Southold Town Board Meeting Minutes Page 45 MR. HARRIS: Alright. Now the fact that the (inaudible) where we are getting an easement and that people did suffer a hardship but that was mother nature. COUNCILMAN KRUPSKI: Right. MR. HARRIS: And it just seems to me that the fact that government is going to restore the entire thing at the cost of the government and once it is completed, little staircases that go down to the beach and those nice little signs that say private, keep out, go back up and I just, when that December 26 storm happened, because we had had a storm, a nor'easter earlier in the year where we got emergency clearance to dump some material because the embankment was going away and I had gotten a couple of phone calls from a resident that owned property directly across the street and he said, when are you going to start dumping material here and I said, well, we are going to put some material there just to in an emergency situation but you as a property owner, you, in my opinion and I am not a lawyer but in my opinion, you as a property owner have as much responsibility to protect me, the taxpayer from allowing your property to get washed away so that it puts me as a taxpayer in jeopardy. So that is just me talking and I am not talking as an elected official. I am talking as a taxpayer, that I feel that there is a certain responsibility there that if you want to, if you want to own property facing Long Island Sound or Peconic Bay or Dune Road, you have a certain responsibility as the property owner to protect your property and not expect everyone else to pay for it if something goes awry. COUNCILMAN KRUPSKI: Well, Martin can answer that legal question. SUPERVISOR RUSSELL: Let me just quickly say that the easements in place for this are only for the rock revetment for the need of shoring up the roadbed for you, for your public road. We are not restoring the beaches there. Any reference in this language that talks about trucking sand, that is sand to Town beach, the public asset. In other words .... MR. HARRIS: Wouldn't we also, Scott, be hauling material in to dump over the embankment to shore that (inaudible) SUPERVISOR RUSSELL: Yes, to backfill the revetment that we are constructing. MR. HARRIS: Not the beach, I am not talking about the beach. The beach is the beach. I am just talking about private property that got washed away that was eroding very rapidly to public property. That is my point. COUNCILMAN KRUPSKI: We feel that after 5 months, this is our only recourse to protect the town road. And we are not going to restore, like Scott said, we are not going to restore their beach .... MR. HARRIS: No, I know we are not, because the beach has somewhat started to replenish itself naturally but I am just saying, it is private property. Thank you.
