Subject to the rights of others to pass over in vehicles and on foot a portion of the above described tract which is described as follows: Beginning at the most southerly corner this described tract , said point being located 3882 . 56 feet North of a point which is 2828 . 94 Dist. 1, 000 feet West of the monument marking the United States Coast and Sec. 0600 Geodetic Survey Triangulation Station "PROS" and running thence Nortl Blk. 0500 80 degrees 30 ' 40" West 50. 86 feet to a monument; thence North 20 Lot. 5,2 degrees 05 ' 30" East 68.50 feet to a point; thence North 73 degrees 25 ' 30" East 97. 57 feet to a point; thence South 16 degrees, 34 ' 30" East 50 . 00 feet to a point; thence South 73 degrees, 25 ' 30" West 72 . 45 feet to a monument; thence South 20 degrees 05 ' 30" West 34 . 04 feet to the point of beginning. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consid- eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose.
