Dear Mr. Samuels:
The Board of Trustees reviewed the site plan prepared by Thomas C. Samuels R.A. last revised
May 20, 2011 and determined the proposed demolition of the existing single-family dwelling,
construction of new dwelling on pilings, new sanitary system with fill, new permeable driveway
and attached two-car garage to be out of the Wetland jurisdiction under Chapter 275 of the
Town Wetland Code and Chapter 111 of the Town Code.
Therefore, in accordance with the current Wetlands Code (Chapter 275) and the Coastal
Erosion Hazard Area (Chapter 111 ) no permit is required. Please be advised, however, that no
construction, sedimentation, or disturbance of any kind may take place seaward of the tidal
and/or freshwater wetlands jurisdictional boundary or seaward of the coastal erosion hazard
area as indicated above, or within 100' landward from the top of the bluff and/or wetlands
jurisdictional boundary, without further authorization from the Southold Town Board of Trustees
pursuant to Chapter 275 and/or Chapter 111 of the Town Code. It is your responsibility to
ensure that all necessary best management practices are taken to prevent any sedimentation or
other alteration or disturbance to the ground surface or vegetation within Tidal Wetlands
jurisdiction and Coastal Erosion Hazard Area, which may result from your project.
This determination is not a determination from any other agenCy.

Samuels & Steelman Architects on behalf of JAMES & DENISE MARTIN requests a Wetland
Permit to demolish the existing single-family dwelling and abandon the sanitary system;
construct new dwelling on pilings and sanitary system with fill; new permeable driveway; and
attached two-car garage. Located: 2740 Deep Hole Dr., Mattituck. SCTM#123-4-11
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment
Form submitted to this department, as well as the records available to me, it is my
recommendation that the proposed action is INCONSISTENT with the below noted policies of
the program and therefore is INCONSISTENT with LWRP.
4.1 Minimize losses of human life and structures from flooding and erosion hazards.
The following management measures to minimize losses of human fife and structures
from flooding and erosion hazards are suggested:
Minimize potential loss and damage by locating development and structures
away from flooding and erosion hazards.
Avoid development other than water-dependent uses in coastal hazard
areas. Locate new development which is not water-dependent as far
away from coastal hazard areas as practical.
a. No development is permitted in natural protective feature areas, except
as specifically allowed under the relevant portions of 6 NYCRR 505.8.
The proposed new location of the residence is a Beach and the
construction of a residential structure on a Beach is not permissible.
Chapter 275
BEACH --
defines a "Beach "as:
The zone of unconsolidated earth that extends landward from the mean
Iow water line to the seaward toe of a dune or bluff, or whichever is most
seaward. Where no dune or bluff exists landward of a beach, the landward
limit of a beach is 100 feet landward from the place where there is a
marked change in material or physio.qraphic form from the line of
permanent vegetation, whichever is most seaward. Shore lands subject to
seasonal or frequent over wash or inundation are considered to be
beaches.
It is recommended that the structure be located further landward.
Move existing development and structures as far away from flooding and
erosion hazards as practical. Maintaining existing development and
structures in hazard areas may be warranted for:
A. structures which functionally require a location on the coast or in
coastal waters.
B. water-dependent uses which cannot avoid exposure to hazards.
c. sites where relocation of an existing structure is not practica/.
The proposed use is a single family residence, not water dependent and
does not meet criteria a throuqh c above.
The proposed location is located in Flood Zone X -
Areas of 0.2% annual chance flood; areas of 1% annual chance flood with
averaqe depths of/ess than 1 foot or with a drainage area less than 1
square mile.
The area within Flood Zone X is surrounded by Zone AE (el 6). To
minimize property damage and/or health safety and welfare of the
occupants of the new residential structure it is recommended that the new
residential structure be re-located landward adjacent to Deep Hole Drive
and in line (not project further seaward) with existing residential structures
on the adiacent parcels.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in
preparing its written determination regarding the consistency of the proposed action.

LWRP CONSISTENCY ASSESSMENT FORM
A. INSTRUCTIONS
All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt action* including Building Permits
and other ministerial perrnits not located within the Coastal Erosion Hazard Area.
Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfi'ont Revitalization Program. A proposed action will be evaluated as to its significant
