(631) 765-1809 Fax (631) 765-9064 FINDINGS, DELEBERATIONS AND DETERMINATION MEETING OF JUNE 10, 2010 ZBA FILE #6377 NAME OF APPLICANT: Allison Tupper SCTM# 1000-87-3-41 PROPERTY LOCATION: 3050 Minnehaha Blvd., (adj. to Corey Creek) Southold, NY SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review fails under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated March 11, 2010 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP: This application has been reviewed under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action is EXEMPT from LWRP review. PROPERTY FACTS/DESCRIPTION: The Applicant's property is a non-conforming, 11,154 square foot, waterfront parcel looated in the R-40 District. The westerly lot line measures 105 feet along Minnehaha Blvd., the northern lot line measures 92.40 feet, the easterly lot line measures 107.05 feet along Corey Creek, and the southern lot line measures 131~97 feet. The parcel is improved with a single- family dwelling, as shown on the survey drawn by John C. Ehlers, Land Surveyor, dated August 11, 2009. BASIS OF APPLICATION: Request for Variance from Code Section 280-116B, based on an application for building permit for additions and alterations, and the Building Inspector's November 19, 2009, updated March 1, 2010 Notice of Disapproval concerning additions and alterations to existing dwelling, at less than the code required setback from bulkhead of 75 feet. RELIEF REQUESTED: The applicant proposes to construct additions and alterations with a setback of 40.6 feet from the existing bulkhead, where 75 feet is required. The proposed construction is for (two) second story dormer additions to the waterside of the dwelling. ADDITIONAL INFORMATION: A letter, in support of the application, was received by the Zoning Board from an adjacent neighbor. FINDINGS OF FACT/REASONS FOR BOARD ACTION: ~' 2- June 10, 2010 ~BA Fi1¢#6377- Allison Tupp~r CTM: 1000-87-3-41 The Zoning Board of Appeals held a public hearing on this application on May 20, 2010 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board fmds the following facts to be true and relevant and makes the following findings: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following f'mdings: 1. Town Law §267-bO)(b)(1). Grant of the variance of will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicant proposes to increase the size of an existing dormer by adding approximately 8 feet to each side. The proposed construction will not be visible from the street, it will not increase the existing 40.6 setback from the bulkhead and it will not increase the existing height of the existing dwelling. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. Nearly the entire house is built within the 75 feet of the bulkhead therefore any attempt to add to the livable space of this house would result in the need for a variance. 3. Town Law §267-b(3)(b)(3). The variance granted herein is not substantial. The expansion of the dormer will result in approximately 160 sq. fi. of headroom in an existing second floor bedroom. 4. Town Law §267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental 'conditions in the neighborhood. The new construction and resulting inspections by the Building Inspectors will insure that the building will comply all of our current laws with respect to the environment. There will be no increase in the existing footprint of the dwelling. 5. Town Law §267-b(3)(b}(5). The difficulty has been self-created. To the extent that the code requires a 75 foot setback from the bulkhead the hardship has been self created, however, when consideration is given to the fact that the house has existed for more than 45 years with the same setbacks this modest increase in living space is justified. 6. Town Law §267-b. Grant of is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of additional living space while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF TH~ BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Dinizio, seconded by Member Goehringer, and duly carried, to GRANT, the variance as applied for, and shown on the plans labeled Proposed Second floor addition prepared 10/21/09, revised 2/25/10 by Boulevard Planning P.C. Architects pages A-1 and A-2 of project number 0911. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for.an alteration that does not increase the degree of nonconformity.
