W I T N E S S E T H:
That the party of the first part, in consideration
of ten dollars ( $10 . 00) lawful money of the United States and
other good and valuable consideration paid by the party of
the second part, does hereby grant, bargain, sell, assign and
release unto the party of the second part, the heirs or suc-
cessors and assigns of the party of the second part forever,
that dwelling unit (the "Unit" ) above the plane defined by
the top of the concrete foundation located on that certain
plot, piece or parcel of land situate, lying and being in the
Town of Southold, County of Suffolk, State of New York, de-
scribed as :
Lot 10 according to the major subdivision
plan prepared for Walsh Park Benevolent
Corporation and filed in the Office of
the Clerk of the County of Suffolk, State
of New York, as Map No. 8871, on December
22 , 1989 ( "Filed Map No. 8871 " ) ,
SUBJECT TO all restrictions, covenants and condi-
, E�J� tions set forth in that certain Ground Lease Agreement, dated
'* as of November 17 , 1989, between the party of the second
�o�4yja part, as lessee, and the party of the first part, as lessor,
\o o O as amended by Amendment Agreement regarding Ground Lease
Agreement, dated as of February 14, 1990 (the two agreements
<=>(z:, toOD collectively, the "GH Lease" ) , a memorandum of the GH Lease
m ao p having been recorded in the Office of the Clerk of the County
of Suffolk, State of New York, in Liber 11068 at Page 466 , on
pO 3 O( , May 16 , 1990, which GH Lease sets forth restrictions , cove-
nants and conditions which are identical to those set forth
in that certain Ground Lease Agreement, dated as of November
17 , 1989 , between Gregory C . Thibodeau ( "GCT" ) , as lessee,
and the party of the first part, as lessor, as amended by
Amendment Agreement regarding Ground Lease Agreement, dated
as of February 14 , 1990 (the two agreements collectively, the
"GCT Lease" ) , the GCT Lease having been recorded in the Of-
fice of the Clerk of the County of Suffolk, State of New
York, in Liber 11068 at Page 349 on May 16 , 1990; all such re-
