WITNESSETH, that the party of the first part, by virtue of the power and authority given in and by said last
will and testament and in consideration ofTEN ($10.00)
dollars, paid by the party of the second part, does hereby grant and release unto the party of the second part,
the heirs or successors and assigns of the patty of the second part forever,
ALL that certain plot, piece or parcel of land, known and designated as Lot #17 on a certain map entitled
"Map of Peconlc Bay Oaks, situate at Indian Neck, Peconic, Town of Southold, Suffolk County, New York,
owned and developed by Henry J. Smith and Stella M, Smith, his wife, Peeonie, New York" and filed in the
office of th~- Clerk of the County of Suffolk on October 18, 1961 as Map No. 3434.
TOGETHER with the right to use the 134.55 X 15.1 foot strip of waterfront beach as shown on said map for
recreational purposes.
BEING AND INTENDED TO BE the same premises conveyed to STANLEY SLAMA and BERTHA
V. SLAMA, both deceased, by deed dated July 3, 1965 recorded in the Office of the Clerk of the
County of Suffolk in Libor 5777 page 481.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the
appurtenances, and also all thc estate which the said decedent had at the time of the decedent's death in said
0rcmises, and also the estate therein, which the party ortho first part has or has power to convey or dispose
of, whether individual, or otherwise;
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or
suc~ssors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the fa'st part has not done or suffered anything
whereby the said premises have been incumbered in any way whatever, except as aforesaid.
AND THE party of the first part, in compliance with Section 13 of thc Lien Law, covenants that tho party of
the first part will receive the consideration for this conveyance and will hold the righ'~ to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement, and
will apply the same first to the payment of the cost of the improvement before using any part of the total of
the same for any other purpose.
The word "party" shall be consumed as if it read "parties" whenever the serme of this indenture so requires.
