PROPERTY FACTS/DESCRIPTION: The applicant's 13,000 square foot non-conforming parcel is located in the R-40 Zone with 228.86 linear feet along the arc of Grove Ddve. The property is improved with an existing one-story, single-family dwelling as shown on survey prepared by Young and Young dated May 23, 1972. BASIS OF APPLICATION: Request for a Vadance under Section 280-124, based on the Building Inspector's April 25, 2007 Notice of Disapproval, amended May 7, 2007 concerning proposed additions and altarations to the existing dwelling at less than 35 feet from the front lot line. SUFFOLK COUNTY ADMINISTRATIVE CODF' This application has been referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning has issued its June 11, 2007 determination stating that the application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on June 28, 2007, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicants seek a variance to extend the size of the first floor sunroom by 2.5 feet and to add a first floor wood deck, all as shown on the site plan prepared 5/15/07 by Frank Uellendahl, R.A. The setbacks requested are for a front yard setback of 22.9' from Page 2 - July 12, 2007 ~ ZB l=ile No. 6046 - Jeffrey and Carol Oak CTM No. 80-4-10.1 Grove Drive for the sunroom extension and 25.4 feet at its closest point from the first floor wood deck. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The current dwelling has a pre-existing non- conforming setback of 25.4 feet and is sited on this irregularly shaped lot so that the elevation facing Grove Drive, technically the 'front" elevation, is actually the side of the house. Other houses in the neighborhood are similarly sited at various angles to the street and at varying setbacks from the road. An additional 2.5 feet closer to Grove Street will not change the character of the existing house or neighborhood since the new elevation will look the same as the existing, and its new setback from the road will be almost unnoticeable. The applicant also proposes to construct a new wood deck across the "side elevation," through which one enters the house, replacing and extending the length of an existing stone terrace, to improve the property's entry and to create useful outdoor space. 2. The benefit sought by the applicants cannot be achieved by some method, feasible for the applicants to pursue, other than an area variance because the existing front yard setback is non- conforming at 25.4 feet and any proposed reduction in that setback will increase the degree of non- conformity. 3. The vadance granted herein is not substantial. The proposed sunroom extension is only 2% feet wide by the existing length of 23 ft. 10 inches long, which totals 60 square feet. The interior of the proposed extended sunreom is 11.7' wide. Anything smaller would not be usable for dining purposes. 4. The difficulty has not been self-created and is the result of the original sifting of the house on an irregularly shaped let with a non-conforming front yard setback. 5. No evidence has been submitted to suggest that a vadance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a sunroom and side deck extension, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Weisman, seconded by Member Oliva, and duly carded, to GRANT the variance as applied for, as shown on the 5/15/07 Plans A~I, A-3 and A-4 prepared by Frank Uellendahl, Architect. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code.
