THIS INDENTURE, made the 28th day of April, Two Thousand Eleven

party of the first part, and
MIRIAM FOSTER and R. GRAYSON MURPHY, as tenants in common, residing at 411 West
End Avenue, New York, New York 10024,
party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party of
the second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being at Orient, Town of Southold, County of Suffolk, and State of
New York~ being bounded and described as follows:
BECilNNING at a point on the westerly side of Village Lane, distant 142.70 feet northerly from
the comer formed by the intersection of the northerly side of State Street with the westerly side of
Village Lane, which said point of beginning is also where the northerly line of land of Joan
Turturro intersects the westerly side of Village Lane;
RUNNING THENCE along the northerly line of land now or formerly of Turturro, North 64
degrees 23 minutes 20 seconds West, 125.97 feet to land now or formerly of McCarthy;
THENCE along land now or formerly of McCarthy, North 25 degreees 59 minutes 10 seconds
East, 38.00 feet to land now or formerly of Benner and Perry;
THENCE along the last mentioned land, North 26 degrees 29 minutes 50 seconds East, 21.14
feet;
THENCE still along land now or formerly of Benner and Perry, South 62 degrees 57 minutes 40

BEING AND INTENDED TO BE the same premises conveyed to the party of the first pan by
deed dated September 23, 1986, and recorded October 6, 1986, in the Office of the Suffolk
County Clerk in Liber 10139, Page 104.
TOGETHER with all right, title and interest, if any, of~ the party of the f'trst part in and to any
streets and roads abutting the above described premises to the centex lines thereof; TOGETHER
with the appurtenances and alt the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
pm-t, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the right
to receive such consideration as a trust fund to be applied first for the purpose of paying the cost
of the improvement and will apply the same first to the payment of the cost of the improvement
before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "panics~ whenever the sense of this indentme so
requires.
