THIS INDENTURE, made the ~¢%ay of November, 2010
BETWEEN
FRANK MARTORANA, residing at 172 Baylawn Avenue, Copiague, New York, 11726, as to
SCTM~1000-115-17-10, and MINDY C. MARTORANA, residing at 172 Baylawn Avenue, Copiague,
New York 11726, as to SCTbl#ammmmmama, collectively the party of the first part, and
FRANK MARTORANA and MINDY C. MARTORANA, residing at 172 Baylawn Avenue, Copiague, New
York, 11726, as tenants by the entirety, the party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten ant[ 001100-($10.)-Dollars, and
other good and valuable consideration paid by the party of the second par1, does hereby grant and release
unto the party of the second part, the heirs or successors and assigns of the party of the second part
forever,
ALL that certain plot, piece or parcel of land, situate, lying and being at Mattituck, in the Town of Southold,
County of Suffolk and State of New York, bounded and described as follows:
BEGINNING at a point on the easterly side of Deep Hole Drive, said point being 1372.96 feet from the
corner formed by the southerly side of New Suffolk Avenue and the easterly side of Deep Hole Drive;
RUNNING thence along land now or formerly of Joseph Zlto South 79 degrees 00 minutes 00 seconds
East, 120 feet (deed), more or less, to a creek or gutter and land now or formedy of H. Alvin Smith and
another;
RUNNING thence southerly along said land, the tie line of said creek 120 feet, more or less, to land now
or formerly of Devries;
RUNNING thence along said land Nodh 79 degrees 00 minutes O0 seconds West, 150 feet (deed), more
or less, to the Easterly side of Deep Hole Drive;
RUNNING thence along Deep Hole Drive North 4 degrees 52 minutes 50 seconds East, 102.34 feet to the
point or place of BEGINNING.
Together with any accretions or land along or under said creek to the land formerly of H. Alvin Smith and
another.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by deed
recorded in Liber 12087 page 388 as to SCTM#~0, and deed recorded in Liber 12087 page
390 as to SCTrv~~0, as well as the same premises in corrections deeds recorded in Liber
12593 page 58 and Liber 12593 page 57, it being the parties' intention to merge both parcels into one
single parcel.
Regulated tidal wetlands associated with Deep Hole Creek are located at Suffolk County Tax Map
Number, District 1000, Section 115, Block 17, Lots 9 & 10, otherwise known as properties of Mindy C.
Martorana and Frank Martorapa, respectively, and their heirs, assigns, or successors. This property is
subject to the provisions of New York State Environmental Conservation Law (ECL) Article 25 or its
successors, and the conduct of regulated activities may occur only pursuant to ECL Article 25 if prior
approval is given by the New York State Department of Environmental Conservation (NYSDEC) or its
successor. Regulated activities include, but are not limited to the erection of any structure(s); excavation;
dredging; grading and filling; cleadng of vegetation; and application of chemicals within the area of
NYSDEC jurisdiction.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the
appurtenances and all the estate and rights of the party of the first part in and to said premises.
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever.

Whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the pady of the first part, in compliance with Seclion 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will ho~d the dght to recewe such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and
will apply the same first to the payment of the cost of the improvement before using any part of the total of
the same for any other purpose. The word "party" shalr be construed as if it read =parties° whenever the
sense of this indenture so requires.
