SCTM# 1000-56-2-8.1. SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type I1 category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated January 4, 2011 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP: This application is not subject to review under Chapter 268 because does not involge features that relate to a regulated natural feature or a bulkhead or other shoreline. PROPERTY FACTS/DESCRIPTION: Subject property is a conforming 43,734 sq. fi. lot, it is improved with two single-family dwellings and one detached frame garage, both of which are non-conforming in size, however have a Pm-Existing Certificate of Occupancy. The parcel is a flag type lot with 52.32 feet of road frontage on Laurel Avenue, 332.96 feet along the southern property line, 162.63 feet on the western property line and 366 feet on the northern property line as shown on the survey dated November 7, 2005 prepared by Stanley J. Isaksen, Jr. BASIS OF APPLICATION: Request for Variance from Code Sections 280-13 (A)(1) and 280-18 and the Building Inspector's October 26, 2010, amended April 19, 201 I, Notice of Disapproval based on an application for building permit for partial demolition and additions/alterations to the existing first floor and a second story addition to an existing single family dwelling at; 1) more than the code required one family detached dwelling, 2) less than the code required rear yard setback of 50 feet. RELIEF REQUESTED: The applicant proposes a partial demolition and first and second story additions with alterations to the southeasterly cottage on the subject property where the code states "one family detached dwelling, not to exceed one dwelling on each lot." This subject cottage is a second single family dwelling with a Pre CO. The applicant's proposed additions to the existing subject cottage are at 41.3 feet from the mar property line where the code requires 50 feet. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held public hearings on this application on March 3,2011 and June 2, 2011 at which time written and oral evidence were presented. Based upon all testimony, documentation, Page 2 June 15, 2011 ZBA File#6438 - Gaffga CTM: 1000-56-2-81 personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-b(3}(b}(1). Grant of the variance of will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The two dwellings have existed since prior to zoning on the subject property which is conforming in the R-40 zone. The total square footage of the new dwelling will be a modest 1,578 sq. fi., which is in keeping with the size of other dwellings in the neighborhood. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. Two houses have existed on this property for over 50 years, and the rear yard setback of the subject dwelling (the southeasterly cottage) became non-conforming at 42.7 feet from the property line when zoning was established. If the subject cottage was to be completely demolished and a new one built, then a conforming rear yard setback could be achieved. However, a new second dwelling could not be established on the subject property if the original cottage was demolished since the Pre CO would be invalidated and the code does not permit two dwellings on one property. 3.Town Law §267-b(3)(b)(3). The variance granted herein is substantial. The applicant is requesting a 100% relaxation from the code requiring one house per lot, however, the two houses have existed on this property since prior to zoning without any negative impact and both have Pre-CO's. The rear yard variance request for a 41.3 feet setback represents a 17% relaxation of the code required 50 foot setback. However, the house currently is situated at 42.7 feet from the rear property line and the applicant proposes to increase the degree of nonconformity of the rear yard setback by only 1.6 feet. 4. Town Law §267-b{3)(b}(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The new construction will bring the cottage into conformity with the sanitation, drainage and building codes 5. Town Law §267-b{3}{b){5}. The difficulty has not been self-created. The two homes have existed on this property since prior to the enactment of zoning. The subject house can not provide sufficient structural integrity to support the proposed additions and renovations without considerable demolition. 6. Town Law §267-b. Grant of this variance is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an up to date larger home on this conforming parcel. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Goehringer, seconded by Member Schneider, and duly carried, to GRANT, the variances as applied for, and shown on the site plan, floor plans and elevations dated April 11,2011 prepared by Robert C. Tast, A.I.A. - Architect. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconforrniiy. Gaffga of 125 Reeve Ave. Matituck, New York, I performed a structural inspection of the house located at 275 B Laurel Ave. Southold, New York, on November 23, 2009. The reasons for this inspection was to ascertain the structural condition of the building and determine the feasibility of renovating the existing structure in the future when the owner retires. Mr. Gaffga and architect, Mr. R. Tast were present and patticipated in the inspection. The weather wa§ cloudy and the temperature was approximately 45 degrees F. The following is a summary of the results of the inspection. A. HOUSE The house is a one story type, that was built around 1950. A small addition to the original building was constructed in the 1960s. The house has five (5) rooms (a Living Room, a Kitchen and two (2) Bedrooms, a Laundry Room and a full Bathroom plus an enclosed Porch. There is a small (approximately 10' by 12' ) full basement under the cena~l portion of the house that contains the furnace, hot water heater and electrical circuit breaker box. The portions of the house beyond the full basement have crawl spaces under them. B. SITE The house is located on a 1.004 acre lot and it faces south. There is an additional one story house and frame garage on the lot that are not a part of this inspection. The property is basically level. The driveway is blue stone gravel. C. EXTERIOR The siding is painted cedar shingles. The cedar shingles are in good condition except for the bottom edge on the southwest side that had been exposed to dampness due to presence of shrubbery. D. ATTIC Access to the Attic was by means of a hatch in the Kitchen ceiling, The roof rafters are 2 x 6 members spaced at 24 inches on center. There are 1 x 2 boards nailed at right angles to the roof rafters and are spaced at 8" on center. The roof sheathing is plywood that was most likely installed in the last 2 years when new asphalt roof shingles were installed. The condition of the roof structure is good. There were no signs of leakage or dampness in the Attic. The ceiling insulation is approximately 5 ½ inches thick. That provides an insulation R number of 19. The current recommended minimum R number for Long Island is 19 ( or 9 ½ inches of insulation). Page 1 E. ROOF The roofing consists of asphalt shingles. The present roof shingles were installed about 2 years ago. At that thne all the layers of old shingles were removed down to the roof sheathing. The roof now has one (1) layer of shingles. These shingles should be good for at least 25 years. The roof flashing around the chimney appears not to have been properly installed wMch may cause some minor leakage in the future. F. CHIMNEY The chimney is brick and is in good condition. There are no loose or missing bricks or loose and cracked mortar joints. There is a metal caps over the flue at the top of the chimney. G. ROOMS The house contains five (5) rooms, one (1) full bathroom and an enclosed porch. In general the condition of the rooms is good, There appears to be no structural cracks in the walls or ceilings. All the rooms have wood floors that are all in good condition except for a small area in the living room near the bathroom entrance where the floor exhibits termite damage on the underside. The Kitchen floor is covered with linoleum. There is a large water stain on the living room ceiling that was from before the roof was repaired according to Mr. Gaffga. Although there has been some heavy rain storms in the recent months no additional leakage was noted by the tenant. There is some minor deterioration of the ceiling adjacent to the chimney in the KITCHEN. The ceiling is a fiber board material with 1" x 2" wood strips over the joints. The ceiling height in all the rooms is approximately 7' - 3" which is sub standard. The cabinets in the Kitchens are painted wood and are in fair condition. All cabinets doors need hardware to hold them closed. The wood counter top in the Kitchens is in good condition. The sink in the Kitchens is porcelain and is in good condition. The electric outlets on either side of the Kitchen sink are not GFIC (ground fault interruption circuit) electrical outlets. All electrical outlets in bathrooms and kitchens near a sink should he GFIC type in accordance with the latest electrical codes. H. FULL BASEMENT Thc full basement is unfinished. Thc basement walls arc concrete block. That may have provided access for termites to attack thc wood portions of the building. There arc no windows in thc basement. The basement floor is a concrete slab. Access to thc basement is by means of a steep wooden stair down from the Laundry room. I. CRAWL SPACES There are crawl spaces under all portions of the building beyond the full basement area. The height of the crawl spaces varies from approximately 2 to 3.5 feet. Most of the crawl spaces can be accessed from the full basement. There are minor vertical cracks in the foundation walls of the crawl spaces. The floors of the crawl spaces are concrete. J. WINDOWS Thc windows in the house arc wood double hung type windows. These windows are in good condition, except for some small cracked glass panes. All windows have storm windows. TERMIITE INFESTATION Termites work very slowly. It takes many years for termites to do serious damage to a house. A mature, well-established colony of 60,000 termites will eat the equivalent of 2 to 4 feet of a 2 x 4 inch board in one year. In the recent past, termites were discovered in the wood post, floor girders, floor joists and wood flooring of this house. Due to the extent of the damage discovered, this termite infestation must have been in progress for a long time. Since the building foundation wails consists of hollow concrete blocks the termites most likely were able to travel up through the voids in the concrete blocks to access the wood members and also up through the wood posts supporting the girders. A termite exterminator was engaged to eliminate the termite infestation. A carpenter was employed to remove all the damaged wood girders and joists. The wood posts were replaced with a number of temporary steel jacking posts. An inspection in the basement and crawl spaces reveal a number of the existing termite damaged wood members still have not been replaced. A number of wood members were found to be deteriorated when probed with an awl. An area oftbe wood floor near the bathroom doorway was also found to be deteriorated due to termites. No current termite activity was noted by this inspection. All the deterioration appears to be the result of the original infestation. L. SUMMARY To summarize the results of this inspection, I will address the two separate purposes for the inspection as follows: 1) Structural Condition; The structural condition of the building is good. There are no immediate grave structural concerns that need to be attended to at this time. The remaining wood members that have not been removed and replaced should be attended to. The termite exterminator that did the original extermination job should be contacted to come and do a follow-up treatment if it is deemed necessary. 2) Feasibility of renovating the existing building in the future when the owner retires; It does not appear to be cost effective to try to expand the present building because of the temporary nature of some of the repairs made to date. It is advisable that a new floor system be installed. If the existing concrete block foundation wall are to be used the top course of blocks should have the voids filled with concrete and continuous metal termite shields be installed along the top of the foundation walls. This would necessitate the removal of the walls and roof. Page 3 . 2) Feasibility of renovating the existing building in the future when the owner retires; (continued) When the floor system is rebuilt and the building is expanded current existing substandard items can be address in the new construction such as: a) Sheet rock on the ceilings, b) a ceiling height of 8 feet. c) a heating system connected to all the rooms, d) energy efficient windows with permanent screens that do not require installing storm windows or screen depending on the season, e) additional insulation in the ceiling to increase the R number.
