(631) 765-1809 · Fax (631) 765-9064 ,JUN 1 2011 FINDINGS, DELIBERATIONS AND DETERMINATION MEETING OF JUNE 15, 2011 ZBA FILE: 6474 NAME OF APPLICANT: ALAN and PATRICIA NORDEN PROPERTY LOCATION: 2395 King St. Orient, NY SCTM# 1000-26-2-44 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated May 6, 2011 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP: This application is not subject to review under Chapter 268 because does not involve features that relate to a regulated natural feature or a bulkhead or other shoreline. PROPERTY FACTS/DESCRIPTION: Subject parcel is improved with a two story dwelling and detached two story garage. It contains 13,375 sq. ft. in an R-80 zone, with 71.35 feet of frontage on King Street, 187.89 feet along the north west property line, 72.85 feet along the northern property line and 186.92 feet along the south east property line as shown on the survey dated November 5, 2008 prepared by William R. Simmons, 3rd, L.S.P.C. BASIS OF APPLICATION: Request for Variance from Article XXIII Code Section 280-122 and the Building Inspector's March 24, 2011 Notice of Disapproval based on an application for building permit to construct a 3'X12' second floor addition to a single family; 1) pursuant to Walz (#5039) such addition will constitute an increase in nonconformance, 2) front yard setback of less than the code required 35 feet. Page 2- June 15,2011 ZBA File#6474 - Norden CTM: 1000-26-2-44 RELIEF REQUESTED: The applicant is proposing a second story bay window addition of 3.4'X 8.6' to the front of the dwelling, above the porch. It is setback 24 feet from the front property line where the code requires 35 feet. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on June 2, 2011, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267~b(3)(b){l}. Grant of the variance of will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The proposed modest 28 sq. fi. addition is above an existing front porch, it is a traditional architectural feature found throughout the area. 2. Town Law l~267-b(3){b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The house has a pre-existing location of 19.5 feet from the property line to the front porch. The proposed addition is requested at 24 feet, which is more conforming than the dwelling. Any additions to the front of the dwelling will require a variance. 3. Town Law §267-b{3}{b)(3). The variance granted herein is substantial. It represents a 31% relief request from the current code, however, the existing dwelling is situated closer to the road than the proposed addition. 4. Town Law §267-b{3'}{b){4} No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The proposed addition will be located above an existing front porch and all stormwater runoff will be contained on-site. 5. Town Law §267-b(3}(b)($). The difficulty has not been self-created. The dwelling has existed in its present location since prior to zoning. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a bay window addition while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Goehringer, seconded by Member Weisman (Chairperson), and duly carried, to Page 3 - June 15, 2011 ZBA File#6474 - Norden CTM: 1000-26-2-44 GRANT, the variance as applied for, and shown on the proposed site plan street elevation dated 4/15/11 prepared by Frank W. Uellendahl, Architect. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. Thc Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity.
