JAMES C. MCBURNIE AND MARILYN G. MCBURNIE, his wife,
residing at 1222 Ostrander Avenue, Riverhead, New York 11901, party of the first part, and
KEVIN MORIARTY AND TRICIA MORIARTY, husband end wife,
residing at 420 Taylor Avenue, Glen Ellyn, Illinois 60137, party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten and 00/100-($10.00)--Dollars, and
other good and valuable consideration paid by the parly of the second part, does hereby grant and release
unto the party of the second part, the heirs or successors and assigns of the party of the second part
forever,
All that certain plot, piece or parcel of land, situate, lyieg and being in the Hamlet of Cutchogue, Town of
Southold, County of Suffolk and State of New York, bounded and described as follows:
BEGINNING at a point on the westerly side of Case's Lane 50.0 feet northerly along said westerly line
from the southerly line o! Cedars Road from said point of beginning;
Running Thenc~ along a private road sometimes referred to as 'Case's Lane Extension' two courses:
1) North 74 degrees 57 minutes 30 seconds West, 150.0 feet;
2) North 11 degrees 45 minutes 40 seconds East, 144.64 feet;
Thence along land of B. Horton South 74 degrees 57 minutes 30 seconds East, 158.28 feet to said
westerly side of Case's Lane;
Thence along said westerly line, South 15 degrees 02 minutes 30 seconds West, 144.40 feet to the point
or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by deed dated
2115199, recorded 814/99 in Liber 11980 cp 542; the grantors herein being the same as the grantees in
deed recorded in Liber 11980 cp 542.
TOGETHER with all right, tit~e and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the
appurtenances and all the estate and rights of the party of the first part in and to said premises.
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever.
AN[;) the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and
will apply the same first Io the payment of the cost of the improvement before using any part of the total of
the same for any other purpose. The word "part~ shall be conslrued as if il read "parties" whenever the
sense of this indenture se requires.
