TOGETHER with all right, title and interest of the panics of the first part, of, in and to, Crescent
Avenue, ia front of and adjoining the above described premises, to the center line thereof.
TOGETHER with all right, title and Mterest of the parties of the first part of, in and to the land iying
~twcen the mean high water mark and mean iow water mark of Fishers Island Sound.
SUBJECT HOWEVER to the following casements and right of way;
Any and all easements given or to be given to Fishers Island Farms, Inc., Fishers Island Electric
Company and Fishers island Telephone Company, for the purpose of erecting and maintaining water
mains, telephone lines or electric lights lines where said water mains, electric or telephone lines may cross

SUBaECT HOWEVER to thc following covenants and restrictions which shall run with the land:
1. No business or ~mmereial enterprise shall be conducted on the above d~scribed premises other
than rental for residential purposes.
2. No buildings shall be erected upon the above described parcels of land other than one family

Any and all zoning ordinances or restrictions imposed by any governmental authority of
competent jurisdiction.

AND TO HOLD the premises herein granted unto the party of the second part, its successors and assigns
of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in v. ny way whatever, except as aforesaid.
AND the part of the first part, in compliance with Section I3 of the Lien Law, covenants that the party of
thc first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to [ag applied first for the purpose of paying the cost of the improvement and
will apply the same first lo the payment of the cost oflh~ improvement before using any part of the total
of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever
the sense of this indenture so requires.
