COMMENCING at the point formed by the intersection of the easterly line of First Street with the
northerly line of lands now or formerly of 414 First Street Corp., once of Baxth & Homart, said point of
beginning being distant 216.17 feet no~hedy as measured along the easterly side &First Street from the
comer formed by the intersection ofth~ northerly side of South Street with the easterly side of First Street;
RUNNING THENCE along the easterly line of First Street North 6 degrees 59 minutes 10 seconds West,
'50 feet to lands now or formerly of Grossman;
;THENCE along said lands, North 83 degrees 16 minutes 40 seconds East, 136.30 feet;
THENCE along lands now or formerly of Warner and along land~ now or formerty of Kulsziski, South 7
degrees O0 minutes 20 seconds East, 50 feet in all;
THENCE along lands now or formerly of 414 First Street Corp., South 83 degrees 16 minutes 40 seconds
West, 136.31 feet to the easterly side of First Street, the point or place of BEGINNING.
SUBJECT TO the following covenant which shall run with tM land for a period often (10)years and then
shall expire and be null and void: The name or description of any business or commercial enterprise
created at the subject premises shall not use the words "Yellow House Works of Art" or "Yellow House" or
any combination of these words.
BEING AND INTENDED TO BE the same premises conveyed tn the parties of the first part by deed
dated May 28, 2003 recorded in the Office of the Clerk of the County of Suffolk on June 11, 2003 in
Liber 12255 page 486.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereofi
TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said
premises.
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or guffered anything
whereby the said premises have been incumbered in any way whatever, except as aforesaid.
AND THE party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party
of the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the coat of the improvement, and
will apply the same first to the paymem of the cost of the improvement before using any part of the total of
the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the
sense of this indenture so requires.
