The Board of Assessment Review for the Town of Southold, has duly met to hear
Complaints or grievances on the tentative town assessment roll for the tax year 2011/12
as prescribed by law.
The Board, having duly convened, has considered each and every complaint or grievance
on the assessments for the tax year indicated, as filed with this Board, as prescribed by
law.
A majority of the Board has determined that all the changes indicated on the attached
page(s) will be made on the assessment roll by the Assessor.

about 1000-1200 square feet.

Gerard Schultheis: Why don't you tell us why you think you should get a reduction?
Ann M. Ver Pault: Ok, I believe I can get a reduction based on the comparable sales
within the last six months in the Town of Southold that are not water view, which my
house is not, not on the water; the sales that are shown there are 285, 290, 300 at the
most. They have garages, they have basements... I have a 3 ½ foot crawl space. I have
no garage. I did recently side the house but unfortunately that isn't going to bring it up to
360 or 400,000. IfI were to sell my house today as a realtor with 27 years experience I
would put the house on the market at no more than 309, and I would expect no more than
290 to 300 depending on which way the wind was blowing; and that would be after 4 to
12 months on the market if the market does not continue in the same spiraling condition
that it is currently in. And that is why.
Gerard Schultheis: You don't have an actual contract for sale?
Ann M. Ver Pault: No, I do not have a contract for sale and honestly I don't want to sell
my home. I would like to be able to stay here but the assessment is wrong.
Phyllis Atkinson: Darline, do you know what the RAR is for this year?
Dafline Duffy: I'm using the equalization rate which is 1.11. What is the RAR now?
Kevin Webster: 1.11 is our uniform percentage equalization rate; the RAR is 1.07
Jonathan Wiggins: 1.077
Phyllis Atkinson: Uh huh
Daniel McConlogue: So what market value does the assessment through oft'?.
Darline Duffy: Right now it is at 342,000
Daniel McConlogue: Thank you
Jonathan Wiggins: And Darline do you think that 342,000 is in keeping with what this
two bedroom house with no garage and no basement would bring in?
Darline Dully: I suspect...you know, I told you that 1 looked in my computer, my
computer is telling me that there is an appraisal in there so I'm suspecting I did an
appraisal a few months back so there's been sales since and we know we're in a declining
market so everything is...I can't find the appraisal, I apologize.
Ann M. Ver Pault: That's ok
Darline Duffy: The comparable sales that the homeowner submitted to don't have any
adjustments on it so I'm not really quite sure. I just wanted to point out a couple of
things about the sales. The fourth comparable was a short sale and the fifth comparable
was an estate sale and it wasn't even given to family. I don't know who is the
beneficiary for the estate but it's not in the family now so that was kind of just sold
off'...so I don't use either one of those.
Phyllis Atkinson: The fifth sale was an arms length transaction if it was not a family
member.
Darline Duffy: A family member wasn't even selling it. I think it was left to a church is
what I'm telling you.
Phyllis Atkinson: Oh okay.
Darline Duffy: Do you know what I mean? The kids want to get their money.
Phyllis Atkinson: Oh okay, but it wasn't...
Darline Duffy: No it was not a family member.
Jonathan Wiggins: So it's a good sale? It's a sale.
Darline Duffy: You think it's a good sale or not? I do not think it is; I do not think so.
The family tries to get as much as they can; the church is always happy with whatever
they get pretty much, but I don't think these are terrible...I think these are good
comparables to Ms. Mancini's house and...
Jonathan Wiggins: Well she has that house next door to her that was for sale. How much
did that sell for?
Ann M. Ver Pault: 285
Jonathan Wiggins: That one sold fbr...
Phyllis Atkinson: 285
Ann M. Ver Pault: But I believe it is a smaller house, I don't know how big that house is.
Phyllis Atkinson: We don't have the square footage so we don't know.

Darline Duffy: I have to tell you, I don't feel strongly about this. Some cases I feel
really strongly. I don't feel strongly about this case.

Gerard Schultheis: Would you like to give us the history of what the basis of the
grievance is?
Jeremy Walsh: 3360 Camp Mineola Road a.k.a 300 Bay Court was a property that had
an existing house on it that had to be demolished due to a lost of wetlands to the west and
various properties had been raised up. There was mold, mildew, the plumbing had rotted
out, the boards had rotted out so the whole...other than the foundation, the whole
structure had to be demolished and rebuilt. There was a new construction project that was
started in 2009. The new construction project was $645,000. That was for new septic,
bringing up the septic that they needed, all new framing, roof, etc. totally new building
plus there was contract in profit associated in that $645,000 number. The property was
built, it was finished in June of 2003...of 2010, excuse me, June of 2010 when the C of O
was issued finally for this and it was started in March of 2009. The house is of distinct
nature in reference to it's an upside down house which means that the living space is on
the second floor and the sleeping space is on the first floor. It has no basement and it has
its counter faults on the first floor as crawl space. The parcel is landlocked on both sides
by two roads and that is the house of where it is today. If you'll note on the 30 or so
properties that sold in Mattituck, the long list, nothing has sold over $500,000 that has not
been on the water or on the creek on this list. This property is not on water nor it is not
on creek. ! think it is currently assessed at somewhere in the $800,000 level.
Phyllis Atkinson: It's 8500 assessment
Jeremy Walsh: Which is 850,000?
Phyllis Atkinson: More or less, is this the house? Sorry I don't have the t¥ont page.
Jeremy Walsh: Yes, that would be it.
Phyllis Atkinson: That's the house. How many square feet do you have?
Jeremy Walsh: 2500
Phyllis Atkinson: 2500 square feet
Jeremy Walsh: Now granted it is 2010 construction it is in excellent condition but if you
look on Mar Lane which were two of the properties that were sold recently, 550 Mar
Lane, 1165 Mar Lane, it is over, it is a block away from the bay similar to my client's
property. They both went for under $500,000. If you were talking about current listing,
across the street from my client's property there is a current listing with Stype for
$510,000 on a larger piece of property in excellent condition again with a basement and
it's similar in nature with square footage. Eight hundred fifty thousand is
disproportionate to what the values are being sold within Mattituck for the past two years
on a landlocked piece of property that does not have water view, does not have bay or
creek access. I did put one that may have thrown off the skew in there which was sold
recently for 1.8 million dollars down the block, very close to my client's property, but
guess what? It is on the water on the bay, it is brand new construction.
Gerard Schultheis: Let me just recap tbr a second...
Cara Wells: Can I Just ask one question Jerry? Everybody down there has deeded beach
rights.
Marjorie Dunn: But you pay a separate tax on the beach
Jeremy Walsh: No I'm sorry; you don't have deeded beach rights. There's a separate
parcel that is owned by the community so that parcel gets taxed. It is not deeded beach
rights. There is a difference, in other words 17 families own a piece of property which
you tax separately, which is not included in this so it's not deeded beach rights. Being
that she is now paying...she pays for this on the tax roll, the other piece of property and
she is paying for this one also.
Phyllis Atkinson: It's a homeowner's association, am 1 correct?
Jeremy Walsh: Yes ma'am.
Gerard Schuttheis: The cost of construction you said was...
Jeremy Walsh: The cost of construction was $645,000 for the complete rebuild, 100,000
of that was profit and overhead by the contractor; and I have the construction contract if
you wish to see it.
Gerard Schultheis: Ok that's the improvements on it, that doesn't include the value of the
land.
Jeremy Walsh: No it doesn't but that was new foundation, you're not getting money for
a new foundation, that's new drywell $20,000...
Gerard Schultheis: Ok but assessment is made up the assessed value of the
improvements and the assessed value of the land. There are two components there.
Jeremy Walsh: ! don't mean to...ifmy client went and put in gold bath tubs in the
property except for the value of the gold, it doesn't add value to the property necessarily.
Now my client's house was destroyed threw repeated floodings between the filling of the
mud flat area, which is off to the west, between the raising of every single other property
that had been done in that neighborhood. There was mold; there was mildew so she had
to just recoup 200, $300,000 from the original house built. Now, yes she did improve it,
yes there was a value. There is a similar house across the street for 510 which owns the
piece of property is within the association and has not sold within one year. When you
value the house at 850, I'm talking 40 feet away from her is going for 510,000 and hasn't
sold for a year and you can not show me at least from the list of properties that I
have...maybe I am missing some and I don't disagree that l'm maybe missing one or two
but I did my best to compile the list. Not one, which is not on the water has sold for over
$500,000 so whether or not my client made a bad investment o~' whether she over paid for
her construction or whatever else, the value of her house is not $850,000.
Gerard Schultheis: Do we have the adjustments of all those houses?
Phyllis Atkinson: No he does not.
Gerard Schultheis: They have not been brought to an equal status where you looked at
the square footage, number of rooms.., made the adjustments or anything.
Jeremy Walsh: I don't disagree with you sir but what I am saying is that her plot is .23; it
is a tremendously small plot. If you take a look down this list I don't think that her
plot...I think her plot is the smallest on this list, that's a fact, 2500 square feet in
excellent condition. We're not disputing that fact either, but if go to list it tomorrow with
a house across the street that is 510,000 in very good condition with a larger piece of land
with the same exact conditions, the same exact road, in fact it only has one major road,
she is landlocked by two. Her value is not going to be $850,000.
Gerard Schultheis: When did you buy the house?
Marjorie Dunn: In the '70's...36,000, no 32,000 and sold. What happened...they
assessed me fbr a year and they said I lived in the house when it was still under
construction and I can prove from LIPA, from Cablevision, from the Town itself that I
was not there, yet they raised my taxes; they said they sent me a letter saying that they
raised my taxes which I never received. I've written to the Governor, I have the letter
here, and I have all the other proof that I was not in the house.
Daniel McConlogue: Is your client one of the owner's of the beach property lot?
Jeremy Walsh: Yes
Jonathan Wiggins: Getting back to the house across the street, I'm looking here...would
that be across to the west or to the east?
Jeremy Walsh: I have a map that I can show you it to you on the map with all the
subdivisions. It would be to the east on the comer of Terry Path and Camp Mineola
Road.
Gerard Schultheis: Was that house been sold?
Jeremy Walsh: No it has not been sold for all three years; it has been listed at 510.
Jonathan Wiggins: Do you know how large a house that is?
Gerard Schultheis: Jonathan?
Jeremy Walsh: I would assume it's somewhere in the area of 1800 square feet.
Phyllis Atkinson: It's only a listing; it's not a sale.
Gerard Schultheis: It's a listing
Jonathan Wiggins: 1 understand just...
Jeremy Walsh: It's listed for 510. If you were to say it was such a buy at 510 within the
last year somebody would have snatched it up.
Jonathan Wiggins: It is just a listing but it is...
Jeremy Walsh: If you want to look for a sale you go for 4700 Ole Jule Lane which is a
landlocked property which was I believe was 539 which was listed or...
Phyllis Atkinson: Mr. Walsh we don't give too much weight to listings we prefer closed
sales.
Jeremy Walsh: Ok, so if we want to look at a house similar in nature that's a block off
the water within Mattituck on the bay side, you have two of them fight there which is 550
Marlene Lane and 1155 Marlene Lane. It's a nice block...
Phyllis Atkinson: It's a busy street.
Jeremy Walsh: But it's no different than having two streets on both sides.
Phyllis Atkinson: How much traffic do you get on your street during the day?
Jeremy Walsh: Every one of those houses that's inside the Camp Mineola property has
to come and go up and down that entire street right pass her house.
Phyllis Atkinson: To get to the beach
Jeremy Walsh: No, to go anywhere
Phyllis Atkinson: But she is down far
Jeremy Walsh: There are 30 homes that everyday they drive up and down pass her home.
Marjorie Dunn: All night long the kids go to the beach every...that's a freedom beach,
the one straight down the road so all night the traffic of the kids all night long drive down
that road.
Phyllis Atkinson: Tell me about it!
Marjorie Dunn: The other road is quiet that I'm on but that road is very busy.
Phyllis Atkinson: I used to live on Marlene and it was the same thing, back and forth in
the summertime screaming, yelling, hanging out the car windows.
Jeremy Walsh: So that's the same character down there. It's right near Strong's Marina
which has a tremendous amount of traffic.
Phyllis Atkinson: Is that before you turn off?.
Jeremy Walsh: Strong's Marina is before that
Phyllis Atkinson: Before...ok, all fight.
Gerard Schultheis: Kevin, what do you have to say?
Phyllis Atkinson: Yeah
Kevin Webster: Well first the assessment is 8500 and based on the equalization rate
8500 equates out to a taxable value of $765,000 as of our valuation date of July 1, 2010.
The taxable value is not 850,000 it is $765,000 right now.
Phyllis Atkinson: We are using the 1.06?
Kevin Webster: 1.11
Phyllis Atkinson: Oh, ok
Jonathan Wiggins: Why are we using 1.11 and not 1.07?
Kevin Webster: Well that's our uniform percentage that we've established and the
equalization rate is also 1.11. If you choose to use the residential assessment, the RAR,
the taxable value is $794,000...
Jonathan Wiggins: Yeah that's what I would say
Kevin Webster: It's not 850,000 depending on which ratio you choose to use.
Phyllis Atkinson: Ok, so this is the same thing as you did last year. You went to Penny
Lavalle and you said can we use this instead of that based on...
Kevin Webster: We've established our ratio and the equalization rates came in at the
same showing a trend in values.
Phyllis Atkinson: Ok
Jonathan Wiggins: All right, so we are going to use the 1.11 then, is that correct?
Kevin Webster: Yes
Phyllis Atkinson: Ok, I'm glad you mentioned that.
Jonathan Wiggins: All right that gives us the market value of 790...$765,000.
Kevin Webster: 765
Jonathan Wiggins: At $765,000, do you feel that's a thir market value for that property?
Kevin Webster: As of July 1, 2010, yes I do.
Jonathan Wiggins: In the...with the way the market is fight now in light of our land of
sales he's presented in front of us here?
Kevin Webster: Based on July 1,2010 valuation date I do, yes.
Gerard Schultheis: And your contention is that the entire property, the land and the
improvements, are worth 400,000?
Jeremy Walsh: Four hundred thousand is the lowest value that you would see. I mean
look...if you looked at this list for landlocked properties that are .23 on two streets, you
would see that nothing is here. lfyou look at Stype Realty valuating a larger piece of
property it would be 510 and it hasn't sold; and I understand that you go with sales and I
don't disagree with you. If you go with sales on the size of the property and upon what's
going on, you start hitting a value at Mar Lane...550 Mar Lane .25 built in 2003.
Gerard Schultheis: Unfortunately what I don't have to see is the adjustments of those
homes so I don't know of the one house is 1000 square feet and you're comparing it to
another house that has 3000 square feet, ok...
Phyllis Atkinson: Number of bathrooms...
Gerard Schultheis: Just the price is not...
Jeremy Walsh: ! don't disagree with you sir so if the closest thing you have is 470 Ole
Jule Lane, again on the same road within the same area if you go towards Strong's you
would be looking at a one family detached with 9 nines, 4 bedrooms which is that same
as my client; this property happens to have a pool on it, my client does not. This property
happens to have water, small deeded bay beach, stroll to Strong's Marina, a bonus
separate 55 30 lot at the mouth of the creek. You could put a 17 foot boat in front of this
property. This property was offered for sale at $539,000 on the same thing. Fifteen
seventy Ole Jule Lane which was sold recently for $800,000 on the creek with a dock,
with a pool, with over 3,000 square feet, rehab condition, very good to excellent
condition, that's 800,000 on the creek, with a pool, with a dock, you know what? There
may be an area on which we can come between 400 and between 776, but if you look at
the appropriate sales that I've shown you no lot on that list is smaller than my client's;
that's one fact. Every house that was sold is 490 and down. Every one of them is
landlocked similar to my client. Across the street from my client is a listed house for 510
in the same exact area. So is it 400? Maybe not. Is it 776? I think it is clear that it is not
776,000. Is it somewhere between? You are the experts in that area and I'll leave that to
you; but there is no way that it is 700 or 600,000 in this market. It's just not going to be
there.
Gerard Schultheis: Anybody have any other questions?
Jonathan Wiggins: Kevin?
Phyllis Atkins: Do you have any comparables or any appraisal you worked up or
anything like that?
Kevin Webster: I can do that if you would like me to submit that; I can do that. I have
done some work up on this case. I do want to mention one thing that one of the ways to
assess new construction by New York State law is cost of construction. If you take the
cost of construction that was admitted here for this property and you take a very
conservative land cost here in one of are nicer areas, it's a homeowner's association in
Camp Mineola, you take the 645 and you add a land value which is below market of
120,000 for this lot, which I know is worth more than that, that comes in at $765,000,
which is exactly what we have it at. If you take the cost of construction at 645 and you
add in what 1 feel the land value would be at $250,000, that comes in at $895,000 and
that was the original assessment that I had on there which was 9900 divided by the
uniform percentage came out to 891 which would be the cost of construction plus a
reasonable land value. What we have on there now for this new construction, which
again is an acceptable way to assess a home, is 645 for the cost and 120 for the land. The
land is worth more than 120, but that's all we are assessing it at is 645 for the cost and
120 for land for a total of 765. So again, that's another reason why I do feel the 765 is
reasonable.
Daniel McConlogue: How long do you think...How many years do you think after
construction that the cost method is appropriate, especially in this market?
Kevin Webster: Originally assessing it? This is an original assessment.
Daniel McConlogue: You are using the cost appropriate for the value of the property.
I'm saying how many years after the construction is this valid?
Kevin Webster: I would say after 5 years. After 5 years that is going to be something
you couldn't consider.
Daniel McConlogue: Five years?
Phyllis Atkinson: 1 would have said ten.
Kevin Webster: Ten?
Phyllis Atkinson: Ten, yes.
Kevin Webster: Ok, I was trying to be nice.
Phyllis Atkinson: Did you figure out the cost per square foot? I don't have my calculator
with me.
Kevin Webster: Cost per square foot?
Phyllis Atkinson: Yeah
Kevin Webster: It's about two-twenty, two-twenty per square foot. I just took the cost
straight what was testified to divided by the square footage which is not an unreasonable
amount for this type of home.
Phyllis Atkinson: Mrs. Dunn? How much homeowner's insurance do you have on the
house?
Marjorie Dunn: I do not know offhand to be honest with you.
Gerard Schultheis: Could you get us a copy of the policy?
Majorie Dunn: I could get you a copy of the policy. Why, do you think I should bum
down the house because I can't live there anymore because the taxes are so high? I don't
really understand to tell you the troth what the difference is. All of my neighbors raised
their houses, ok, causes me a flooding condition. I had a basement before. The water
rose, it rotted out the thing; I had to re due this. The cost of raising this house, filling in
all of that land...that was the big cost of it in the construction of this house. It doesn't
change the property, it's still...the Town says you can not have a pool on your property,
you can not do all these other things, you can not have water on your property. Those are
the people who, which he explained, actual sale of a house was 254 feet or 154 feet that
has 5 bathrooms, brand new bathrooms, there is a house on Ole JuIe Lane, they...there is
almost no comparison. That is on the water, I would love to live on the water and instead
I have two roads on either side and I have the smallest piece of property in all of
Mattituck I think and yet all of these homes have sold. I have listings of the (inaudible)
that they sold and yet mine is all of a sudden is valued at this? Who wants to buy my
house? Nobody wants to buy an upside down house, and it was built that way because
my husband is 76 years old. We wanted to live there and if something happens to him, he
is blind in one eye, he could then reside on the first floor in his bedroom confined and I
can bring him down the meals. That is why it was built like that so we would have some
place to retire. To go (inaudible) listing here not even tell the people what you've done to
increase that rate and I did not live in that house at that time and I can prove it. I wrote to
the Governor and he say to come back to you. It's a shame you do this to the older
people, I really don't get it.
Jeremy Walsh: I just really have a problem with you equating remediation ora condition
with value ora house. Is anybody here buying a drywell? I mean anybody here? Are
you going into a house and going "Oh you've got great drywells that cost $15,0007" No
one here is buying a drywell. Are you putting real value on a roof?. At the end of the day,
when you look and you go "oh wow that's the best roof I've ever seen, those shingles
really shine tbr me" or what about the framing? "Oh the framing is really something
we're going to value." You are talking about a house that had to be torn to the Found; it
lost money. There was 100 to $200,000 lost because of this, because of'just the
infrastructure associated with it. New boiler versus old boiler, $400 versus $1000 and
then the minute you put it in it drops $600 $700. I just don't understand how you can do
cost of construction on this house. In addition, you taxed my client for last year for a full
year when there was no CO issued until June so you valuated her property in 2010 at
$8,000 when she has no CO, she wasn't allowed to live in the house, she did not have the
requirements to live in the house but yet it was still taxed for the full year. It was not
split for half of the year.
Gerard Schultheis: What was the date the building permit was issued?
Jeremy Walsh: The building permit was issued on March of 2009; the C of O in June.
We have letters associated with LIPA from February 2010. Cable was not installed and
phone was not installed until June so an unlivable house you taxed at $765,000.
Phyllis Atkinson: I'm looking at the data card; the house that you demolished was a 1000
square feet?
Marjorie Dunn: It was a little over.
Kevin Webster: Yeah, a thousand forty
Phyllis Atkinson: One thousand forty square feet
Kevin Webster: Right
Phyllis Atkinson: And you rebuilt it to 2500, the new construction?
Marjorie Dunn: Right
Jeremy Walsh: And by the way just as a note on that house, that house was on the market
for over a year in 2009 which was a much better climate did not receive an offer over
300.
Phyllis Atkinson: The original house?
Jeremy Walsh: The original three-bedroom house in the condition that it was on the lot
that it was with the same exact...did not receive an offer for 300. There was competing
sales. My client owned two houses at the time. She owned 1570 Ole Jule Lane and she
owned that one. She had to sell one of the houses. The one at 1570 Ole Jule Lane sold
for $999,000. After that was sold, one year later it was resold, this is the one on the water
with the pool with the new construction in great condition, a year later it sold. It sold for
$888,000 which the value of that the person lost over 100,000 and it was vacant for a
year and that's on the water, that's 3000 square feet, that's all new interior of the house
built in 1970-something and had an in-ground gunite pool.
Gerard Schultheis: Is that one of your comparables?
Jeremy Walsh: That is showing one of the comparables, I believe, in here. But it is not
in the comparable because it is on the water.
Phyllis Atkinson: Yeah, I was going to say that.
Jeremy Walsh: But the point is that it's a real sale on the water, pool, 3000 square feet,
880,000.
Phyllis Atkinson: And how old was it?
Jeremy Walsh: It was built in 1978. It was rehabbed in the 2000's. The pool was put in
in 2000; the roof was put in 2000, great roof because that must have had a lot of value.
The whole interior was put in, new kitchen, new bathrooms so it was very good to
excellent condition where the house down Camp Mineola now is excellent condition
obviously because it's new construction.
Gerard Schultheis: Ok anybody else have any questions or any other comments?
Jonathan Wiggins: No I thought Kevin you were going to work up an appraisal. Do you
want to do that now or...?
Phyllis Atkinson: No we'll do when we're...
Jonathan Wiggins: We can do it later, you can submit it later.

Marjorie Dunn: What I do have is...l do have a copy of when the Cablevision was put in
in June and I have copies from LIPA where the electricity was not done right, it wasn't
done until February of 2010 and I have from the water testing that wasn't done until June
of 2010.
Gerard Schultheis: We don't need that.
Marjorie Dunn: Ok

giving us and then we will make a decision.

Phyllis Atkinson: Basically, this sounds terrible, but the Town is assumed correct and it's
up to you to prove them wrong; that's the purpose.

Joseph Avella: I feel a little inadequate after that last presentation. You did mention it
was a waterfront so I'll address that first. It is a small little tributary off of James Creek.
It is a dead end, cul-de-sac of water that doesn't free flow. It's not navigatable except
maybe by kayak. The only thing I get out of this little tributary is a lot of debris and a lot
of material that washes up; it doesn't cleanse itself out like a normal situation. It is listed
as a waterfront and it really isn't. Back in 2000 the Board of Trustees issued a permit.
The land just keeps eroding and in 2000 they issued a permit to put some planting and do
some things to stabilize the land.
Jonathan Wiggins: You're not bulk headed?
Joseph Avella: It is not bulk headed. They permitted some railroad tires to be put in and
it wasn't done properly to even stop this erosion. They did permit some small bulk
heading; it still washes out underneath probably washes a considerable amount of land
into this tributary. That is a situation I would like to have enforce in future time but they
would not allow any major bulk heading. You would really have to go down to stop it
underneath; it wasn't done properly 1 guess. I bought the house in 2008 and paid 595,000
for it. I dare say I couldn't get close to... according to my research and talking to some
real estate agents and doing some research online, the value is well...$100,000 less than
what I paid for it at this time. I just listened to this gentleman here talk about some places
that were in and around my area and I agree totally that the values are in the 400's. I
think probably my value is probably 470, I don't know what I put on this...I thought the
value was at this point in time...484. There are parts ofOle Jule Lane where people have
boats and larger pieces of property. I think my property is listed as .28, I'm not even sure
at that point anymore with the erosion that has taken place. The properties on either side
of me are least 10 feet in front with bulk heads so when you come off the bulk heading it
comes in 10 feet from my property line which has a supposed buffer in which just a
couple of 6 by 6 or something like put in the ground to stop erosion that which hit hasn't
done. I just listed on the paper so many places that I thought were either a comparable,
some have bigger homes than mine.
Gerard Schultheis: Do you have the specifics on those as far as what the size of the
houses, the square footage, number of rooms, adjustments to harmonize them?
Joseph Avella: On the comparables?
Gerard Schultheis: Yes
Joseph Avella: No, I don't. I just recently got into town and went ahead and put this
thing to together just to get put in for today. No I don't. I just know from real estate
articles, brochures, and talking to the friend of mine in the real estate business, so this is
what I came up with these things: two bedroom, two bathrooms, larger pieces of
property, whatever I was able to put down but I really didn't put too much research into
it.
Gerard Schultheis: What we do is we look at the information that you've submitted as far
as proof to the inequality in assessment that you're claiming and some evidence is
required to protest comparison to existing homes that have sold...
Joseph Avella: Once again what I'm trying to put forth is the so called waterfront; it's
just not. lt's a dead end piece of road and I all I do is get is garbage.
Gerard Schultheis: What is the assessment of the land?

Joseph Avella: Yeah. I would be very happy to sell it at the value that it's assessed at
here, 587,000, it's just not even close to that. I have no STAR program or anything like
that so people like myself get caught in between without any kind of benefit.
Gerard Schultheis: Did you apply for the STAR?
Joseph Avella: No, I'm not eligible for it.
Phyllis Atkinson: This is not your primary residence?
Joseph Avella: No, my primary is actually listed as Florida. I've been in Southold Town
since 1970 in one home or another. I do consider this my home; I certainly do not want
to have to leave here but we did leave the area for two years and that's how I ended up
having a Florida residence and that never changed. I wish I would have changed back
and would have gotten the Star program or something like that.
Phyllis Atkinson: Well you get the Homestead exemption in Florida.
Joseph Avella: Yeah but it's a much less value, it doesn't return as much in Florida as
they would get here.
Gerard Schultheis: Kevin, do you have any comments or...?
Kevin Webster: 1 do. The 6400 represents the taxable value with the 1.11 at $576,000.
We have this assessed as a 1680 square foot cape built 32 years ago. It has a deck, a
balcony, 360 square foot garage, upstairs it has two bedrooms and a bath...bath and a
half total, has a full basement, there is no fireplace, well kept home. We were there a
couple years ago, we did take a photograph. It does have creek front; I did listen to what
Mr. Avella had said about that. I know the access, you have to correct me if I'm wrong,
you have to go north to get to the opening then go back west a little bit and then your
back out into the opening. Again, as of July 1, 2010 we have this at 576,000; the deed
shows that he purchased it for more than that. I feel that 576,000 is a very reasonable
taxable value as of our evaluation date for this type of home in a very nice location.
Gerard Schultheis: Any other questions or comments?
Gerard Schultheis: Ok, well thank you for coming and what we'll do is we'll look at the
evidence that you submitted and make a determination and you will be notified.
Joseph Avella: Ail right, thank you.
Kevin Webster: We'll have to submit something to you and then give it to Mr. Avella.

Joseph Avella: Well I'm going by what other houses in the area are selling for, what
some have sold for is on that piece of paper and what some have tried to sell for as the
last gentleman said the selling prices are much lower so that's all I have to say. I thank
you for your time; I do appreciate the situation that the Town is in but I would like to be
considered that some of us are forced to pay some of these taxes on a limited income. I
certainly do want to have to be selling and leaving the area because of the taxes.
Jonathan Wiggins: While you are still here, Kevin, what do you think about the sale on
1050 Marratooka Road which sold for 319?
Kevin Webster: I'm not sure.
Jonathan Wiggins: Ok, what about 4550 Deep Hole Drive which sold for 339?
Kevin Webster: You're asking me what I think about that?
Jonathan Wiggins: Yeah, about the sale.
Kevin Webster: Without having the card in front of me and researching where it is I
don't have any comment on it either way.

gone down on this house?
Kevin Webster: On this particular house...no I did not say that. I said that I feel the
home is worth at least $576,000.

Phyllis Atkinson: in July '08 when you closed, at what date did you go to contract at on
the 595?
Joseph Avella: I think that was probably in July.
Phyllis Atkinson: You closed in July; you went to contract the same month that you
closed?
Joseph Avella: I don't know.
Phyllis Atkinson: I'm just trying to... I know that's right when the market dropped so
I'm thinking maybe he was still at the height of the market when he went into contract
was locked into that price when he finally closed but that's...

Kevin Webster: I'm not sure of the circumstances of the sale but it's 24 months before
our evaluation date.

McCormick: My name is Daniel McCormick from McCormick Law Firm, business
address P.O. Box 580, Manorville, NY and for the record I am an attorney.
Gerard Schultheis: And you are representing Christine Fetten?
McCormick: I am sir.
Gerard Schultheis: Ok, and we see from your complaint that the assessed value of the
land and the improvements is $4,400 and you're feeling is that the...well the property
owner's estimated market value is $190,000.
McCormick: Correct
Gerard Schultheis: The proof that you are offering appears to be a contract for sale.
McCormick: That is correct. I actually submitted to the Board and again I thank you for
allowing me the opportunity to address this particular assessment. I do know that this
was a bonified and arms length purchase of the property with a closing date of September
of 2010. As the Board is aware, the evaluation date for the purpose of the 2011/2012 tax
year is July 1, 2010. So here we have an actual sale right around the evaluation date for
purposes of this grievance at this point. We have a sale of $190,000 which again as I
have indicated is an arms length transaction with no relationship between buyer and seller
at that particular time and at this point l'm relying on that sale. As this Board is aware
that arms length transaction is the best evidence of the value of a property with regard not
only to grievances but certainly market value as well, so I respectfully submit this sale to
the Board as evidence that this property was worth $190,000 as of that July 2010.
Jonathan Wiggins: What's the address of the subject property?
McCormick: Sorry, sir.
Jonathan Wiggins: The address of the subject property?
McCormick: The actual address that I have from the records is 2810 County Road 48,
2810 County Road 48, Mattituck, Town of Southold.
Jonathan Wiggins: Ok
McCormick: And for the record I indicate based on the current assessment if you
equalize that value based on your current rate of 1.07 percent that's handed down by the
State, the current value is $411,000. Clearly this property, with all due respect, calls out
for a reduction. I would respectfully submit to this Board that we are seeking that
reduction based on that sale so Ms. Fetten is not obviously clearly burdened with a tax
burden based on an inappropriate evaluation.
Daniel McConlogue: And I suspect you are urging us to use the residential assessment
ratio rather than the equalization rate.
McCormick: I am sir.
Daniel McConlogue: And why is that?
McCormick: As this Board is aware residential assessment ratio is predominantly based
on sales of residential properties as opposed to the equalization rate which utilizes both
residential sales and commercial sales. I've been involved with the grievance business
going back to 1998 and clearly in my mind the residential assessment ratio is the best
indicator in terms of percentage of value for residential properties. If this was a
commercial property, I would be before you on an equalization rate issue but that clearly
is not the case.
Gerard Schultheis: Do you have a copy of the actual contract?
McCormick: I've submitted the closing statements sir. That should be attached to your
petition and the deed.
Gerard Schultheis: I've got the closing statement but I don't see a copy of the contract.
Jonathan Wiggins: Even if they use the equalization rate it would still be $396,000 at
1.11 percent.
McCormick: Right, but that doesn't always hold true sir as you know.
Jonathan Wiggins: I understand. I've got both figures here; I just want to keep things in
perspective.
McCormick: Sir, to answer your question Chairman, I would have to review the file if
that's an issue with this Board I would certainly go through it and seek out a copy of the
contract if you really need it for today's purposes. I did submit the closing statement
obviously which indicates the nature of the sale.
Gerard Schultheis: I think we would like to see the contract just to make sure there are
no other extenuating circumstances that...
McCormick: Ok, ifI could have a moment to go through the file perhaps if you want to
do another action or whatever, I could have a little time to go through that would be

McCormick: Yes it is, owner occupied. Any other questions before I look through the

Kevin Webster: Well looking at the property card, it appears as if it's an estate sale.
Bertha McHugh passed away, the property of the estate was transferred to somebody
named Holly for no consideration. I don't want to assume that's a family member but
there was a transfer in May of 2010 for no consideration from the estate to Holly then
there was another transfer September 20, 2010 from Holly to Fetten for no consideration,
which is the same name as... but I don't have any...another transfer on my card.
McCormick: I'm sorry, so you're saying that September 20, 2010 there is no
consideration for the transfer?
Kevin Webster: It says on my card...maybe that should be...on my card it says that but
let's take a look and see.
Phyllis Atkinson: No consideration, yeah. Offright-of-way on Middle Road
McCormick: No because I submitted a closing statement with an indicated sale of 190.
Kevin Webster: It appears that looking at this deed that the deed was for 190 September
20. May 21, 2010 the estate transferred into somebody named Holly for no
consideration, and then I know the Chairman is asking for when the contract was signed.
I assume the contract was assigned between May 21 and September 20; there was a
contract signed for this 190 and then the property was transferred so in the face of it it
appeared to be an estate sale.
Phyllis Atkinson: What is this marriage certificate 3/11/117 Do you see that?
Kevin Webster: I do see that. May I be excused for a moment and check in my office on
these two lines?
Phyllis Atkinson: Yes

McCormick: And you are sir?
Kevin Webster: I am Kevin Webster; I'm the assessor for the Town.
McCormick: Oh, nice to meet you.
Kevin Webster: Ok we have clarified some of the information on the property card. The
September 20, 2010 transfer was for $190,000. The March 11,2011 notation, not sure if
we asked about that, but it's a marriage certificate where Christine Fetten was married on
June 8th of 2008 and she brought that in to be recorded for...for her name to be changed
to Christine Fetten-Williams. That clears up that, it has nothing to do with the market
value but there was a note on 3/11/11 about the name being changed that she was married
on June 8, 2008. I see...she purchased this as Christine Fetten but she was married June
8, 2008 and changed it to Christine Fetten-Williams.
Phyllis Atkinson: Ok I see, yeah.
Kevin Webster: So again, when you were asking me to comment about this Dan, Bertha
McHugh passed away in 2009, the McHugh estate transferred to Holly for no
consideration May 21, 2010 and then four months later the property was sold from Holly
to Fetten. My opinion is it's an estate sale.
Jonathan Wiggins: It should have Holly to Fetten $190,000 at no charge.
Kevin Webster: Right, that N/C is an error on the property card.
Jonathan Wiggins: Ok
Phyllis Atkinson: Oh
Kevin Webster: It is 190,000 on the deed; we checked it through the County system.
Jonathan Wiggins: Ok I'll just put a little note here.
McCormick: Just ifI could kindly respond to the gentleman's, sir, statements. As this
Board is aware, and I have done estate work, an executor in an estate is obligated in
satisfying his case of the will to liquefy or liquidate assets as best as possible, meaning
you got to get as much money as you can get for any of the assets to liquidate to provide
for the beneficiaries. Even in an estate sale, there's an obligation to try to get the market
value for that property. I submit to this respective Board that the fact that estate sale
represented the market value because who would sell that property for less than what it's
worth at that time if you needed to satisfy the (inaudible).
Daniel McConlogue: is there a time restraint on an estate sale?
McCormick: Not that I am aware of. The only obligation is to sell that property as best
as possible under the time frame of the court in terms of the value, and my understanding
is that you can't simply sell the property for less than what it's worth just to move
forward, that would certainly be a consideration for the Board at that point. Now we all
know of course within the last three, four years the market for the most part has not only
been staggering but it's been lower than it has been in decades, so given that fact I
presume given the market rate they sold in a trend that was down and it's still down, even
now as we all know so even if they waited another year they probably would have gotten
the same amount. I respectively submit that, with all due respect to the gentleman, that
was the market value at that time, and certainly the transaction between Holly and Fetten
was arms length, there's no relationship.
Jonathan Wiggins: Ok, I think you have given us a good argument and we will certainly
look into it. The assessor, Mr. Webster, what do you have to say about this sale?
Kevin Webster: Well it is proven there is...case law and opinions of counsel that one
sale does not make a market and along with that statement I would like to be given the
opportunity to do an appraisal on this home and present it to the Board and to Mr.
McCormick. Is there an appraisal that went along with this for financing purposes?
McCormick: 1 presume there was. There was bank finances and as you know in
generally in the bank finances they are not going to loan money unless they do their own
market analysis but I do not have those documents, and actually that strengthens the
argument that in fact the bank, especially in this market, is not going to extend the
mortgage if in fact the property is not worth what the sale price is. If anything thing they
head in the opposite direction.
Kevin Webster: That would be something that would be a good piece of evidence to look
at to see what the appraisal came in at and see what sales they used for the appraisal to
support a 190,000 value.
Phyllis Atkinson: The closing statement shows the mortgage amount at 152,000.
Kevin Webster: 152,000 that the purchaser has...
Phyllis Atkinson: It says first loan proceeds, now I don't know if there is another second
loan, I don't know. It just says first loan proceeds, there's an asterisk, and then at the
bottom it says represents total loan amount of 152,000 minus bank fees of 6,000.
McCormick: That's exactly an 80% loan to valuation which would be a standard loan
scenario...
Phyllis Atkinson: 20% down, yeah
McCormick: They put 20% down and financed 80% of debt, again that's based on
$190,000 value to the bank's interest.
Kevin Webster: This is a 1,000 square foot ranch on over a third of an acre with a full
basement, fireplace, one bathroom, has heat, 420 square foot garage. I would like to be
given an opportunity to do an appraisal on this home. Again, supply it to and Mr.
McCormick.
Phyllis Atkinson: There's nothing here to indicate that they added a porch; doesn't say
there. There's nothing here to show that they applied for a building permit to do any
improvements.
Kevin Webster: There's a building permit in 1966 and I guess that's the only one that
our records show.
Phyllis Atkinson: Yes, right, and that's when the records started because they
didn't...they had the total assessment at 2400 and then in '72 they were reassessed but it
doesn't say why and that's the last time they were reassessed.
Gerard Schultheis: Ok, thank you for coming.
McCormick: Can I get a copy of the contract?

McCormick: The contract...I gave you it to you to be copied, can I get that back for the
supporting data.

you're over assessed by about $20,000 in market value?

Gerard Schultheis: Kevin, I'm looking at the property record card...

Gerard Schultheis: and there are changes made to the assessment in '02, '08, '09 and '10
and I don't see any reasons why those changes were made on the property record card.
Kevin Webster: It is on the back; the reasons are that we...Mr. Bremer and I discussed
this three previous times and I reduced it as it shows in the front because of the market
value analysis in March of 2008, January of 2009, and again in February of 2010. I put
down "review" in front of the card but on the back you can see why it was done because
of the market area review of those previous times.
Phyllis Atkinson: You did all of the houses in Farmveu or...is that what you are saying
when you say area review?
Kevin Webster: Mr. Bremer asked me to review his assessment and I went out and
reviewed it and made a change for him for three times.
Phyllis Atkinson: Oh ok, when you say market area review, I thought maybe you went
through the whole area.
Kevin Webster: No, I did the analysis of his individual home on those three previous
years.
Jonathan Wiggins: How long have you owned your house sir?

at all from Town Hall?
Kevin Webster: Oh that I'm not aware of if you can do that. Mr. Bremer was coming in
to file a grievance and I explained that he should put the grievance in and then when he
had the appraisal he could supply the additional information tomorrow, of course that
would be up to the Board, but I do believe that has been done in the past.
Phyllis Atkinson: Right, right...we can put it aside
Kevin Webster: Ok
Gerard Schultheis: We can give him some time, and give him until a certain date to have
the appraisal.
Jonathan Wiggins: Yeah, we will review it when he brings it in.

Board is supplied the appraisal tomorrow, is that sufficient?

Gerard Schultheis: Five hundred thousand came from the application. He said the
property estimated market value was 500,000
Jonathan Wiggins: That's your estimate, huh, but the appraisal is going to come out at
520,000...ok. Using the RAR...using the equalization rate which is what Kevin is using
we get 531,000 so it's maybe $10,000 off according to that. Using the RAR it is 551 so
that would make it a bit more, so we will have to decide.
Gerard Schultheis: We will give you one week adjournment to get that appraisal to us
then we will consider the process.

Cara Wells: Yeah, this is a primary residence to you?
Monaghan: No it isn't. When I say no it isn't I meant we're...in 2004 1 was presumed to
a corporate relocation and moved to Arizona. I worked in Arizona from 2004 to 2008,
retired, moved them and January of this year I sold my house in Arizona and moving to a
condo there but am relocating back to New York.
Gerard Schultheis: Ok so 1 see by your submission here that your assessment is $5,600.
Monaghan: That's correct.

Jonathan Wiggins: And you feel the property is worth 425?
Monaghan: I think it's worth in the 400,000's area. Four twenty five is a number that
seemed to be the median number in several different indices on the web and some real
estate people that I talked to.
Jonathan Wiggins: How old of a house is it?
Monaghan: If I may make a presentation to you about the house so you can get a sense
of what the house is. Let me say, my wife Maggie and I have been residents of Mattituck
for the past 42 years, part time residents. I lived in East Williston in Nassau County and
owned the house within the confines of Camp Mineola buying it in 1969. It was a
bungalow with no heat, had an upstairs like a loft and one bedroom, had a half bath,
literally a half bath when I bought the house. I owned that house until the early '90's
when I bought the Miller house as it's known or known at the time. The Miller house
which is 3055 Camp Mineola Road was a house that when I first moved into Camp
Mineola it hadn't been lived in over 15 years. The house was built in 1920, sometime in
the 1920's, how do I know this? Norman Womack who is the president of the Mattituck
Historical Society was...gave me a photograph of the house dated 1929 so I know at the
least was in existence in 1929. The picture is taken from the beach up to the house. The
house is what's called a balloon construction and I'm sure you're familiar with the term.
Balloon construction was prevalent construction from the 1830's to the 1950's but had
some serious defects in it namely that when a fire was in the building it would spread up
through the eaves because the eaves were continuous from the bottom all the way to the
roof rafter. There is no installation in the house and as you know with balloon
construction the higher costs now with energy of the house is not energy efficient.
Cara Wells: There is still no installation?
Monaghan: There is still no installation in the house except for which I will get back to a
later a section of the house.
Daniel McConlogue: Is this waterfront?
Monaghan: This is not waterfront.
Gerard Schultheis: I'm looking at your property record card and I see that you have an
outstanding building permit.
Monaghan: Yes I do.
Gerard Schultheis: And you're putting additions and alterations to the house?
Monaghan: I'm putting...and this is what I was alluding to...I put in, it hasn't been
completed yet. If you look at the survey there was a screened in porch which was 8 by
20. Let me go back, if you look at a 1920's house what was one of the problems with a
1920 house was that there was no closet space. People didn't have a lot of clothes in that
time. My wife has been complaining for years that our bedroom in this house, which is a
four bedroom house, master bedroom downstairs, there's a 20 by 30 room upstairs with 2
other bedrooms. The footprint of the house has not changed since 1920. I haven't added
on or done any construction with the respect of the exterior of the house except for
completing and taking off the front porch. The reason why I took offthe front porch
because I had a carpenter ant problem and decided this past year, 2010, that what we
would do is expand the bedrooms, take away the porch, add to a sunroom we had, which
we did during January through April. We weren't here, we had a contractor come in and
we had a building permit which had expired because I had put in...I was going to do that
awhile ago and didn't come in (inaudible). This year I renewed the permit that I got here
in November and the building commenced and that's why I said to this young lady, I'm
sorry I didn't catch your name...

Monaghan: Ms. Wells, that they did was put in installation in the new part of the
completed porch that was finished off, so now I have an enlarged bedroom and enlarged
sunroom. Those portions that were worked on have installation in them. The rest of the
house does not. The rest of the house has one and a half baths, it still has a fireplace, it
has baton in the ceiling as I said the configuration of the house has not changed at all. It
had just been squared off really so it's still a 30 by 40 house. When I bought the house,
my wife didn't think it was a good idea because it had been overgrown for 15 years and I
fell in love with the house because I had an opportunity to get into the house to look at it
and fell in love with the baton, the wood. We bought the house, Mrs. Miller had gone to
a nursing home as I said 15 years she didn't live in the house, them was no heat, no
water, no electricity in the house. It had a lot of problems, overgrown. What I did was I
called in a friend of mine who was an engineer after I bought the house, not before I
bought the house. I should have probably done it before I bought the house but I was in
love with the house. I said to the engineer go up and tell me what's wrong with this
house if there's anything. He goes upstairs to the 20 by 30 room and puts a flashlight on
the floor and rolls it downhill so he said to me that I think you may have a problem. He
said the house is built on locust posts, which was very common in those times, and he
said the house is pitching forward. He said it's going to collapse on you so I said what is
the answer to correct the problem. He basically said you have to put in a new foundation.
So what we did was raise the house. I don't know if any of you are aware of Emie Davis
and a guy named Sheehan, they used to be the house raisers on the South and North Fork.
I hired Emie Davis, he raised the house and put in a full basement in the house and took
care of the problem and that's the way it's been.
Gerard Schultheis: That was done in 19947
Monaghan: 1994...yes, 1994 we did that...so it was basically that plus the construction
that was just completed were the only improvements we made to the house.
Daniel McConlogue: You gave us a lot of sales.
Monaghan: I did give you a lot of sales.
Daniel McConlogue: Are you familiar with any of those sales, can you help us with how
it compares to your house?
Monaghan: I'm trying to give you a flavor for the house.
Gerard Schultheis: Well we don't need...
Monaghan: Well I think you do.
Gerard Schultheis: Well where we are today, we are determining the assessment based
on what the house looks like today versus comparable houses that...
Monaghan: I understand that but what I think you have to do is kind of look at the
construction of the house...we all know that fair market value of a house, which Kevin
says is $504,000, is what a willing buy and a willing seller who are in possession of all of
the facts know would pay for the house and that's what I'm trying to get to. I'm trying to
give you a sense of what somebody who would come to my house and say what they
would offer me on the house.
Daniel McConlogue: Was there a professional engineer looking at the house?
Cara Wells: Can I make one comment?
Monaghan: Sure
Cara Wells: As a part owner of a seasonal cottage, with a very long history, your home is
actually extremely valuable to a New York market, young people looking for exactly
what you have. I understand a seasonal cottage.
Monaghan: It's not...my house is not a seasonal cottage.
Cara Wells: You have no installation.
Monaghan: I have no installation; the house has never been gutted. It doesn't have
central air; it doesn't have central vac. It doesn't have any of the amenities except...
Cara Wells: No but it does have central heat?
Monaghan: No.,.it does have central heat, yes.
Cara Wells: Ok, so it's not seasonal.
Gerard Schulteis: When was the heat added?
Monaghan: The heat was added in 1994.
Cara Wells: With the full basement
Monaghan: With the full basement
Cara Wells: So it's not a seasonal home
Monaghan: It's not a seasonal house.
Cara Wells: Thank you.
Monaghan: So let me go further, the house was hit by lightning during th el5 year period
that Mrs. Miller wasn't there. There was a fire in the roof. Mattituck Fire Dept.
responded they were fortunate enough to put out the fire. I can not use the attic in the
house for a couple of reasons. They (inaudible)joists and left the charred remains of the
burned joists still there which creates a problem. If you push up to go in the attic you get
black soot all over you so you can't use it. Maybe when I put a new roof on the house I'll
take it offand cure it. Right now I haven't gotten to that point. I will do that later on.
Let me tell you about the neighborhood. My house sits on the comer of Terry Path and
Camp Mineola Road. There are approximately between 30 and 40 houses in Camp
Mineola and Terry Path, that means that virtually everybody...and Camp Mineola is a
private road it's not covered by the Town the Town doesn't take care of it, so the owners
when it needs to be paved they have to pave it, when the snow has to be plowed they
have to pay for the plowing. It's not a public road. So right now the situation is that I get
anybody going into Camp Mineola Road or anybody on Terry Path passes my house. It
is a very busy street. You may recall that in 2006 there was a suit filed fellow by the
name of Norton Smith whom you may know and Bob Anderson bought a piece of
property in the 8 acres that's around my house. There is 8 acres of woodland around my
house and they were sued by the West End Property Owners Association of Camp
Mineola because they asserted that they had beach fights. There are two beaches in
Camp Mineola, there's a small beach and then there's another beach on the westerly side
of Camp Mineola Road and that beach is owned by the 11 houses in Camp Mineola that
aren't on the beach.
Gerard Schultheis: I appreciate the history but we are here to determine the value
today...
Monaghan: No according to Kevin you're to determine the value back in July.
Gerard Schultheis: July, that's today to us
Monaghan: Today it would even be worse.
Gerard Schultheis: Now you have a very unique house, you have problems with it, you
have situations with it.
Monaghan: Right, and I'm in a declining market.
Gerard Schultheis: Well you have submitted as proof sales.
Monaghan: I did, I analyzed all of the sales in Mattituck for the year 2010.
Gerard Schultheis: What I don't know with these sales are I don't know if these sales are
one bedroom houses or 10 bedroom houses, are waterfront or not.
Monaghan: I can tell you.
Gerard Schultheis: Have you ever had an appraisal done where you have three
comparable sales where they are adjusted for the condition of your house?
Monaghan: I didn't do that.
Gerard Schultheis: Do you have an insurance policy on the house?
Monaghan: Yes
Gerard Schultheis: Do you have a copy of that?
Monaghan: No I don't, I didn't bring it with me.
Gerard Schultheis: Do you know what the value that the house is insured afl
Monaghan: I haven't checked it recently. I don't know. My wife normally does that.
She normally takes care of the insurance.
Gerard Schultheis: Kevin, have you done any appraisal where you compare it to similar
houses with adjustments?
Jonathan Wiggins: Similar houses built in the '20's.
Kevin Webster: I did an appraisal on this home, yes.
Monaghan: You did an appraisal on my house?
Kevin Webster: I did.
Monaghan: May I have a copy of it?
Kevin Webster: Is that what we are doing? Are we submitting information here?
Gerard Schultheis: Yup
Kevin Webster: Ok, I'd be happy to distribute what I have.
Monaghan: Let me give you what I think are comparables to the house.
Gerard Schultheis: The information that you submitted has no information regarding the
number of rooms, the square footage of the house, the location...
Monaghan: Of which house?
Gerard Schultheis: Of these houses...
Cara Wells: Of any of them on your sales report.
Gerard Schultheis: I don't know they're comparable sales.
Monaghan: I'm going to give you the comparables. These are the comparables that I
view as comparable sales.
Gerard Schultheis: Ok, so that's further information you have.
Monaghan: Sure, and I have the listings with what the square footage is, what the taxes
are...
Gerard Schultheis: Let me see that.
Monaghan: Sure
Daniel McConlogue: Do you have a copy? Would you make a copy of this for us?
Kevin Webster: No I do not have a copy of that.
Jonathan Wiggins: Ok she is going to make another copy for us.
Monaghan: Sure...see the problem here is 640 Alois Lane which I have...is a house that
is 2.6 acres, has a 20 by 40 pool...
Cara Wells: It's 1.58 acres and it's been adjusted into Mr. Webster's figures.
Jonathan Wiggins: That's only a 52,000 adjustment?
Kevin Webster: For the land? Yes
Jonathan Wiggins: For over an acre?
Kevin Webster: It's not sub dividable. There is a difference between his lot and that lot.
Jonathan Wiggins: It's only an acre and a quarter and it's only $52,000.
Monaghan: It's a larger piece also it's an improved house, has much more improvements
than my house. It has a pool.
Cara Wells: Those have been adjusted. We have adjustments for those.
Jonathan Wiggins: Yeah, for the pool and the size of the garage.
Monaghan: It may be in the sheet I gave you.
Daniel McConlogue: It's being photocopied fight now. So you both used that one
lowest...
Monaghan: I didn't use the lowest because I thought it was a larger parcel, the
construction, it's not a 1920's...do you show when the house, Kevin?
Kevin Webster: It is 28 years old.
Jonathan Wiggins: It's a new house compared to yours.
Monaghan: It is a new house compared to mine, that's my point. When I looked at the
sales...what, pardon me?
Kevin Webster: He's asking me a question ifI adjusted for the age and I said no.
Monaghan: When I look at the sales and narrow it down I think I only found 2 or 3
houses maximum that had the construction constraints going back to the '20s. I think
there was one in 1931. Most of the houses that I saw were constructed between '50s to
now.
Gerard Schultheis: Are those houses included in your sales and your appraisal?
Monaghan: They are, let me give you one for example.
Gerard Schultheis: Are they included in the appraisals that you have?
Monaghan: I can give you all of the information. I have all of the information on
everything that I put on that chart.
Gerard Schultheis: No, my question is the appraisal that you are submitting to us right
now, are those houses included in that appraisal?
Monaghan: Which houses?
Gerard Schultheis: The two that were sold that were older homes.
Jonathan Wiggins: Ok we have them here right now.
Monaghan: 640 Alois, here is 640 Alois...originally put on the market at $705,000, that
was the original asking price. It is one family, detached seven rooms, three bedrooms
built in 1983.
Gerard Schultheis: Do you have the adjustments on these?
Monaghan: Do I have the adjustments?
Gerard Schultheis: Yes
Monaghan: They weren't furnished. The only thing I have now is Kevin's appraisal.
Gerard Schultheis: Well an appraisal takes the houses that are for sale that have sold and
adjust them so that in this essence you are looking at equal houses.
Monaghan: That is what I'm saying. Kevin used a comparable for my house for 640
Alois saying that it is comparable to my house. It is no where near comparable to my
house, even at the price that they sold it at $555,000. Remember it went on the market; it
was on the market for 161 days, original asking price was705 and it was eventually sold
for $555,000. It was a house built in 1983 completed renovated with a pool. It's not
comparable to my house.
Cara Wells: Huge private lot backs to Norris' estate...backing up to the Norris' estate is
a pretty nice piece of property.
Monaghan: I have a problem with that with the Norris' estate.
Cara Wells: Bay Avenue is certainly not a comp; Westphalia does not have the access to
the beach; Pike Street certainly...
Jonathan Wiggins: Bay Avenue is a similar aged house.
Cara Wells: It's in the industrial part of Bay Avenue and it's like Mrs. Willow's house or
whatever her name was...it's been vacant for I don't know how long.
Monaghan: Could we go through it?
Cara Wells: I am going through them.
Gerard Schultheis: She is making her comments based on her knowledge of real estate.
Cara Wells: Wickham Avenue is waterfront.
Monaghan: I view 3705 Ole Jule Lane as probably a comparable.
Jonathan Wiggins: Kevin, did you adjust for the air conditioning in here?
Kevin Webster: I did not, no. Our records did not show that 640 Alois had central air
conditioning.
Jonathan Wiggins: All right.
Daniel McConlogue: You have that as your comparable the one that he uses Ole Jule
Lane?
Monaghan: No I have 3705.
Daniel McConlogue: Yes, Kevin do you have that?
Kevin Webster: I did not. It is a one story ranch built in 1973. I did not use it as a
comparable.
Jonathan Wiggins: Do you have in ground sprinklers in your house?
Monaghan: No I don't.
Jonathan Wiggins: Did you adjust for in ground sprinklers?
Kevin Webster: No we do no adjust for in ground sprinklers.
Monaghan: What I looked at for example was 3705 Ole Jule Lane because it's in the
neighborhood; it was originally put on the market at 469,000 and sells for 409 in 2010. It
is 6 rooms, 3 bedrooms, 2 and half baths, I only have one bath.
Jonathan Wiggins: Which one are you looking at now?
Monaghan: 3705 OleJule Lane
Gerard Schultheis: Jonathan, what he submitted are just sales. There are no adjustments.
Jonathan Wiggins: Well he has Ole Jule Lane on here also.
Gerard Schultheis: That's Kevin's
Monaghan: May I explain my methodology?
Gerard Schultheis: We need certain information to make a decision; this is not sufficient
information for us. This is only sales of houses that aren't adjusted to be equal to your
house.
Jonathan Wiggins: But it is a comparable sale...it is a comprehensive sale in that it has
all the amenities...
Daniel McConlogue: We should argue this is private session. Let's get all the
information...
Monaghan: Here's one...to be candid with you I'll tell you, the next one I used as a
comparable was 1435 Park Avenue. It is on the list.
Gerard Schultheis: What I will be willing to entertain, I don't know what the other
members feel, is that if you are willing to come in with an actual appraisal done by an
appraiser where you have compared your house to three houses that are comparable and
adjustments made to come up with a value made of, that's acceptable.
Monaghan: One of the problems that I have, and I'm sure experiencing the same thing
that I have, that the market in Suffolk County is dropping rather quickly.
Gerard Schultheis: Okay we are not in Suffolk County; we are in the Town of Southold.
Monaghan: You're not in Suffolk County? You're in the Town of Southold?
Gerard Schultheis: We are in the Town of Southold which is...
Monaghan: I'll tell you what the web says about the Town of Southold. Mattituck, the
rating declined in Mattituck is about 10% a month almost in Mattituck sales where as in
Southold and Cutchogue it's 2 to 3% so Mattituck has to be carved out.
Cara Wells: Do you believe everything you see on the web?
Monaghan: No I don't, absolutely not. What I am saying is that there are trends. When
you look at trend line is Suffolk County everybody said that the market has been
declining ever since the second quarter of 2006 and it they said it would bottom out in the
second quarter of2011, they push it out until 2013. The market is still declining, and if
you look at the steep decline in prices in Mattituck as well as Cutchogue as well as
Southold the decline in Mattituck is greater so if you're looking at just the Town of
Southold you would be in error. You have to look at the town of Mattituck because it is
different from Cutchogue and Southold.
Cara Wells: Jerry how do you want to proceed?
Gerard Schultheis: Let me figure this out. We have to go with what the assessor feels is
the correct price unless sufficient proof is presented by you to indicate that's no true. We
have an appraisal from the assessor that based on our ground rules that we have to take.
Now, I will give you the option...
Monaghan: Whose ground rules, I'm not familiar with the process9.
Gerard Schultheis: The Board of Assessment Review, the rules set by New York State.
Monaghan: So if Kevin makes an assessment you're bound by his assessment.
Gerard Schultheis: It is presumed correct unless...
Monaghan: I'm giving you credible evidence that his valuation isn't correct.
Gerard Schultheis: Ok, what I need from you and I'm offering you the opportunity to do
it, is everybody in agreement that if he can...
Daniel McConlogue: We can talk about this. I think there's enough here to talk about at
least.
Jonathan Wiggins: I think there's enough here to make a judgment call.

Monaghan: I know. But just so you're aware what's going on in Mattituck, I don't know
how familiar everybody is whether they live in Mattituck, Cutchogue or Southold, what
I'm saying is that in my particular area there was a court case which dramatically
impacted the flow of traffic past my house. You're aware of the court case?
Gerard Schultheis: No and it...right now...
Monaghan: Well it should impact how you people view properties. The court case said
basically the people along Ole Jule and Kraus Lane now have a public easement to the
beach. Do you know the traffic that now passes by my house to go to beach? Kevin isn't
there and he did his appraisal and that's is fine, I don't think it's right but I'm telling you
that it dramatically impacts what a buyer is going to pay for a house when they see the
traffic coming into the 40 houses, somewhere between 35 and 40 houses in Camp
Mineola and everybody has two or three cars. The house next to me, the Hummel house
has been on the market three years. The price that originally went on was 669 and it's at
519. It is not selling. Can I use that as a comparable?
Gerard Schultheis: Comparable is a sale as I said we have everything we need to make
our decision. At this point I would like to adjourn the meeting.
Monaghan: Ok, I don't mean to take up any more of your time.

Monaghan: Thanks very much. Frankly I appreciate you hearing me. Do you need any

Daniel McConlogue: would be very helpful but we have to work with what we have. It
is to his advantage of he gets an appraisal with adjustments.
