BEGINNING at a monument on the west side of Bay Avenue, at the northeast
corner of land now or formerly of Hommel; running thence south 65 degrees
37 minutes west along land last mentioned 90 feet more or less to the
ordinary high water mark of Orient Harbor; running thence along said
ordinary high water mark of Orient Harbor on a tie line course and a
distance of north 34 degrees 51 minutes 50 seconds west 129.50 feet to
land now or formerly of Orient Wharf Company; running thence along land
last mentioned north 84 degrees 47 minutes east 123 feet to the west
side of Bay Avenue; running thence along the west side of Bay Avenue
South 22 degrees 39 minutes east 87 feet to the point or place of beginnin-_
Being and intended to be a portion of the same premises conveyed to the
party of the first part herein by deed recorded in Liber 8894 cp.449 .
Subject to rights of others to maintain the monument and flagpole presently
on the premises.
In order to not obstruct the water view from the premises across the
street (Bay Avenue) and known as the Bay House (the Bay house is known
on the Tax Map for the County of Suffolk as District 1000 , Sect. 25,
Block 3, Lot 12) and to not interfere with the nature and environment
of the area, the above-described premises are conveyed subject to the
following covenants which shall run with the land and be binding upon
the party of the first part herein, their heirs, successors and assigns:
1. No hedge, fence or anyother obstruction higher than three (3) feet
" shall be erected on the subject premises.
2 . The fence presently on the premises shall be open to be used as a gate .
