TERMS AND CONDITIONS The Permittee, James P. Martin, residin~ at 135 West 70t~ St., Apt.PHB, New York, Ny, as part of the consideration for the issuance of the Permit does understand and prescribe to the following: That the said Board of Trustees and the Town of Southold are released from any and all daroages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Pennittee assumes full liability with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold. MARTIN 2740 DEEP HOLE DR., MATTITUCK SCTM#123-4-11 Dear Mr. Just: The Board of Town Trustees took the following action during its regular meeting held on Wed., April 20, 2011 regarding the above matter: WHEREAS, J.M.O. Environmental Consulting Services on behalf of JAMES P. MARTIN applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance, application dated March 1,2011, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator recommended that the proposed application be found Inconsistent with the LWRP, specifically with Policy Standards 6 - Protect and restore the quality and function of the Town of Southold ecosystem and 6.3 - Protect and restore tidal and freshwater wetlands, and, WHEREAS, the Board of Trustees has furthered Policies 6 and 6.3 of the Local Waterfront Revitalization Program to the greatest extent practical through the imposition of the following Best Management Practice requirements: the catwalk will be constructed with open-grate decking, and the removal of the existing dock and reconstruction/relocation will not interfere with navigation, and, WHEREAS, a Public Headng was held by the Town Trustees with respect to said application on April 20, 2011, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, and, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that for the mitigating factors and based upon the Best Management Practice requirements imposed above, the Board of Trustees deems the action to be Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code, and, RESOLVED, that the Board of Trustees approves the application of JAMES P. MARTIN requests a Wetland Permit to legalize and modify an existing docking facility which consists of a 3'X 7' landward ramp leading to a 3'X 27' catwalk, 2.5'X 8' ramp and a 4'X 11' float secured by (2) batter piles. SCTM#123-4-11 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the LWRP and listed policy standards provided below. Policy 6. Protect and restore the quality and function of the Town of Southold ecosystem 6.3 Protect and restore tidal and freshwater wetlands. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andres Patent and other lands under their jurisdiction 1. Further, the applicant fails to prove that the action meets the following requirements § 275-11 Construction and operation standards C. 2 (d) of the Southold Town Code: (d) Review and approval of dock applications. Before issuing a permit for a dock structure, the Trustees shall consider whether the dock will have any of the following harmful effects: [1] Whether the dock will impair navigation or be located in areas of high vessel traffic or vessel congestion; The proposed dock expansion in relation to opposite shoreline structures is not discussed or shown and therefore an assessment of navi.qation impairments cannot be made. in addition, Chapter 275 requires that the determination of the len.qth of the dock must include the dimensions of the vessel. The dimensions of a vessel are not specified. An assessment to whether the expansion is consistent with the existin.q dock line cannot be made. [2] Whether the dock will unduly interfere with the public use of waterways for swimming, boating, fishing, she#fishing, waterskiing and ether water-dependant activities; 1. An assessment to whether the expansion would interfere with the use of waterways cannot be made. [5] Whether the dock will cause degradation of surface water quality and natural resources; 1. Applicant does not show current water depths on plans.
