The homeowner has given thought to the items discussed and has changed to a very reputable swimming pool company who has been in business for over 20 years to complete the job. A letter of authorization is also attached signed by the homeowner,Kathy Tsoumas stating that Eve Millner is the agent or contact person. All contact phone numbers are in detail so that you can contact both the homeowner and agent. We are submitting 5 new copies of survey/site plan showing that we have changed the pool size from a free form shape to a 1602 Rectangle. The changes made since the first submission has given us a greater setback, then what we have first shown. We are requesting a 50' setback from the wetlands. The Part 661 Tidal Wetlands Land Use regulations 661.6 section(1)criteria will not be able to be met of a 75' setback. This is the only variance from the NYSDEC that is being sought. We are asking for Variance from the 661.1 we are asking for the minimum setback for the proposed swimming pool from the wetlands. There are no other alternative placements that can be made for the pool in the size of the parcel in question. The environmental impact of the residence and neighboring properties will not be in jeopardy. Protection of all onsite wetlands, and preservation of the non-disturbance-non-fertilization buffer landward of the wetlands already exists and will remain. A 4'wide path to the existing dock will not be disturbed. This buffer from the wetlands serves as a screening to the west branch of the Mattituck Creek. The proposed swimming pool has been staked in the field by Swim King Pool as well as the proposed pool drywell location. All of these are depicted in the latest survey/site plan with this submission. Photograph evidence of these staking are also being submitted with this. The homeowner is also going to use a turfstone type of pervious paver around the pool area so that the lot coverage will remain in conformance and will not be over the 20%allowed. The existing stone driveway will be shorted for the proposed pool to be built and some of the existing walkway in the rear will also be removed.
