AUTHORIZATION
Pursuant to the provisions of Chapter 275 and/or Chapter 111 of the Town Code of the Town of
Southold and in accordance with the Resolution of the Board of Trustees adopted at the meeting held on
March 23.2011. and in consideration of application fee in the sum of $500.00 paid by Kevin & Alexandra
O'Mara and subject to the Terms and Conditions as stall in the Resolution, the Southold Town Board of
Trustees authorizes and permits the following:
Wetland Permit to construct (incorporating existing, previously permitted toe.
armor) approximately 226 Hnear feet of rock revetment, consisting of 4-5 ton quarry
capstone over 50-100 core stone, on filter cloth; cover stone and backfill with
approximately 250 cubic yards of clean sand to be trucked in from an upland source
and planted with Cape American Beach Grass (12" on center); re-vegetate denuded
portions of bluff face with beach grass, Bayberry, and Virginia Creeper; and repair
existing stairs as necessary; and as depicted on the site plan prepared by En-
Consultants, Inc. last dated January 27, 2011, and stamped approved on March 23,
2011.
IN WITNESS WHEREOF, the said Board of Trustees hereby causes its CorPorate Seal to be aft-Lxed,
and these presents to be subscribed by a majority of the said Board as of this date.
TERMS AND CONDITIONS
The Permittee Kevin & Alexandra O'Mara, residing at 14345 Oregon Road, Cutchogue, New
York as part of the consideration for the issuance of the Permit does understand and prescribe
to the following:
That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Southold.
That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
That thc work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Permittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.
That the said Board will be notified by the Permittee of the completion of the work
authorized.
That the.Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.

Dear Mr. Herrmann:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, March 23, 2011 regarding the above matter:
WHEREAS, En-Consultants, Inc. on behalf of KEVIN & ALEXANDRA O'MARA applied
to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the
Southold Town Code, the Wetland Ordinance of the Town of Southold, and Chapter 111
of the Southold Town Code, Coastal Erosion Hazard Areas, application dated February
16, 2011, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the application be
found Consistent with the Local Waterfront Revitalization Program policy standards,
and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on March 23, 2011, at which time all interested persons were given an
opportunity to be heard, and,

WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 and
Chapter 111 of the Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees have found the application to be Consistent
with the Local Waterfront Revitalization Program, and,
RESOLVED, that the Board of Trustees approve the application of KEVIN &
ALEXANDRA O'MARA to construct (incorporating existing, previously permitted toe
armor) approximately 226 linear feet of rock revetment, consisting of 4-5 ton quarry
capstone over 50-100 core stone, on filter cloth; cover stone and backfill with
approximately 250 cubic yards of clean sand to be trucked in from an upland source
and planted with Cape American Beach Grass (12" on center); re-vegetate denuded
portions of bluff face with beach grass, Bayberry, and Virginia Creeper; and repair
existing stairs as necessary, and as depicted on the site plan prepared by En-

Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

The CAC does Not Support the applications because the proposed erosion control
measures are not viable. This section of the shoreline is a major source of sediment
supplying beaches to the east.

i. State Not Liable for Damage The State of New York shall in no case be liable for any damage or
~njury to the structure or work herein authorized which may be caused by or result from future operations
undertaken by the State for the conservation or improvement of navigation, or for other pm-poses, and no
claim or right to compensation shall accrue from any such damage.
2. Notice of Commencement At least 48 hours prior re commencement of the project, the permittee
and contractor shall sign and remm the top portion of the enclosed notification form certifying that they
are fully aware of and understand all terms and conditions of this permit. Within 30 days of completion
of project, the bottom portion of the form mu~t also be sig~aed and returned, along with photographs of
the completed work.
3. No Construction Debris in Wetland or Adjacent Area Any debris or excess material from
construction of this project shall be completely removed from the adjacant area (upland) and r~moved to
zm approved upland area for disposal. No debris is permitted in weAlat~ds'and/or protected buffer areas.
4. No Disturbance to Vegetated Tidal Wetlands There shall be no disturbance to vegetated tidal
wetlm~ds or protected buffer areas as a result of the permitted activities.
5. Seeding Dizturbed Areas All areas of soil disturbance rgsulting from the 0.pproved project shall be
stabilized as per thc specifications of the approved plans immediately following projecu completion or
prior to permit expiration, w~LicheVer Comes fii~st. If the proj'ect site renSains inact~%e for morethan 48
hours or planting is impractical due to the season, then the area shall be stabilized with straw or hay
mulch or jute matting until weather conditions favor germination.
6. Clean Fill Only All fill sh~ll consist of olean sand or gravel of beach compatible grain size, and
must not contain asphalt, slag, flyash, broken concrete or demolistion debris.
7, No Beach Excavation For Fill No excavation of thc beach is authorized for thc purpose of
obtaining fill or stone materials,
8. Backfilling All peripheral berms; cofferdams, rock revetments, seawalls, gabions, bulkheads or
other approved shoreline stabilization structures shall be completed prior to placement of any fill
material behind such structures.

9. No Equipment below Apparent High Water Equipment operation below (seaward) apparent high
water is strictly prohibited.
10. Maintain Erosion Controls All erosion control devices shall be maintained in good and functional
condition until fl~e project has been completed and the area has been stabilized.
11. Plant Beach Grass The area of fill placement shall be planted with American Beach Grass planted
12 inches on center dUnng the first growing'seasOn follOWing placement, but not more than 6 months
following the placement of fill. The Permittee shall maintain a hca'ch:grass SUrvival rate of at least 85%
after 3 years. Any grass planted after April 15 of any calendar year shall be Lrfiggted.
12. Vegetate All Disturbed Areas The permittee shall revegetate all exposed facesand disturbed areas
to prevent soil erosion prior to the project completion or expiration date of this permit, whichever comes
first.
13. No RunoffDowh Bluff Or Onto Beach There shall be no discharge ofrtmoff or Other efrlluent
on, in or down the bluff face, onto the beach or over/through the revetment.
14. Revetment The rock revetment shall consist of natural quarry cap stone of 4 to 5 tons in size, on
top of a hardcore stone foundation and underlain with filter cloth as shown on the stamped approved
plans.

of the line of apparent high water.
16. Refueling No refueling of vehicles or equipment may occur on the beach.
17. Replacement of Fill This permit authorizes the replacement of up to 250 cubic yards of fill placed
over the revetment on an annual or as needed basis if necessary to ma~nta/n the slope of the bluff. Fill
shall be trucked down the beach and must be beach compatible grain size.
la. Stalrway Design Projects involving the repair or replacement of an existing stair way or walkway,
or sections thereof shall net exceed the wMth of the existing s~mctu~e as depicted on the approved plans
or a maximum of four feet whichever is greater.
19, Stairway Design The stairway must be constrncted with open grate steps to allow sunlight to reach
vegetation on the face of the bluff.
Z0. Inspect Bluff The permit holder shall conduct an inspection of the bluffon an annual basis prior to
May 1st of each calendar year from the date of permit issuance for the life of the permit, A written
record of the inspection mxast be completed which includes the date of inspect!on, and a d,scription and
color photographs of the condition of the bluff and structure. Each inspection record shall be provided

21. Conformance With Plans All activities authorized by this permit must be in strict conformance
with the approved plans submitted by thc applicant or applicant's agent as part of thc permit application.

22. State May Order Removal or Alteration of Work If future operations by the State of New York
require an alteration in the position of the structure Or work herein authorized, or if. in the opinion of the
Department of Environmental Conservation it shall cause u~easonable obstruction to the free navigation
of said waters or flood flows or endanger the health, safety or welfare of the people of thc State, or cause
loss or destraction of the natural resources of the State, the owner may be ordered by the Department to
remove or alter the structural work, obstructions, or hazards caused thereby without expense to thc State,
and if, upon the expiration or revocation ofthis permit, the structure, fill, e~cavation, or othe~
modification of the watercourse hereby aut~0fized shall not'be eon~pIcted, the owners, shall, without
expense to the State and to such extent and in such time and manner as the Department of
Environmental Conservation may require, remove all or any portion of the uncompleted structure or fill
and restore to its former condition the navigable and flood capacity of the waterCOurse. No claim shall
be made against- the State of New York on account of any such removal or alteration.
23. Precautions Against Contamination of Waters All necessary precautions shall be taken to
preclude contamination of any wetland or waterway by suspended solids, sediments, fuels, solvents,
lubricants, epoxy coatings, paints, concrete, leachate or any other environmentally deleterious materials
associated with the project.
sa. State May Require Site Restoration If upon the expiration or revocation of this permit, the
project hereby authorized has not been completed, the applicant shall, without expense to the State, and
to such extent and in such time and manner as the Department of Environmental Conservation may
require, remove all or any portion of the uncompleted structure or fill and restore the site to its former,
condition, No claim shall be made against-the State of New Yorl(on' accoUnt ofa~y such removal or
alteration.

The permittee shall provide a person to accompany the Department's representative during an inspectton
to the permit ~rea when requested by the Department.
A copy of this permit, including all referenced maps. drawings and special canditions, must be available
for inspection by the Department at all times at the project site or facility, Failure to produce a copy of
the permit upon request by a Department representative is a vio~ati6n Of this permit.
2. Relationship of this Permit to Other Department Orders and Determinations Unless expressly
provided for by the Department, issuance of this permit does not modify, supersede or rescind any order
or determination previously issued by the Department or any of the tv~mS, conditions or requirements
contained in such order or determination.

4. Submission of Renewal Application The permittee must submit a renewal application at least 30

5. Permit Modifications, Suspensions and Revocations by the Departmen, The Department

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my recommendation that the proposed action is
CONSISTENT with the below listed Policy Standards and therefore is CONSISTENT with the LWRP
provided that the followin.q questions listed in 4.1, D, 5a. are adequately answered:

Minimize losses of human life and structures from flooding and erosion hazards.

This section of the shoreline is subject to frequent storm surges
capable of eroding the toe of the bluff.

Construction of a hard structure is the only practical design consideration
and is essential to protecting the principal use.
The principal use is a private residential residence (not water
dependent). The purpose of the proposed structure is to dissipate
tidal and wave energy during storm events to minimize erosion of
the bluff seaward of the structure.
5. The proposed hard structural erosion protection measures are:

The proposed erosion control structure is limited in
design using natural stone. However, it is
recommended that the Board assess.

It is anticipated that enhancement of the existing toe stone installed in 2009 into a properly engineered rock
revetment (as was originally approved by the Trustees in 2005) will provide effective toe protection for the eroding
bluff(not being provided by the DEC - mandated toe stone) so that it can be effectively revegetated and stabilized.
Previous attempts to stabilize the bluff face through vegetative plantings failed due to toe scour and attempts to
stabilize the toe scour with the currently installed toe stone failed due to overtopping of the stone.
Implementation of the project is consistent with similar bluff stabilization efforts along this shoreline and will not
significantly adversely impact nor increase erosion of the fronting beach or adjacent properties. Further, the
structure has been designed in accordance with generally accepted engineering principles so that it will be durable;
capable of withstanding inundation, wave impacts, weathering and storm conditions; and have a reasonable
probability of controlling erosion for at least thirty years. Both the integrity of the structure and the proposed bluff
plantings will be maintained over the long term to ensure such effectiveness at controlling erosion.

The proposed revetment is consistent with Policy 4, as the proposed hard structural erosion protection measure is being proposed only
where non-structural, vegetative and smaller scale hard stabilization erosion control methods were implemented but ineffective; where
the natural protective feature - in this case the bluff- cannot be effectively enhanced without effective stabilization of the bluff toe;
where a hard structure is the only design consideration that can practicably and effectively provide such toe stabilization; where the
proposed protection measure is engineered to provide 30 or more years of effective erosion control but also designed as naturally as
possible (i.e., sloped, natural stone revetment rather than vertically faced retaining wall); where vegetative bluff face enhancement
remains part of the long term project design; and where, due to the natural design of the revetment, including its slope and angled end
returns, there will be no adverse impacts to the adjacent property owners. There will be no significant direct or indirect costs incurred by
the public as a result of the implementation of the project.
