the Southold Town Board of Appeals at a Regular Meeting held
on Thursday, September 3, 1981 concerning the above appeal:
BE IT RESOLVED, that Thomas and Phyllis Maus be granted
a variance to New York Town Law, Section 280-a for approval
of access, SUBJECT TO THE FOLLOWING CONDITIONS:

Pursuant to Section 617.13 of the N.Y.S. Department of
Environmental Conservation Act, Article 8 of the Environmental
Conservation Law, and Section 44-4 of the Southold Town Code,
notice is hereby given that the Southold Town Board of Appeals
has determined that the subject project as proposed herein is
hereby classified as a Type II Action not having a significant
adverse effect upon the environment for the following reason(s):
An Environmental Assessment in the Short Form has been
submitted which indicates that no significant adverse effects
were likely to occur should this project be implemented as

Patrick and Marilyn Astre, subject to my clients being
able to obtain a Certificate of Occupancy for a one-
family residence thereon. My clients have applied for
an obtained a certificate of Occupancy for this dated
8uly 6, 1981. Said certificate contains the wording,
"Approval of Access will be required before any
Building Permit may be issued."
Chicago Title Insurance Company, which is
searching the title reports that
"Lakeside Drive, Clearview Road and Oakwood Drive
are not legally opened or maintained by the Town
of Southold."
I enclose print of survey of the property
made by ~Roderick Van Tuyl, which shows that said ]~nd
fronts on the above-mentioned road and drives.
In view of the foregoing I would appreciate it
if you would let me know whether this would present a
