ZONING BOARD OF APPEALS
The Board made the following findings and determination:
Appellant has appealed to this Board seeking a variance from
the zoning ordinance, Article III, Section 100-31, Bulk Schedule
for an insufficient frontyard setback from Beachwood Lane of 30
feet. The subject premises contains an area of approximately
17,500 square feet with approximately 107 feet road frontage and
107 feet depth at the easterly property line and 202.70 feet
depth at the westerly property line. These premises fronts
Goose Creek and pursuant to correspondence dated August 20, 1981,
applicant has received permission from the N.Y.S. Department of
Environmental Conservation with the restriction that the new
home be placed not closer than 50 feet from the tidal wetland
boundary, leaving minimal area in the frontyard. The Board
agrees with the reasoning of the N.Y.S. Department of Environ-
mental Conservation; however, the Board feels that applicant
can take off a five-foot portion of the front of the dwelling
or perhaps change the design of the house in order to meet a
35-foot frontyard setback.
In considering this appeal, the Board determines ~hat the
variance request is not substantial; that the circumstances
herein are unique and the practical difficulties have been shown;
that by permitting a 35-foot frontyard setback no substantial
detriment to adjoining properties would be created; that the
difficulty cannot be obviated by a method, feasible to appel-
lants, other than a variance; that no adverse effects will be
produced on available governmental facilities of any increased
population; that the relief requested will be in harmony with
and promote the general purposes of the zoning code; and that
the interests of justice will be served by allowing the variance.
On motion by Mr. Goehringer, seconded by Mr. Grigonis,
it was
RESOLVED, that a variance to the zoning ordinance as
applied for in Appeal No. 2874, application of Matthew McKier-
nan be ALLOWED, SUBJECT TO THE FOLLOWING CONDITIONS:
1. That the frontyard setback be a minimum of 35 feet;
2. That the grading of the lot shall be done in such a
manner that it does not cause flooding of surrounding lots;
3. That this matter be referred to the Suffolk County
Planning Commission;
4. That this matter is subject to approval of the N.Y.S.
Department of Environmental Conservation;
5. That this project comply with the rules and regulations
of the Flood Damage Prevention Law of the Town of Southold;
6. That this project is subject to the approvals of the
Suffolk County Department of Health Services.

WHERE~S, WILLIAM H. KELYNACK, or his successors in int-
erest have conveyed by various deeds recorded in the Office of t~
Clerk of the County of Suffolk, plots of land located and being
at Southold, County of Suffolk and State of New York, known and
designated as Lots 1 through 5h inclusive, on a certain map known
aS "Map of Southwood", filed in the Office of the Clerk of the
County of Suffol~ on the 24th day of November, 1953, Abstract
#22~19, as Map No. 2]]41, which said deeds contained certain restrie
tire covenants as follows:
1. That only one single family dwelling house, for private pur-
poses, and a private garage, for family use, shall be built on anT
lot as shown on said Map. No trailers, tents or camping shall be
permitted and no occupancy of any such d~elling house shall be per
mitted until the outside and roof shall be fully and completely
finished and painted.
2. T~t no building, structure or structures on, above or below
the surface, other than public utility pipes or lines, shall be er
ected, constructed or maintained within forty (~0) feet of any
lane, highway or road as shown upon said Map, except that as to
lots numbered 1 to 5 inclusive the set back shall be thirty-five
(35) feet, and as to lots numbered 32 and 33 the set back shall
also be thirty-five (35) feet.
3. That no building, structure or structures on, above or below
the surface, other than public utility pi~es or lines, shall be
erected, constructed or maintained within ten (10) feet of ~lde-
linesboundaries and within five (5) feet of the rear lines of sai~
lots as shown on said Map.
~. That no building, structure or structures shall be erected
constructed or maintained of a height in excess of one and a half
stories, and that all roofs shall be of the hip, gable or pitch
type construction. Buildings shall be erected on closed founda-
tions of poured concrete or concrete bloc~ and no buildings on
posts shall be permitted. No flat roofs or lean to roofs shall be
permitted.
5. That no dwelling house, exclusive of garage, shall be erects
or constructed on any lot shown upon said Map which shall cost lee~
th~n ~8,000.00 nor contain less than 1,000 square feet on the
ground floor. Ail roofs shall be of asbestos, cedar or compoai-
tionsshingle and no roof shall be laid down with rolled roofing.
Ail plans and specifications shall be subject to the approval of
the party of the first part in writing.
6. No trade, craft, business, manufacture, industry, commerce
or profession (medical and dental profession permitted) including

hotels, boarding and rooming houses, shall be conducted on any 1
on said premises as shown on said Map.
7. No fences shall be permitted along any roadway or lane as
shown upon said Map. Open type or hedge fences shall be permitte
along the sidelines of said lots as shown upon said Map and shall
not exceed three (3) feet in height or six (6) feet in height a-
long the rear lines thereof.
8. No n%isances and noises of any kind, unwholesome and offen-
sive to the neighborhood, shall be permitted to exist on any lot
shown on said Map, nor shall any accumulation of ~ubbish, garbage
Junk or materials of any kind be permitted to remain on any of sa
lots. No advertising signs, billboards or other sign devices
be permitted on any of said lots, excepting a developer's sign or
a "FOR S^LE" or "?OH BENT" siMn of reasonable dimensions. Lot
Owners shall cut the grass and keep the appearance of the lots in
accordance with the standard of the community. No outside clothe
lines shall be permitted except circular umbrella type clothes
ers.
9. No fowl, poultry, animals or livestock shall be kept on
of said lots, except domestic household pets.
10. There shall be no outside toilets or outhouses erected up
any of said lots. An adequate septic tank or cesspool shall be
erected and maintained to take care of the sewage disposal at sac
dwelling erected upon any of said lots, and the same shall be of
such design and construction as may be approved by the Suffolk
County liealb~ Department.
ll. Each of said lots as stxown upon Laid May shall be subject
to electric light, gas and telephone easements on the surface or
below th~ surface along the roadway or lane adjacent to each of
said lots.
12. No sand, earth or sod shall be removed from the premises,
excavation be allowed to remain open thereon, except as may be ne
cessary at such times as building or landscaping operations are i
progress.
13. The said covenants and restrictions are hereby declared to
be covenants and restrictions attached to and running with the
land. That such covenants and restrictions are to run for a per-
iod of ten (10) years and shall terminate on June 26, 1963. The
covenants and restrictions con~ained herein may be changed, amend.
ed, altered, released or annulled by an instrument in writing, ex.
ecuted by the party of the first par~ and by the then record own-
ers of more than one half of the lots shown on said Map$ and
WHEHLAS, by instrument dated December 19, 1962, and re-
corded in the Suffolk County Clerk's 0ffioe on December 2h, 1962,
in Liber 5283 at page 496, the aforesaid WILLIAM H. KELYNACK, did
appoint the party of the first part his true and lawful attorney
in fact to act for him and in his place and stead to perform all
acts of enforcement and administration necessary to ca~ry out and

maintain the standards and objectives set forth in the aforesaid
covenants ~nd restrictions; ~nd
~HE~'~E^S, by agreement dated August 2?, 1962, and record-
ed on August 28, 1962, in the Suffolk County Clerk's Office in
Liber 5221 at page 358, the aforesaid covenants and restrictions
were extended for an additional period of ten (10) years to June
26, 1973; and
WHER~S, the parties of the second part herein are now
the owners of more than one half of the lots shown on said "Map
of Southwood"; and
WHERMAS, the party of the first part and the parties of
the second part are desirous that the covenants and restrictions
as here-in-above set forth be extended for an additional period
of ten (10) years to June 26, 1983, in order to promote the order.

and agreements herein contained, it is mutually agreed that pur-

The agreement was signed by Richard W. Ken, er as
president of the Association and the individual property

The agreement appears to be legal and binding and
I believe your Association would be in a good position to block
any lot owner who would attempt to violate the Covenants and
Restrictions.
I would consider preparing another agreement prior
to June 1983 (around April or May) and filing with the County
Clerk to keep the Covenants from expiring.

Dear Mr. Lademann:
At a Regular Meeting of the Board of Appeals held on
October 15, 1981, the Board was advised that there is a
current set of covenants and restrictions filed with the
County Clerk concerning construction in this subdivision,
"Map of Southwood, Map No. 2141" and the Board had requested
that our office be supplied with a copy of same certified
by the Suffolk County Clerk as early as possible.
This appeal is to be placed on the agenda for the next
regular meeting of this Board to be held November 5, 1981,
and the Board requests submission of the documentation to
our office by November 5, 1981.

This Commitment shall be effective only when the identity of the proposed Insured and the
amount of the policy or policies committed for have been inserted in Schedule A hereof by the Com-
pany, either at the time of the issuance of this Commitment or by subsequent endorsement.
This Commitment is preliminary to the issuance of such policy or policies of title insurance
and all liability and obligations hereunder shall cease and terminate nine months after the effective
date hereof or when the policy or policies committed for shall issue, whichever first occurs, provided
that the failure to issue such policy or policies is not the fault of the Company.
This Commitment shall not be valid or binding until countersigned by a validating officer or
authorized signatory.

Gentlemen:
I represent Mr. and Mrs. Matthew McKiernan in their
proposed purchase of Lot No. 53 on Map of Southold, Lots Nos.
1-53 inclusive.
The McKiernans appeared before your Board on September
17, 1981, to request a variance from the zoning ordinance to
allow a setback of 30 feet.
It is my understanding that at the time of the hear-
ing, certain individuals appeared objecting to the granting of
the variance based upon the existence of certain covenants and
restrictions. Please be advised that a title report has been
ordered from Foremost Abstract, Inc. under title no. 8108-
273343, and they have informed me that any and all covenants
and restrictions which previously applied to the subdivision
have expired. Therefore, the only restraints on the location
of building on Lot No. 53 are those restraints contained in the
Town of Southold zoning ordinance. However, my clients have
informed me that they intend to comply with the expired covenants
and restrictions other than the setback requirements.
Please make this letter part of your record in res-
pect to Mr. and Mrs. McKiernans application for a variance.
Thank you for your courtesy and cooperation in this
matter.

The members of the above named Association do hereby oppose
the granting of any variances for the poroposed construction
on Lot Number fifty-three, ( 53 ), Map of Southwood, Southold,
New York which directly conflicts with the Covenants and Rest-
rictions of said property dated November 2~, 1953 and extended
to June 26, 1983.
Section A of s,~id Covenants and Restrictions specify that a
minimum of forty feet front yard setback be kept and a minimum
of fifteen feet sideline setb~ck be kent. We o~pose any variance
to these restrictions.
We would also oo~ose any permission to be ~anted that would
allow construction more than the reouired two feet above the
crown of the road.
We also respectfully request that any further consideration to
the granting of any variances on ssid Lot 53 be tabled until
such a time that full complAance with the regulations of the
Department of Environmental Conservat~on conscern~ng the min-
imum setback of seventy five feet from Mean High W~er and
full compliance of the reeuired distance for the nlacement of
the sewage system of one hundred fee% from Mean H~h W~.ter
have been met.
Prior objections to construction on this oro~erty have beon
fi~ed by the North Fork Environmental Council. This ~ronerty
also adjoins land under control of the Town Trustees and they
should also be a~praised of the situation.
We ask that no variance be ~ranted that is in dlrec~ conflict
with DEC regulations, Suffolk County Board of Mealth reouire-
ments and the Covenants and Restrictions of the above named
Association.

The entire premises as shown upon a certain filed map entitled~ "Map of Southwood
File ~21~1 at Southold, New York," made by Otto W. Van Tuyl & Son, Licensed Land Surveyors,
Greenport, New York, dated May 1st, 1953, including the lots being conveyed hereunder and
including other lands of the party of the first part as shown on said filed map (This map
is filed in the Suffolk County Clerk's Office) shall be subject to the following covenants
and ~estrlctions:
1. That only one single family dwelling house, for private residential purposes, and a
private garage, for family use, shall be built on any lot as shown on said MaD. No trail-
ers, tents, or camping shall be permitted. No occupancy of any dwelling (house) shall
be permdtted until the roof shall be completely finished and the outside finished
and painted.
2. That no building, structure or structures on, above or below the surface, other than
public utility pipes, or lines, shall be erected, constructed or~aintained within forty
(~0) feet of any lane, highway, or road as shown upon said Map, except that as to lots
numbered 1 to 5 inclusive the set back shall be thirty-five (35) feet, and as to lots
numbered 32 and 33 the set back shall also be thirty-five (3~) feet.
3. That no building, structure or structures on, above or below the surface, other
than public utility pipes or lines, shall be erected, constructed or maintained within
fifteen (1~) feet of sidelines boundaries an4 within twenty-five (25) feet of the rear
boundaries for the construction of a dwelling.
~. That no building, structure or structures shall be erected, constructed or main-
tained at a height in excess of one and a half stories, and that all roofs shall be of
the hip, gable or pitch roof type construction. Buildings shall be erected on closed
foundations of poured concrete or concrete blocks, and no buildings on wooden posts
shall be permitted. No flat roofs or lean to roofs shall be permitted. The required
two (2) feet grade must be taken from the crown of the road. No more than two and one
half (2}) concrete blocks or twenty (20) inches of p~ured foundation shall be showing
after grade.
5. That no dwelling house, exclusive of garage~ shall be erected or constructed on
any lot shown upon said Map which shall contain no less than 1,O00 square feet on the
ground floor. All roofs shall be of asbestos, cedar or composition shingle and no
roof shall be laid down with rolled roofing. All plans and specifications shall be
subject to the approval of the party of the first part iu writing.
6. No trader craft, business, manufacture, industry, commerce or profession
(medical, dental and legal included) Including hotels, boarding and rooming houses,
shall be conducted ou any lot on said premises as shown on said Map.
7. No fences shall be permitted along any roadway or lane as shown upon said Map.
Open type or hedge fences shall be permitted along the sidelines of said lots as shown
upon said Map and shall not exceed three (3) feet in height or six (6) feet in height
along the rear lines thereof.
8. No nuisances and noises of any kind, unwholesome and offensive to the neighbor-
hood shall be permitted to exist on any lot shown on said Map, nor shall any accumulation
of rubbish, garbage, Junk or materials of any kind be permitted to remain on any of said
lots. No advertising signs, billboards or other sign devices (including a developer's
sign) shall be permitted on any of said lots. A "FOR SALE" or "FOR RENT" sign can be no
more than two (2) feet by three (3) feet. Lot owsers shall cut the grass and keep the
appearance of the lots in accordance with the standard of the community. Outside clothes
dryers must be of the conventional type.
9. No fowl, poultry, animals or livestock shall be kept on any of said lots, except
domestic household pets~ which should be restricted to premisis.
lC. There shall be no outside toilets or outhouses eFected upon any of said lots.
An adequate septic tank or cesspool shall be erected and maintained to take care of the
sewage disposal at each dwelling erected upon any of said lots, and the same shall be of
such design and construction as may be approved by the Suffolk County Health Department.
11. Each of said lots as shown upon said Map shall be subject to electric, electric
light, gas, and telephone easements on the surface or below the surface along the road-
way or lane adjacent to each of said lots.
12. No sand, earth or sod shall be removed from the premises, or excavation be allowed
to remain open thereon, except as may be necessary at such times as building or land-
scaping operations are in progress.
13. The said covenants and restrictions are hereby declared to be covenants and
restrictions attached to and running with the land. That such covenants and restrictions
are to run for ten (10) years and shall terminate on June 26, 1963.
By the powers transferred to the Southwood Property Owners' Association and recorded
the Suffolk County Clerks Office at Riverhead, N.Y., the a~socistions directors amended
Schedule "A" to extend the covenants and restrictions for an sdditio~al ten (10) year
period until. June 26, 1973 at which time said covenants and restrictions are to run with

Pursuant to Section 617.13 of the N.Y.S. Department of
Environmental Conservation Act, Article 8 of the Environmental
Conservation Law, and Section 44-4 of the Southold Town Code,
notice is hereby given that the Southold Town Board of Appeals
has determined that the subject project as proposed herein is
hereby classified as a Type II Action not having a significant
adverse effect upon the environment for the following reason(s):
An Environmental Assessment in the Short Form has been
submitted which indicates that no significant adverse effects
were likely to occur should this project be implemented as
planned.
A Tidal Wetlands Permit #TW 15276-0177A (Marlo J. Fusaro)
has been issued by the N.Y.S. Department of Environmental Conser-
vation permitting the placement of the new dwelling 50 feet, more
or less, from the tidal wetland boundary.
This declaration should not be considered a determination
made.for any other agency nor for any other project not covered by
the subject appeal application.
