S¢r8¢ Doyen, Jr. Fred Huls¢, Jr. MINUTES Southold Town Board of Appeals January 30, 1975 A regular meeting of the Southold Town Board of Appeals was held at 7:30 P.M. (E.S.T.), Thursday, January 30, 1975, at the Town Office, Main Road, Southold, New York. There were present: Messrs: Robert W. Gillispie, Jr., Chairman; Robert Bergen; Fred Hulse, Jr. Absent: Messrs: Charles Grigonis, Jr. and Serge Doyen, Jr. Also present: Mr. Bob Winkler of the Suffolk Times. Decision of the Board on Appeal No. 1981, Richard Cron, Esq. a/c Ivan T. Honnett, Orchard Street, New Suffolk, New York: THE CHAIRMAN: At the las~ meeting of the Board we postponed decision on this appeal. The proposal is to expand the existing house which is one of two houses owned by the applicant at the corner of Orchard Street and'Third Street, New Suffolk. The house is a one and a half story frame building. I think at the last meeting, Mr. Cron, that you said something about the roof line. RICHARD CRON, ESQ: The dormer would not go beyond the outside line of the house. THE CHAIRMAN: In 1967 Appeal No. 1151 was denied for permission to rebuild a non-conforming dwelling on a small lot with two dwellings thereon. Appeal No. 1981 is for a variance in accordance with the Zoning Ordinance, Article III, Section 100-31 and Bulk Schedule. Southold Town Board of Appeals -2- January 30, 1975 MR. CRON: I do not take the position that it is non- conforming. It is a permitted use. THE CHAIRMAN: Any small building can be enlarged under our Ordinance providing the outside dimensions are not changed. If this applicant wants to put a cellar under the house, install a single dormer, and square off the two corners of the dwelling it would not alter the existing lines. It is conforming use. MR. CRON: The dormer would not go beyond the outside line of the house. THE CHAIRMAN: After discussion with Counsel, neither one of us was convinced that this ahould be denied even though it is an undersized lot because a man has the right to use his property, and this is conforming use. He does no~ propose to decrease the side or front yards. He is just going to go up and he is going to build a cetlar under the dwelling. ROBERT BERGEN: He will also square off the house. MR. CRON: It won't go beyond the existing building lines. MR. FRED HULSE, JR.: We are now talking about filling in. THE CHAIRMAN: If he fills in, he.won't change the front yard or the side yards, he won!t decrease the side and front yards. He.will add to the living area, which he is allowed to do. Our feeling is that Judges would l~ok on this, if we denied it, as depriving the applicant of use of his property. MR. CRON: The original application was presented in such a manner that it was denied. MR. BERGEN: I would not like to see any more variances of any kind on this property. MR. CRON: A man could come in and ask for it but I can't conceive of any other requests for a variance~ THE CHAIRMAN: Is there anyone present who wishes to speak against this application? (There was no response.) THE CHAIRMAN: Are there any other questions? (There was no response.) Southold Town Board of Appeals -3- January 30, 1975 After investigation and inspection the Board finds that applicant requests permission to alter and rebuild dwelling on small lot at Orchard & Third Streets, New Suffolk, New York. The findings of the Board are that applicant proposes to alter existing dwelling for year round use. Applicant is the owner of a 75' x 100' lot on which is situated two summer type dwellings. He proposes to improve and alter one of the dwellings by installing a cellar, installing a single dormer, and squaring off the two corners of the dwelling, without going beyond the existing building lines. The Board finds that any small buildings can be enlarged under our Ordinance providing the outside dimensions are not changed. The Board agrees with the reasoning of the applicant. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will not change the character of the neighborhood; and will observe the spirit of the Ordinance. On motion by Mr. Gillispie, seconded by Mr. Bergen, it was RESOLVED, Richard Cron, Esq. a/c Ivan T. Honnett, Orchard Street, New ~uffolk, New York, be GRANTED permission to alter and rebuild dwelling on small lot at Orchard & Third Streets, New Suffolk, New York, as applied for, subject to the following condition: That there shall be no further diminution of front or side yards now or in the future. Vote of the Board: Ayes:- Messrs: Gillispie, Bergen, Hulse. PUBliC HEARING: Appeal No. 1995 - 7:45 P.M. (E.S.T.) upon application of William Heins, Main Road, Orient, New York for a variance in accordance with the Zoning Ordinance, Article III, Section 100-30 and Bulk Schedule for permission to maintain existing addition to garage causing a reduction in side yard. Location of property: Route 25 and Old Main Road, Orient, New York, bounded on the north by Tuthill; east by now or formerly Duvall; south by Main Road; west by Old Main Road. Fee paid $15.00. Southold Town Board of Appeals -4- January 30, 1975 The Chairman opened the hearing by reading the application for a variance, legal notice of hearing, affidavits attesting to its publication in the official newspapers, and notice to the applicant. THE CHAIRMAN: Is there anyone present who wishes to speak for this application? (Mr. William Heins was present to speak for the applica- tion). THE CHAIRMAN: There is a note in the file dated January 23, 1975: "To~Whom It May Concern: There is no objection on my part re~rding a building ofMr. Hein's being too near the property line." s/s William D. Tuthilt. Is that your neighbor to the north? MR. WILLIAM HEINS: Yes. THE CHAIRMAN: How close is the building to the line? MR. HEINS: I thought it was about 10 feet. THE CHAIRMAN: This first survey shows 12 feet but I khink you added something to that. MR. ROBERT BERGEN: How much did you add on to the garage? MR. HEINS: About 8 feet. THE CHAIRMAN: The cause of all this trouble was that you connected the accessory building to the house which put the house three feet from the line. Originally the building was there and you enlarged the.original garage, and tken attached the garage to the house. The house is eleven feet from Old Main Road and it is on an irregularly shaped lot. I think that the reason why the date~of the original applica- tion for a Building Permit is 1969 and this violation that the Building Inspector found is dated 1975 is that in the meantime you were trying to buy some property. THE CHAIRMAN: Is there anyone present who wishes to speak against this application? (There was no response.) Southold Town Board of Appeals -5- January 30, 1975 After investigation and inspection the Board finds that applicant requests permission to maintain existing addition to garage located on Route 25 and Old Main Road, Orient, New York. The findings of the Board are that applicant is the owner of a building which pre-existed the Zoning Ordinance and which is on an irregularly shaped lot. The Board feels that the addition will not change the character of the neighborhood, and agrees with the reasoning of the applicant. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will not change the character of the neighborhood; and will observe the spirit of the Ordinance. On motion by Mr. Gillispie, seconded by Mr. Bergen, it was RESOLVED, William Heins, Main Road, Orient, New York, be GRANTED permission to maintain existing addition to garage which is situated on property located at Route 25 and Old Main Road, Orient, New York, as applied for. (E.S.T.) upon application of Douglas Cooper, Bergen Avenue, Mattituck, New york for approval of access, in accordance with Section 280A Town Law, on Private Road. Location of property: Off north side Bergen Avenue, Mattituck, New York, bounded on the north by Long Island Sound; east by David Cooper; south by Met Homes; west by Met Homes. THE CHAIRMAN: Is there anyone present who wishes to speak for this application? Southold Town Board of Appeals -6- January 30, 197~ MR. DOUGLAS COOPER: I have 135 feet in width on the Sound. There is an existing farm road. This would be a right of way across my father's property. MR. ROBERT BERGEN: Is a right of way from Bergen Avenue on up shown in your Deed to this property? MR. DOUGLAS COOPER: I am pretty sure it is. MR. ROBERT BERGEN: I would suggest that you be sure that you have it because if this property were sold to someone else there would be no way to get to your property except by helicopter. MR. COOPER: My father is having Mr. Wickham draw up a Deed. THE CHAIRMAN: We will act on your application subject to your bringing in a copy of the Deed. We.drove up there and it appears that the old farm road is in pretty good condition. MR. COOPER: We have an old road scraper and we keep it honed up. THE CHAIRMAN: When you create this new access to your property you should take out topsoil and improve it to 15 feet for emergency vehicles in all types of weather. Put in suitable bank-run. This will be subject to approval of the Building Inspector. The hoUse is so far from Bergen Avenue and from the old farm road that I should think you would improve this all the way to the house. We can only talk about access to your property. ~Your dwelling will be 380 feet from the Sound. This main farm road is good, have you put sand on it? MR. COOPER: We do, once in awhile, when it gets a little muddy. THE CHAIRMAN: We have to approve access all the way to Bergen Avenue. It looks pretty good at this point but you will have to improve it to 15 feet wide and put in bank-run, and get the approval of the Building Inspector. THE CHAIRMAN: Is there anyone present who wishes to speak against this application? (TThere was no response.) Southotd Town Board of Appeals -7- January 30, 1975 After investigation and inspection the Board finds that applicant requests approval of access for property located off the north side of Bergen Avenue, Mattituck, New York. The findings of the Board are that applicant proposes to build a dwelling on a single lot which could be reached by extending an existing farm road. The Board agrees with the reasoning of the applicant. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will not change the character of the neighborhood, and will observe the spirit of the Ordinance. On motion by Mr. Gillispie, seconded by Mr. Hulse, it was RESOLVED, Douglas Cooper, Bergen Avenue, Mattituck, New York be GRANTED Dpp~oval of access for property located off the north side of Bergen Avenue, Mattituck, bounded on the north by Long Island Sound; east by David Cooper; south and west by Met Homes, as applied for, subject to the following conditions: That applicant shall improve the access from the old farm road to the new lot under application by moving the topsoil to a width of 15 feet and replacing it with suitable bank-run, subject to approval of the Building Inspector. That applicant shall furnish to the Board of Appeals a copy of Deed granting this right of way from Bergen Avenue to applicant's property. Vote of the Board: Ayes:- Messrs: Gillispie, Bergen, Hulse. The Chairman read the following letter: Mr. Robert W. Gillispie, Jr. Main Road East Marion, N. Y. Dated: January 22, 1975 Re: ~arvey Bagshaw Variance Southold Town Board of Appeals -8- January 30, 1975 "In furtherance of our telephone conversation this morning concerning the variance granted by the Board of Appeals to Bagshaw at the last Board of Appeals meeting. It is my understanding that the Board voted to grant the variance of the 300 foot distance requirement although the decision has not been prepared nor filed. In reviewing this matter again with Mr. Yakaboski who is handling the present proceeding against the Board of Appeals brought by Mr. Goodate, both Mr. Yakaboski and I are of the opinion that based upon recent court decisions, the Board of Appeals has nou authority to vary the conditions set forth in the ordinance upon the approval of a special exception. In view of the foregoing, I believe that the appropriate pro- cedure for the Board to follow is for the Board to adopt a resolution at its next meeting providing for a rehearing for a reconsideration of the previous grant of the variance. Subdivision 6 of Section 267 of the Town Law provides that "upon motion initiated by any member and adopted by the unanimous vote of the members present, but not less than a majority of all of the members, the Board of Appeals shall review at a rehearing held upon notice given as upon an original hearing, any order, decision or determination of the Board not previously reviewed." This section further provides that upon such rehearing, the Board may, upon the concurring vote of all of the members then present, reverse, modify or annul its original order, decision or determination. For your information I am enclosing herewith copies of the current decisions upon which I have concluded that the Board has no authority to grant a variance to any of the conditions set forth in the ordinance under a special exception case. TASKER On motion by Mr. Gillispie, seconded by Mr. Bergen, it was RESOLVED that a rehearing be held at 7:30 P.M., February 27, 1975 for Appeal No. 1988, Harvey Bagshaw, Deephole Drive, Mattituck, New York for reconsideration of variance granted on January 9, 1975. Vote of the Board: Ayes:- Messrs: Gillispie, Bergen, Hulse. Southold Town Board of Appeals -9- January 30, 1975 Mr. Reginald Hudson sent four maps of property surveyed for Claire Brody & Otkers of four lots located on the east side of Gull Pond Lane, Greenport. A public hearing was held on Appeal No. 1954, Brody & Others, on October 3, 1974 at which time decision was postponed pending submission of this appeal to the Planning Board. THE CHAIRMAN: It is p~posed to divide this property into four lots on Gull Pond Lane. I believe we will have to grant permission to use this property in some way. How- ever, it can't be used for residential purposes, it's filled land. The applicants have asked us for permission to have boating privileges there. They want to sell these lots off and file a declaration of restriction so it can't be used for residential purposes. The Chairman directed the secretary to write a letter to Mr. Hudson requesting that he submit separate applications for the four lots on this property. Therewwas a further discussion by the Board regarding restrictions, particularly as it concerns sanitary facilities. On motion by Mr. Gillispie, seconded by Mr. Bergen, it was RESOLVED that the minutes of the Southold Town Board of Appeals dated January 9, 1975 be approved as submitted subject to minor correction. Vote of the Board: Ayes:- Messrs: Gillispie, Bergenr Hulse. Three (3) Sign Renewals were reviewed and approved as submitted.
