This conveyance is made without consideration as a partial
distribution under the Last Will and Testament of Lois A. Thorp,
a/k/a Lois Johnson Thorp
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets ani
roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenance.-
and also all the estate which the said decedent had at the time of decedent's death in said premises, and als-
the estate therein, which the party of the first part has or has power to convey or dispose of,whether individ
ually, or by virtue of said will or otherwise; TO HAVE AND TO HOLD the premises herein granted unt,
the party of the second part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby thersaid remises have been incumbered in any way whatever, except as aforesaid.
AND,the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party o
the first part will receive the consideration for this conveyance and will hold the right to receive such consid
eration,as a trust fund to be applied first for the purpose of paying the cost of the improvement and will appl,
the same first to the payment of the cost of the improvement before using any part of the total of the same fo
any other purpose.
The word party" shall be construed as if it read "parties' whenever the sense of this indenture so requires

SCHEDULE "A"
All that certain plot, piece or parcel of land situate, lying and
being at East Marion in the Town of Southold, County of Suffolk
and State of New York, bounded and described as follows:
BEGINNING at a point on the southerly side of North Lane at the
corner formed by the intersection of the southerly side of North
Lane with the easterly side of West Lane and from said point of
beginning South 86 degrees 27 minutes 1-0 seconds East"315.70 feet
along the southerly side of North Lane to the Westerly side of
East Lane,
THENCE South 31 degrees 01 minutes 30 seconds East 65. 68 feet
along the westerly side of East Lane to a point,
THENCE South 58 degrees 58 minutes 30 seconds West 130.00 feet
along land now or formerly of Jones to a point,

THENCE North 31 degrees 01 minutes 30 seconds West 35.46 feet
along lands of Wilson to a point,
THENCE South 58 degrees 58 minutes 30 seconds West 130 feet still
along lands now or formerly of Wilson to a point on the easterly
side of West Lane,
THENCE North 31 degrees 01 minutes 30 seconds WestV//209.35 feet
still along the easterly side of West Lane to the point or place
of BEGINNING.
TOGETHER WITH whatever right, title and interest the party of the
first part may have of, in and to a right of way running from the
premises hereinbefore described to Old Orchard Road and thence
northerly over Old Orchard Road to the Main Highway, and TOGETHER
WITH whatever other rights of way, if any, are appurtenant to the
said premises.
SUBJECT TO whatever right of way over said premises may exist in
favor of and running to premises now or formerly of LeRoy G.
Edwards and others, lying to the east of the premises
hereinbefore described.
TOGETHER WITH whatever interest, if any, the party of the first
part may have of, in and to the land under the water of
Gardiner's Bay adjoining the said premises on the south and
TOGETHER WITH whatever interest, if any, the party of the first
part may have of, in and to the land under the water of Marion
Lake adjoining the said premises on the north.
BEING AND INTENDED TO BE a portion of the premises conveyed to
FRANK S. THORP and LOIS JOHNSON THORP by Deed dated December 19,
1949 and recorded in the office of the Clerk of the County of
Suffolk on December 19, 1949 in Liber 3028 of conveyances at page
407. The said Frank S . Thorp having died on August 13 , 1975 and the
said Lois Johnson Thorp being the survivor tenant by the entirety.
