The Southold Town Board of Trustees reviewed the survey dated October 16, 1998 and last
revised January 5, 2001, and determined the proposed vestibule and the conversion of the
existing garage to a family room to be out of the Wetland jurisdiction under Chapter 97 of the
Town Wetland Code.
However, any activity within 100' of the Wetland line would require permits from this office.
This determination is not a determination from any other agency.

The following action was taken by the Southold Town Board of
Trustees at their Regular Meeting held on Wednesday, May 24,
2000:
RESOLVED, that the Southold Town Board of Trustees grant an
Amendment to Permit #5086 to depict a seasonal "stick" dock and
a low-sill bulkhead proposed 7' farther landward than originally
proposed. Regarding the dock, the catwalk will be supported by
4"x4" posts and the float by 4"x6" posts, and the ramp and float
will be removed and replaced seasonally, as they comprise the
portion of the dock to be located seaward of the vegetated tidal
wetlands, as per the request of the DEC.
However, this permit does not constitute any other permits from
other agencies.

Dear Mr. Herrmann,
The following action was taken by the Board of Town Trustees
during a Regular Meeting, held on November 30, 1999, regarding
the above matter:
WHEREAS, WILLIAM BAYLIS, applied to the Southold Town Trustees
for a permit under the provisions of the Wetland Ordinance of
the Town of Southold, application dated November 5, 1999 and,
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on November 30, 1999, at which time
all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 97-18 of the Southold Town Code,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approves the application of
WILLIAM BAYLIS to construct approx. 91 1.f. of vinyl low sill
bulkhead and create approx. 930 s.f. of inter-tidal marsh
landward by placing approx. 75 c.y. of clean sand fill to be
trucked in from an upland source and planted with spartina
alternaflora, remove existing 10' X 35' timber dock and
associated pilings and construct a 4' X 16' catwalk, elevated 4'
above marsh with a 3' X 14' ramp and a 6' X 20' float with 2- 8"
in diameter pilings. Located: 535 Arshamomoque Ave.,
Southold.
BE IT FURTHER RESOLVED that this determination should not be
considered a determination made for any other Department or
Agency which may also have an application pending for the same
or similar project.
Permit to construct and complete project will expire two years
from the date it is signed. Fees must be paid, if applicable,
and permit issued within six months of the date of this
notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.

Dear Mrs. Herbert:
As we discussed by telephone, please find enclosed the captioned permit to be corrected and
reissued to my attention. Specifically, the permit as presently written could be interpreted to
authorize construction of a 4' x 28' catwalk, whereas the Board approved construction ora 4' x
16' catwalk, as depicted on the revised project plans enclosed herewith~ Stating that the
originally proposed "structure" needs to be "moved landward 12 feet" unfortunately makes the
wording of the permit too ambiguous and will inevitably lead to confusion and misinterpretation
of the permit during the construction phase.
In fact, as a general rule, I believe that it would be in the Trustees' interest for the wording of the
permits to clearly state what is ultimately approved, rather than stating what was originally
applied for and how that proposal was changed.
Thus, would you kindly substitute the enclosed plans for those most recently submitted to your
office and change the new dock portion of the permit to read as follows: "...construct a 4' x 16'
catwalk, elevated 4' above marsh grade, a 3' x 14' ramp, and a 6' x 20' float secured by (2) 8"
diameter pilings."
Please call if you have any questions regarding my request. Otherwise, I thank you in advance
for your cooperation and look forward to receipt of the revised permit.

To Whom It May Concern:
The New York District, U.S. Army Corps of Engineers, has received a request for
Department of the Army authorization for the following activity:
APPLICANT:

ACTIVITY:
Under authority of the nationwide general permit program, construct
approximately 91 linear feet of vinyl low-sill bulkhead and create 930
square feet of intertidal marsh landward of the proposed bulkhead by
placing approximately 75 cubic yards of clean sand fill and planting
with Spartina alterniflora 12 inches on center on a 1:7 slope. Remove
an existing 10 foot by 35 foot timber pier and associated pilings and
construct a fixed timber pier of a 4 foot by 28 foot fixed pier, elevated
a minimum of 4 feet above the grade of the proposed marsh, a 3 foot
by 14 foot walk-ramp, and a 6 foot by 20 foot float to be secured to
two 8-inch diameter pilings. The purpose of this project is to provide
erosion protection and an adequate mooring facility.

As this is minor in nature, authorization may be by Letter of Permission. This is in
accordance with current Federal Regulations governing work in navigable waters of the
United States. To accomplish the coordination required, prior to the issuance of a Letter
of Permission, your review of the enclosed drawing is requested.
Pursuant to Section 307 (c) of the Coastal Zone Management Act of 1972 as
amended (16 U.S.C. 1465 (c)(3)(A)), the applicant has certified that the activity complies

Construct approximately 91 linear feet of vinyl low-sill bulkhead and create approximately 930
square feet of intertidal marsh landward thereof by placing approximately 75 cubic yards of clean
sand fill to be trucked in from an upland source and planted with Spartina alterniflora (12" on
center) on a 1:7 slope.
Remove existing I0' x 35' fixed timber dock and associated pilings and construct a fixed timber
dock, consisting ora 4' x 28' fixed catwalk (elevated a minimum of 4' above proposed marsh
grade); a 3' x 14' ramp; and a 6' x 20' float to be secured by (2) 8" diameter pilings.
