BE IT FURTHER RESOLVED that this determination should not be considered a determination made for any other Department or Agency which may also have an application pending for the same or similar project. Permit to construct and complete project will expire two years from the date it is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. Specifically, the permit as presently written could be interpreted to authorize construction of a 4' x 28' catwalk, whereas the Board approved construction ora 4' x 16' catwalk, as depicted on the revised project plans enclosed herewith~ Stating that the originally proposed "structure" needs to be "moved landward 12 feet" unfortunately makes the wording of the permit too ambiguous and will inevitably lead to confusion and misinterpretation of the permit during the construction phase. In fact, as a general rule, I believe that it would be in the Trustees' interest for the wording of the permits to clearly state what is ultimately approved, rather than stating what was originally applied for and how that proposal was changed. Thus, would you kindly substitute the enclosed plans for those most recently submitted to your office and change the new dock portion of the permit to read as follows: "...construct a 4' x 16' catwalk, elevated 4' above marsh grade, a 3' x 14' ramp, and a 6' x 20' float secured by (2) 8" diameter pilings." Remove an existing 10 foot by 35 foot timber pier and associated pilings and construct a fixed timber pier of a 4 foot by 28 foot fixed pier, elevated a minimum of 4 feet above the grade of the proposed marsh, a 3 foot by 14 foot walk-ramp, and a 6 foot by 20 foot float to be secured to two 8-inch diameter pilings. The purpose of this project is to provide erosion protection and an adequate mooring facility. WATERWAY: Petty's Pond, Shelter Island Sound LOCATION: Town of Southold, Suffolk County, New York As this is minor in nature, authorization may be by Letter of Permission. This is in accordance with current Federal Regulations governing work in navigable waters of the United States.
