Box 1179 Southold, New York 11971-0959 RE: Malcolm McAllister and Ethel McAllister Appeal No. 5025 Dear Chairman Goehringer: On December 13, 2001, the Zoning Board of Appeals granted a variance for a pool in the side yard area on the McAllister property on Ocean View Avenue, Fishers Island, New York (SCTM #1000-9-6-8.3 and 8.4). The Board granted the applicant's proposed pool location which was 95± feet from Ocean View Avenue and 100± feet from the McKown property (a copy is enclosed). As I understand it, the contractor in installing this pool did not pay attention to the wording of the variance and became confused as to where the front yard ended and the side yard began. This is somewhat understandable due to the size and orientation of the existing residence with the front yard property line on Ocean View Avenue. In any event, the contractor excavated for the pool and was informed the pool was not in the proper location. Finally, the surveyor, Richard Strouse, staked where the front yard area ended and the side yard began and had them relocate the pool some 64 feet from the front yard property line. The McAllisters' who own the property want to leave the pool in this area due to the topography of the side yard area. However, the Southold Town Building Department does not see it that way and even though the pool is now presently located in the side yard area, they have taken the position, in order to issue a Certificate of Occupancy that the pool must conform exactly to the language of the variance unless the Board of Appeals informs them otherwise. In the meantime they have issued a Stop Work Order. Mr. Gerard P. Goehringer -2- June 20, 2002 Southold Town Board of Appeals This leaves the McAllisters' in somewhat of a dilemma as they would like the pool to remain in this location, however, they want to be able to use it this summer and to attempt to relocate it this time does not make much sense. I am enclosing a copy of Mr. Strouse's letter to me dated June 19, 2002 along with his revised drawing with the exact location of the pool with its landscape design. Therefore, I am requesting you present this matter to the Board to find out what they will require as the McAllisters' would like the pool to remain in this area. It is also my understanding Mr. George Horning has been to the site and is familiar with the situation. Your prompt attention to this matter will be sincerely appreciated. RFL/bd Enclosure cc.
