AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consid- eration as a trust fund to be applied first for the purpose ofpaying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. THORP ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being at East Marion, Town of Southold, County of Suffolk, State of New York, described as the following: BEGINNING at the point: where the easterly line of land formerly of Gardiner's Bay Company as shown on "Map of Section Two Gardiner's Bay Estate situate at East Marion, Long Island" filed in Suffolk County Clerk's Office on September 23 , 1927 under the No. 275 intersects the: high water mark of Gardiner's Bay; thence running easterly or northeasterly along said high water mark seventy (70) feet; thence north thirty-one degrees, one minute, thirty seconds West (N. 310 1' 30" W. ) parallel to the easterly lime of said land formerly of Gardiner's Bay Company, Inc. , Two Hundred Seventy-five (275) feet more or less to the southerly lime of a proposed street to have been laid out by Frank S. Thorp and Lois Johnson Thorp, his wife, residing at 120 Rockaway Avenue, Rockville Centre, Nassau County, New York; thence westerly along the southerly line of said proposed street to the easterly line of said land formerly of Gardiner's Bay Company, Inc. at a point Two Hundred Ninety (290) feet northerly from the point of BEGINNING; and thence south thirty-one degrees, one minute, thirty seconds East (S. 310 1' 30" E. ) along said land formerly of Gardiner's Bay Company, Inc. TOGETHER with an easement over the right of way running Westerly. from the premises in as above described to Old Orchard Road and thence Northerly over Old Orchard Road to the main highway.
