WITNESSETH, that the party of the first part, in consideration of ten dollars and other valuable consideration
paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs
or successors and assigns of the party of the second part forever,
ALL that certain plot, piece, or parcel of land, situate, lying, and being in
the Town of Southold, County of Suffolk, and State of New York, being bounded
and described as follows:
BEGINNING at a point on the easterly side of a private road known as Major's
Pond Road at the northerly line of land Shown as the "Park and Playground" as
Shown on the Map of Willow Terrace, Section One, Map No. 5407;
RUNNING THENCE from said point along the easterly side of said private road
known as Major's Pond Road North 01 degree 38 minutes 10 seconds East, 400.67
feet;
THENCE South 88 degrees-21 minutes 50 seconds East, 81.11 feet to land now or
formerly of John H. and Joyce A. Holzapfel;
THENCE along said lands the following four (4) courses and distances:
(1) South 27 degrees 17 minutes 20 seconds East, 77.63 feet;
(2) South 19 degrees 01 minutes 10 seconds East, 120.00 feet;
(3) South 06 degrees 59 minutes 50 seconds East, 69.29 feet;
(4) South 02 degrees 13 minutes 10 seconds East, 138.06 feet•to land now or
formerly of Derrick D. and Donna S. Cephas;
THENCE along Said lands South 51 degrees 25 minutes 50 Second$ West, 67.10
feet;
THENCE North 75 degrees 40 minutes 20 seconds West, 132.71 fee;: to the point or
place of BEGINNING.
TOGETHER with all of Grantor's right and interest in and to a certain
" "Declaration," dated December 2, 1969, which was recorded in the Office of the
Suffolk County Clerk at Liber 6668 of Conveyances, Page 347, and which was
thereafter modified by "Amendment to Declaration," dated February 7, 1972,
which was recorded in the Office of the Suffolk County Clerk at Liber 7108 of
• Conveyances, Page 232, and thereafter modified by "Modification of
Declaration," dated September 22, 1994, which was recorded in the Office of the
'Suffolk County Clerk at Liber 11695 of Conveyances, Page 201, and specifically
including the right to use the "Park and Playground" as well as the roads set
forth in the said "Declaration," as modified and amended.
SUBJECT TO all declarations, covenants, restrictions, reservations, and
agreements of record, including, but not limited to, those declarations,
covenants, restrictions, reservations, and agreements executed by the Grantor
or any of her predecessors in title, which are of record.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO
HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever.
AND the party of the first part covenants that the party of the-first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except Rs aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indentpre so requires.
