party of the first part, and
CHARLES BERNER, JR., residing at 411 Main St., Apt. 1C, Greenport,
New York
party of the second part,
WITNESSETH, that the party of the first part, in consideration of ten dollars paid by the party of the second
part, does hereby remise, release and quitclaim unto the party of the second part, the heirs or successors and
assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being fi XIM at Mattituck, in the Twon of Southold, County
of Suffolk and State of New York, bounded and described as
follows:
BEGINNING at a point on the northerly line of land now or formerly
of Arthur H. Penny distant 351.60 feet on a course North 700 45'
00" East and when measured along said northerly side of land now
or formerly Arthur H. Penny, and along the northerly side of
land now or formerly Minnie Schutt from a point on the northeasterly
side of Westphalia Avenue, from said point of beginning. RUNNING
THENCE along land now or formerly of Mabel L. Bubier North 190
43' 40" West 600.58 feet to the shore of Mapes Creek; THENCD
along the shore of Mapes Creek on a tie line of North 820 15'
40" East 110 feet; THENCE South 180 50' 30" East 587.61 feet
to said northerly line of land now or formerly of Arthur H.
Penny; THENCE along said last mentioned land South 700 45' 00"
West 100 feet to the point or place of BEGINNING.
SUBJECT to and together with the benefits of an easement or
right of way 15 feet in width running from premised adjoining
on the East to Westphalia Road as created by deeds made by
Lizzie Y. Meday recorded in liber 984 cp 99 as modified by
agreement between Stephen C. Bubier and Ruth Sloan Gimbernat
dated April 25, 1966 and recorded in Suffolk County Clerk's
Office on August 25, 1972 in Liber 7227, page 470.
BEING AND INTENDED to be the same premises conveyed to the party
of the first part by deed dated April 23, 1966 and recorded in
the Office of the Clerk of the County of Suffolk on April 29, 1976
at Liber 8024 page 558.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO
HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever.
AND the party of the first part, in compliance with Section 13 of the Lien Law, hereby covenants that the party
of the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year first above
written.
