Fishers Island/Southold Videoeonferencing Equipment
On April 12, 2011 the Town Board passed a resolution to formally enable Fishers
Island Zoning and Planning Board Members to vote at Regular and Special Meetings
via videoconferencing. However, when Member Homing and the Board used the
equipment at the ZBA meeting on April 20th, the audio was intermittent at best and
the image quality was quite poor. To be used effectively, the system connectivity
needs to be considerably improved

Accessory Apartments in Accessory Structures
The Chairperson and Member Dinizio attended a Town Board work session on April
12, 2011 to present the ZBA's request that the Town Board clarify the intent of the
code regarding the continuation of a second use in an accessory structure when an
accessory apartment is established, and to discuss issues relating to the required
calculation of livable floor area to determine code conformance. Both of these issues
were referred to the Code Committee meeting on April 2t, 2011 which was attended
by the Chairperson and Members Diuizio and Schneider.
Clarification of the Code: Intent
On April 26, 2011 the Town Board passed a resolution (no. 2011-348) to hold a
pubic heating on May 24, 2011 to discuss a proposed amendment to the current
code Section 280-4-13B (13)(0 which would read "The accessory structure which
is to be converted, in whole or in part, to permit an accessory apartment shall be in
existence and be eligible for or have a valid certificate of occupancy issued prior to
January 1, 2008."
B. Calculation of Livable Floor Area
At their Regular Meeting on April 26, 2011, the Town Board adopted Resolution
no. 2011-353 titled Policy on Calculation and Verification of Livable Floor Area

which directs the Building Department to verify livable floor areas in all Special
Exception Permit applications for accessory apartments in accessory structures
submitted to the Zoning Board of Appeals, within 14 days of receipt of the
application from the ZBA Office. The ZBA Chairperson has scheduled a meeting
with the Building Department Head Mike Verity and ZBA Assistant Vicki Toth to
establish interdepartmental procedures and discuss acceptable documentation from
applicants so that application instructions may be revised accordingly.
