There were present: Mess~s:~ John-Wickham,~ Chairman,. Henry Moisa, Alfred Grebe,~ .Archibald Young. Absent: William'Unkelbach,! due to poorlweatherconditions. -Also present: Otto Van Tuyl,.Consultant,~ Howard Terr~ Building Inspector. On motion bylMr. Moisatl seconded by-Mr. Grebe~ it-was RESOLVED that the following amendments be made to the "Town of Southold~. Rules and Regulations for the Subdivision Southold Town Planning Board --2- February 3~ 1965 1.-Amend Section 5,~ "IMPROVEMENTS", by adding a new item~ to be item 4, to read as follows: SECTIONS, ITEM4: A construction inspector'representing the Planning Board shall~inspect-all improvements while in the process of construction and it shall be the duty of the subdivider to notify the PlanningBoard when the improvement is to be commenced and subsequently before it is completed, 2.-Amend Section 5, "IMPROVEMENTS", by'adding a new item to be item .5, to read as follows: SECTION 5, ITEM 5: The constuuction inspector shall certify to the Planning Board when all improvements are $ompleted as required by the regulations and specifications of the Planning Board. 3~ Amend Section 5w. "IMPROVEMENTS",. by adding a new item to be item i(b t),, to read as follows: SECTION 5~ ITEM .~1): All highways terminating at tidewater shall have a width.of not less than 100 feet back from themain high water mark~ All highways on waterfront propertymust have the~'~ame access to the watez as above required. 4, Amend Section 5~ "IMPRO~NTS",. I~em 2 e~ to read as follows: SECTION 5, Item 2e: A width of not:less than 70% ,of the bounds of the highway shall be hereinafeer known as the highway area from which all trees¢, brush~ rocks~ stumps, and other obstruction shall be thoroughly cleared 'and'all such material shall be removed from the bounds of the highwayl 51 Amend Section 5~i"IMPROVEMENTS"~ Item2j~ to read as follows: SECTION 5,, ITEM 2j: After. the highway area has been proper~y graded, rolled and Shaped to the approval.of the superintendent~ef'Highways, the twenty--four foot section in the center of the highwayarea~erein- after referred to as the road section) shall be,stabilized Southold Town Planning L~rd -3- February 3~j1965 with an application of one (~) gallon of SC-1 (Bituminous Cut Back)per square yard mixed 'to a depth of i.C4) inches. Amend Section 5 "IMPROVEMENTS"~ Item.2m~ to read as follows: SECTION 5,~ ITEM '2m: Sidewalks shall be standard four foot in width,~ four inches thick e~ceptin driveways where they mustbe not less than six inches thick. Ail curbs-and gutters to be built to stanaard forms as may be directed by the Superintendentof Highways.~ On existing Town Highways the town will furnish the necessary engineering grad/ng,~ fill and labor; the property ,~w~er orowners sh~ll furnish the necessary ready mixed doncrete and shall deliver'such concrete to the site as directedby the ~Superintendentof Highways, The amount of sidewal~ ~constrnction throughout the ~TOWn.s~ail~ determined by the Town-Board. ~i~Amend Section 9~ "DETAILS OF CONSTRUCTIONIbiPROVEMENTS%, item 1,i to read as follows: SECTION 9~ ITEM 15 The entire sewage systemand the disposal of-sanitary and stormsewage shall be planned and built 'to meet the approval of the proper~'a~iDistriative officialsz but inall cases,, all liquids must be returned' to the soil. 81 Amend Section 9,, "DETAILS OF'CONSTRUCTION'IMPROVEMENT"~, item 2, to read as follows: SECTION 9, ITEM2: The water distribution system shall be designed to meet the approval of the New ¥ork~State Department of Health and the Suffolk'CountyD~partment of Health, Southold Town Planning ~o~rd -4-- February 3 ~J1965 9~ Amend Section 9~ "DETAILS 0F CONSTRUCTI©N IMPROVEMENTS't~ Item 3',~ by adding a new item 3,~ and thus moving ali remaining items up one number,. New item '3 to read as follows: SECTION 9, ITEM3: In subdivisions,~ including the development ofproperty fronting on saltwater or'~oontemplated saltwater frontage, the plans for such de~elo~mentshall be approved by the Planning'Board andthe Town Trustees as it affects the f~eshwater, resources of theTown, and other town regulations. IMPROVEMENTS .~ 10. Amend Section 9~ "DETAILS OFCONSTRUCTION " the new item 6~. to read as follows byadding the following phrase: SECTION 9, ITEM 6: In lieu ofmaking the improvements as specified ............... of the parties thereto. If the planning Board Shall decide atany time'during the term of the performance bond,, upon //~pection~by'its constructio$ inspector, that the extent ofbuiIding devel0pmentthat has taken pla~e in the subdivision is not-suffiCient to warrant-----~ .......---- ---------- ofsuch proceeds. ll.~Amend Section on "PROCEDURE" In regard'to the fees for applications: 109acres or less - base fee of $50.'00; Over~10 acres - base fee plus $5°00 for each additional~acre or ~f~cti0n thereof in excess of 10 acres. Also byadding a new paragraph.under the fee: In addition~ a highway inspection fee' of $50.00 per mile or fraction thereof will be charg~ed , but'a mininum~charge of $40.00 will be made in all cases. By amendingArticle III, Section 300, by-adding thereto a new section to be lb, to read as follows: ARTICLE II~' SECTION 300~ SUBSECTION lb: The construction of a new two family dwelling Will.be permitted in the "A" Residential and Agricultural District by special exception ofthe Board of Appeals. as hereinafter provided, if the building lots contain twic~ the required square footage area and twice the frontage~.r,e a required~or'a single family dwelling. 2. By amending Article VII, Section 703, to read as follows: ARTICLE VII~~ SECTION 703, A permit will be required prior~tothe commencing of workfor the erection or'additions to all buildings. 3. By amending Article VII~ Section 705~ to read as follows: ARTICLE VII%i SECTION 705~- For. each applicatlon. or Appeal to the Board of'Appeals as hereinafter provided~there sb~i1 be a fee offifteen dollars i($15.00) accompanying the application or appeal. 4. On motion by Mrl Moisa, seconded.by Mr~ Grebe, it was RESOLVED .in .the matterof the petition of William'Wickham fora change of zone from "A" Residential and Agricultural District to "C" Industri~l. District on certain real property located in Cutchogue, in the Town of Southold, Suffolk'County, New York, and more particularly bounded and~desCribed as follows: bounded north byMiddle Road, east byMoore, south by'Long Island Railroad, west by Tuthil~, containingaPProximately 18 acres more or less. It is hereby'RESOLVED bthat the Planning Board favorably recommends to the Town Board the change of zone from "A Residential and AgriculturalDistrict to "C" Industrial District on the property of William'Wickham as described above. This is Parcek'II on the original application of~Mr.i William Wickham, submitted tothe Board in June,~ 1959. Mr. Wickhamhas been more than cooperative in this mat~erand we feel that the time has come for this to be given some'consideration for change. The Planning Board held a lenghty discussion with the preSidentof Cove Beach Estates,. Inc.,~ and the Supervisor was also present, at this meeting to discuss the chang.e of zone. This change of zone meets the approval of all parties involved. Voteofthe Board: Ayes:-Mr. Wickham~. Mre Moisa~ Mr. Grebe, and Mrl Young. The Planning Board received from the Town BOard a petition for a change of zone from "A" Residential and Agricult~aiDis~rict to "B" Business District by'Woodhull Properties, Inc., ~ith the instructions to prepare an official report_definingthe conditions described inthe petition and determine the area-so e~fected with the recommendation of the Plan~ing Board. The Planning Board further recommends that the Town B~rd on its o~n motion include in this change the property of Young to the east. The property of Young will be the only remaining residential property between the proposed change and the business propertyof the Orient Point Inn~ if it is not included. vote of the Board: Ayes:-Mr. Wickham,~ Mr. Moisa, Mr. Grebe~ and Mrj Y®~ng.
