There were present: Messrs: John~Wickham~ Chairman; Henry Moisa, Archibald Young, William Unkelbach. Absent: Mrl Alfred Grebe - Also present: Otto Van Tuy~, Consultant; Howard Terry,, Building Inspector; Lawrence Tuthill~, Professional. Engineer. Mr. Lefferts P. Edson appeared before the Board~to further discuss the subdivision ,Eastern~Sho~es at Greenport,~ Section II". This subdivision will have Village'Water~and a ,statement or contract will be received from,the villageof Greenport. The Board of Health has not yet given itsz approval but this is expected to be obtained before the next meeting of the Planning Board. The Planning Board will also require a statement at a later date for .some property on the shore front when this~s developed. The Planning Board next viewed the map of the subdivision, "Blue Horizons,, loca~edon the north side of the: North Road,. Peconic, NewYork. This subdivision contains a-n-area of 6.63acres,.and ownedand developed by'CjP%F~' Land COrporation~ The mortgage for this property is held by Mr. George Williamson, formerowner'of the property. Southold Town Planning B~6~rd -5- February-1~, 1965 On motion by Mr. Moisa, seconded by Mr. Unkelbach,~ it was PcESOLVED that the Southol~Town Planning Boardrecomme~ to the Town Board a performance bond of $15~000-00 for the construction ofthe .roads and the watermains in the subdivision, "Melrose Manor", located in Southold, owned and developed by Clement Booth. Vote of the Board:~Ayes:-Mr. Wickham, Mrl Moisa~ Mr. Young, and Mr. Unkelbach. The Planning Board nex~qheld a very lenghty discussion with the Southold TownT~stees. The Planning Board requested this meeting with .the trustees in order to discuss man- made canals. The biggest problem concerning manmade canals is that the fresh water in the Town is being destroyed by salt'wa~er running into it. The Planning Board and the T~nstees both felt that there should be some regulations concerning the digging of canals.. At the present time, a permit-is not needed to dig a canal on the person~s own property if he desires to do so. It was thought that perhaps the Zoning Ordinance could be changed to provide for certain specifications for digging a canal. The Planning Board and the Trustees next discussed the possibilityof the Town taken over the bottom of the man-' made canals. However, the Town Board was not-willing to go along with this when it was suggested to t hem. It was thought that perhaps the Town could pay up to half the cost of maintaining the canals. BOth'the Planning $0ard and the Town Trustees felt that a permit~should~e required before a ~erson may dig a canal on their own.Droperty. Such permit could be obtained from either the TOwn Trustees or the Planning Board, or perhaps both Boards should be consulted for such a permit. The Problem of excavatingwas also discussed. A person could easily just keep digging in his own back yard until he reached water. Sucha thing would be undesirabl~ to the Town. Both boards felt.that a permit for excavating should also.be required. So~thold Town 1planning B~rd --6-- February l~ 1965 On motion by'bLro Moisa~ seconded by Mr. ~nkelbach, i t was RESOLVED that~the Somthold Town PlanningBoard further recommed a change in the "Rules and Regulations for the Subdivision of~'Aand"~, in regard to Section 9, "DETAILS OF CONSTRUCTION IbIPROVEMENTS",. Item 3. Item 3 should read as follows: SECTION 9~ ITEM3: In subdivisions, including th~ development of property fronting on saltwater or contemplated saltwater frontage, the plans forlSmCh development shall be a~proved by the Planning Board and the Town Trusteesas it affects tt~ f~esh water resources of the Town and other Town regulations. Notwithstanding any other provision of this section, no person may make a connection between tide waters and. a canal or excavate without a permit from the Town Trustees~ nor without submitting plans to the Planning Board. The Planning Board met with the Town Trustees, and this new regulation is mostagreeable to both parties. Vote .of theBoard: Ayes:-Mr~ Wickham~ Mr. Moisa, Mr. Young~ and Mr. Unkelbach. On motion by Mr. Young, seconded by Mr.. Moisa, it was RESOLVED that theminutes of the Southotd Town Plan~ing Board dated January 15~. 1965, be approvedas submitted. Vote of the Board: Ayes: Mr. Wickham, Mr. Moisa, Mr. Young~ and Mr. Unkelbach.
