Thursday~ June 3~ 1965, at the Town Office, Main Road, Southold~ New York. There were present: Messrs: John Wickham, Chairman. Henry -Moisa,i Alfred Grebe, Archibald Young, acting chairman until Mr. Wickhamwas present~' and William Unkelbach. Also present: Messrs: Otto Van Tuyl~ Consultant. Howard Terry, Budding Inspector. Lefferts~P. Edson, Esq.~ and Mr. Schneider~appearedbefore the ~oard to request a date .for~a final hearing-on:E~stern Shores, at-Greenportl Section III. Mr. Yonng~ acting'Chairman~ advised Mr. Edson that a letter of-approVal ~as needed from Harold Price~ Superin~dent of~Highways~ on .thelayout-of the roads. Also. the Planning Board had not yet received an estimate for a per- formance bond fort~e completion of the roads and water mains in the subdivision. On motion by Mr. Unkelbac~, seconded by Mr. Moisa, it was RESOLVED that the subdivision to be known as "Eastern Shores at Greenport,'.Section IV,, located at Greenport,. containing approximately 12 acres, oWned and developed by HJJ.~S% Land & Development'Corp., be ~iven preliminary approval. Vote of the Board: Ayes:-Mrj Young, Mr. Grebe, Mr. MoiSa, Mri Unklebach. -~ ~ ' Southold Town Planning Bo~d -3- Ju~e 3, 1965~'~ Edward Abitz appeared before the Board to request~a date for a final hearing on the subdivision, "Mat%~k'Estates,. M_ri Young ~ acting Chairman, advised him that '~y~Q~ld set a date for a hearing as soon as possible, but would have to wait for Mrl Wickham to set a definite date. Mr. AbitZ also presented the Board with photographs of the type of entrance he would ~e to have to the subdivision. He stated that this entrance~would be five feet to six feet back from the road and requeSted the BOard's opinion on the matter. Mr. Young advisedMr. Abitz, thata WOod entrance would be more acceptable than e~be~y shrubbery. There is a chance that the shrubbery wouid become overgrown and obstruct vision of the traffic. Mr. ~bitz was also advised that ~n entrance such as he proposed, would have to be set back 35 feet from the highway line/ (Mr. John Wickham%Rs present at the meeting at 8:20 and presided as Chairman.) Vote of the Board: AyeS:-Mr. Wickham~ Mr~ Moisa, Mr. Grebe~ Mr. Young.~i and Mr. Unkelbach. ~ 'Southold Town Planning BO~d -5- June 3. 196b~ Bernard and Theodore Kaplan appeared before the Board to discuss the proposed subdivision to be known as "Dawn Estates", located at Greenport, in 'the Townof-Southold, Suffolk'iCounty, New York,~owned and developed byDawnEstates Builders'Corp. This sub,vision will contain approximately 28 lots. Mr. Kaplan was advised that the Board would wait until they had a report from Mr. Young on the meeting with the Town Trustees. This meeting dealt with the creation ofman made carols , s~ch as proposed in the subdivision "Dawn Estates". It was felt that themeeting wither he trustees should not be discussed with the applicants.. Mri~ Wickhamadvised the applicants that the Planning Board would try to have an answer, for them at their next mee~:ing. Mr. Wickham felt that.the lots in the subdivision were too small, however, Mr. Kaplan fettthatthere was no real basis to determine whether lots were too small or'too large. He also felt that there are many people who request smaller lots. Mrl Young advised thatthe water tablewas a serious question and should be given very serious consideration. Mr. Kaplan didn't feel that the proposed'canal in the subdivision would harm the-water table,] in v~ew of the fact that the subdivision would have village~ater. Mr. Wickham further advised thatthere are ~les~and regulations for the provision of a park-and playground area in the subdivision. He also.'~ormedMr. Kaplan that said park and playground area would have tobe for the public and not just for t~e lotowners in the subdivision. Lefferts P. Edson. Esq..,. and Mr. and Mrs. Clayton-Clarke nextappeared bebre the Board to discuss the following Change of zone application of Mr. amd Mrs. Clarke. South ~ a~monument on the said along the said north- ?30" E.- a distance of 'beginning. Mr. Edson stated that the applicants were not asking for the whole farm to be changed 'to business. They only-wanted a small parcel of the farm, in order, to conduct their'business, namely an antique shop. Mr. Edson also stated that 'to the east of the property in question is KaelinJ-s Farm Machinery, D0roski'ls and Myers FactorY"' all zoned business. The propertyofCharles Hubbard~~ non-donforming business, is across the street from the property in question. The applicants were advised that the Planning Board was not willing to goalong with this change of zone. Such a change in this particular location would constitute spot zoning. This would be a small business district in the middle of a residential section. The Planning Board also pointed out that~County-Route 27A was to be a high-speed highway and should not have small businesses on the route. Lefferts P. Edson appeared before the Board to discuss the following change of zone application. The petition of:Vitaliano Caroleo and others for a change of zone from -A,, Residential and Agricultural District to "B=2" Business District on certain real property situated ab~Cutchogue, in the Townof:Southold, Suffolk-County, New York, a~d more particularly bounded and described as follows: Beginning at a monument on the southerlyline of Middle Road marking the division of lands of the ~pplicants herein and L. This change of zone is also on the County Route 27A#. which the'~Planning Board feels should be maintained as a high-speed highway. Mr. Edson requested that the Planning Board hold-up their recommendation on this application until they receive a report from theCounty on a study being made of'County Route 27A. On motion by Mr. Moisa, seconded by Mr. Grebe, it~was RESOLVED thatLawrence Tuthill, professional engineer, be authorized to make an estimate for a performance bond for the completion of the roads and water mains in the subdivision -to ~e known as Eastern Shores at Greenport, Section III. There shall be a total for the completion of the roads, and a total for the water,mains, and the grand total. Vote of th~ Board: Ayes:- Mr. Wickham,. Mr~ Moisa, Mr. Grebe,' Mr. Young, and Mr. Unkelbach. The Planning Board received from the Town Board the original petition or'Anna C. Hansen, fora change of'zone from "A" Residential and Agricultural DiStrictto "B-2" Business~Dis~t~ict on certain real property.-situated at Mattituck, ~in the Town of Southold~Suffolk~CounJty,~ New York~, with the instructions-to prepare an official report defining the conditions therein. On motion by Mr. Moisa, seconded by Mr~ Young, it was ~ RESOLVED that~the Southold Town Plan~ning Board does not favorably recommend to the Town Board the change ~of zone from "A" Residential and Agricultural District to "B~2" Business District on the property of Anna C. Hansen as described above. The Planning Board fe~ls that the property in question is too large of an area to be zoned for business. Vote of the Board~ Ayes:- Mr. Wickham,~ Mr~ Moisa~ Mr, Grebe,. Mr. Young, and MrjUnkelbach. The Planning Board again, took up the matter'of'the petition of H.R. Southold Town Planning B~d -9- June 3.~ 19~ On motion by Mr. Grebe, seconded by Mr. Young, it was RESOLVED that the Planning Board hold-up their recommendation on the property of H.R. Reeve & Sons, Inc.~ until the Southold Town Board takes action of the petition of~Vina Baker and George Van Buren, for a change of zone from"A" Residential and Agricultural District to "B'2" Business'District. This property is.in the same vicinity as the property of H.R.' Reeve-~ Sons, Inc. Vote of'the Board: Ayes:-Mr.---Wickham, Mr. Moisa, Mr Grebe, Mr. Young, and Mr. Unkelbach. The Planning Board again took'up the matter of the ~e~%~e~ petition of William J. Pollert for a change of zone from'"A'' Residential and Agricultural District to "B--2" Business~District, on certain real property situated at Greenport, in the Town of Southold, Suffolk County,' New York, and more particularly'bounded and described as follows: Beginning at a point.on the westerly line of'Manhanset Avenue where the same is intersected by the northerly i/ne of Champlin Place and thence running along said northerly line of Champlin Place, south 58° 35~ 20" west, 489.90 feet to a point~ running thence north 31"-'24~'"'40'' west, 832.03 feet to a point on the southerly line of the N~rth"lRoad; thence along the southerly line of North Road two courses, as follows: ~) north 66° 36~40" east, 291~24 feet, and (2) north 65~ 23'-50" east~ 228.44-feet; thence abng land now or formerly of~enze,, two coursesl as follows:o 1) south 22~ 30' 10" east, 191.59 feet, and [2) north 66 36~ 40" east, 1'~.14 feet to the westerly li~e of'Manhanset ~venue; thence along said line~ south 20~. 12' 30" east, 569.68 feet to the point or place of beginning. On motion byMr. Wickham, seconded by'Mr. Grebe, it was RESOLVED that the Southold Town Planning Board doe"s not favorably-recommend to the Town. BOard the change of zone'from "A" Residential and Agzicultural DistIict to "B-2" Business Districton the property of Wiliiam J.. Pollert~as described above. It is the opinion of the Plann/ng Board that a business zone of this size and in this particular vicinity doesn~'t appear to be needed at this time. Vote of the Board: Ayes:-Mr. Wickham, Mr. Moisa, Mr. Grebe, Mr. Young~' and Mr. Unkelbach- South01d Town Planning Bd~d -10- June 3~ 19~~ A letter'was sent to H~rmon F. Bishop, commissioner, Depart- ment of Public'Works,.Cou~ty ofSuffolk, r~questing a copy of the plans for the future extension of C0unty Route 27~, as soon as they are available~ Howard Terry, Building Inspector, reportedthat hehad talked to Mr. Williamson, and he had given his approval on the subdivision to be known as~"Blue Horizons". This.subdivision had been approved subject to a letter from Mr~ Williamson. The Chairman is tobe notified when the Town Board accepts the performance bond so that he may sign %he final maps. On motion by Mr. Grebe, seconded by Mr. Young, it-was RESOLVED that the minutes ofthe Southold Town Planning Board dated May 11,. 1965, be approved as submitted. Vote of the'Board: Ayes:-Flr~ Wickham, Mr. Moisa, Mr. Grebe,~ Mr. Young, and bir~Unkelbach. Mr. Young.reported on his meeting with the Town Trustees, Town AttorneyRobert Tasker,' Esq., and Supervisor Albertson~ At the meeting t~e creation of man-made canals was discussed. Mr~ Young reported that Robert Tasker, Esq. informed them that a man can dig in his back yard and create a canal if he wants to. The Planning Board then held more disuussion on this particular subject. Mr. Young also reported thatthere should be an exchange of minutes between the Town Board,' Board of-Appeals, Planning Board and Town Trustees. A letter was sent to'Brookhaven Town Planning Board and Southampton Town Planning Board asking~ them what their policy has been in conmection with the creation of~man-made canals. A letter was written to Bernard and Theodore Kaplan in regard to the proposed subdivision "Dawn Estatest Section I~' Theywere advised that the Pllanning Board would have a more definite answer for them at-their'meeting in July. They will be notified of the exact date.
