Also present.: Otto Van Tuyl, Consultant The Chairman reported that he had received a letter from the Suffolk~County Planning Co~ssion in regard to County Route 27A. This was a very lenghty letter and the members of the Board agreed to read it-separately. It-will be discussed at the next-meeting of the Planning Board. The Planning Board next discussed proposed changes in the "Rules and Regulations for the Subdivisionof'~Land in Southold Town". Lenghtydiscussion was held in regard to man-made canals and the bulkheading of said canals. _Plaid lng ~ Southold Town/~oara ~ -2- June 22, 196~ On motion by M_r. Grebe, seconded by Mr. Young, it was RESOLVED that the following amendments be made to the "Town of Southold, Rules and Regulations forthe Subdivision of'Lan4": 1. Amend Section on "PROCEDURE" in regard to the fees for applications: 10 acres or less - base fee of fifty.dollars ($50.00); Over 10 acres - base fee plus five dollars ($5.00) for each additional acre orf~ction thereof in excess of ten acres. Also by adding a new paragraph under the fee: In addition, a highway inspection fee of fifty dollars ($50.00) per mile or ~ fraction thereof will be charged, but a mininum charge of fourty dollars ($40.00) will be made in all cases. 2. On page 2, under "PROCEDURES", paragraph 3,, shall be amended to read as follows: At a regular'mee~ng, the Planning Boa~will review the report~ consider ~11 phases of the proposed subdivision and ~ither. approve or disapprove the tentative-layout,.whereupon thedeveloper'will be notified of the approvaI~or disapproval of the tentative layout'as submitted. 3. BT amending Section 5 "//HPROVEMENTS", Subsection 2, item (b), by adding a new item to be item SECTION 5,.SUBSECTION 2, ITEM b-2: All highways terminating at tidewater~shall have a width or'not less than 100 feet ~cr 100 feet back from the main high water mark. All highways on waterfront~property.must'have the same access to the water as above required. 4. By amending Section 5, "I~PROVEMENTS", Subsection 2, item (e), to read as follows: SECTION 5, SUBSECTION 2, ITEM (e): A width of not less than 70% of the bounds ofthe highway shall be hereinafter known as the highway area from which all trees, brush, rocks, stumps, and other obstructions shall be thoroughly cleared and all such material shall be removed from the bounds of the highway. By amending~Section 5 "INiPROVEMENTS", Subsection 2, Item (g), by making item (g) become item (g-l), and adding a new item to be item g-2, to read as follows= SECTION 5, SUBSECTION 2, ITEM (g-21: Where surface is heavy loam or-clay, 'remove to sandy sub-soil andreplace with two feet bank run. Sandy loam shall be used for top six inches as in item (g-l). 6. By ~m~nding Section 5, "IMPROVEMENTS", Subsection 2, item (j) SECTION 5, SUBSECTION 2, ITEM (j): After the highway area has been properly graded, rolled and shaped to the approval of the Superintendentof-Highways, the twenty-four ,(24) foot section in the center of the highway area .~ereinafter referred to as the road section) shall betstablized with an application of one (1) gate'of'SC-1 (Bituminous Cut Back) per' squre yard mixed to a depth of (4) four inches. Within two months, and not less than one (1) month after stab~ization, the road section shall be rolled and properly ~repared and an application of one-half (%) gallon of ~MC-2 (Butuminous Cutback) per square yard shall be. applied with sufficient sand to absorb the excesssoil. In case o~ dry wea~/aer, the subgrade shall be wet-down before the oil is applied. 7.~Amend Section 5, "IMPROVEMENTS", Subsection 2, Item (m) SECTION 5, SUBSECTION 2, ITEM (m): Sidewalks shall be standard four foot in width, fQur inches thick except .in driveways where they must be not less than six inches .thick, Ail curbs and gutters to be built to standard forms as may be ~irected by the Superintendent' of Highways. On existing Town Highways the Town will furnish the necessary engineering, gra~ing, fill and labor; the property owner or owners shall furnish the necessary ready mixed concrete and shall deliver such concrete to the site as directed by the Superintendent or'Highways- The amount of side walk construction throughout the Town shall be determined by the Town Board. 8. By amending Sectic~ 5, "IMPROVEMENTS", by adding a new subsection to be subsection 4. SECTION 5,- SUBSECTION 4 - A construction inspector representing the Planning Board shall inspect all improvements while in the process of construction a~d it shall be the duty of the subdivider to notify the-Planning Board when the improvements is to be commenced and subsequently before it-is completed. Southold Town Planning Bo~f~ June, 22, 19~ 9. By.amending Section 5, "IMPROVF/~ENTS", by,.adding thereto a,'new subsection to be subsection 5. SECTION 5, SUBSECTION 5 - The construction inspector shall certify to the Planning Board when all improvements are completed as required by'the regulations and specifications of the Plann~g Board. 18. By~amending!~ the section on "Idenification and Description", item (t): "IDENIFICATION'ANDDESCRI~ION", I-TEM (t): The mininum width of any pavement shall be twenty four (24) feet. 11. By amending the section an "IDENIFICATION-AND DESCRIPTION", item ~). IDENTIFICATION'ANDDESCRI~TION, ITEM (w): The mininum thickness for sidewalks shall be 4" of concrete at 1.2:4 mixture, or equal. 12. By amending Section 9, ,DETAILSOF CONSTRUCTION IMPRO~NTS", Subsection 1. sys, tem .~ SECTION 9, SL~SECT. ION i - The entire sewage/and the disposal of sanitaryand storm sewage shall be Planned and built to meetthe approval of the proper administrative officials, but in all cases, all liquids must be returned to the soil. 13. By amen~kng Section 9, "DETAILS OF CONSTRUCTION IMPROVEMEB~ , Subsection 2. SECTION 9, SUBSECTION 2 - The water distribution system shall be designed to meet the approval or'the New York~State Department ofHealth'and the Suffolk'-CountyDepartment of Health. 14. By.amending'Section 9, "DETAILS OF~'CONSTRUCTION'IMPROVEMENTS", byadding a new.subsection~3, and thus moving all othersubsections up one number. SECTION 9, SUBSECTION 3, All man-made~waterways will be bulkheaded. The type and extent of bulkheading 'sh~ll be determined by the construction inspector or an engineer designated by the Planning Board. By .amending Section 9, "DETAILS OF CONSTUCTION INLPROVF/V~F. NTS"-, Subsection 3, through 5, inclusive. Subsection 3 to be renumber'Subsection 4 Subsection 4 to be renumber Subsection 5 Subsection 5 to be renumber Subsection 6 16. By amending'Section 9, "DETAILS OF CONSTRUCTION I/HPROVEMENTS", Subsection 6, by adding a new phrase: SECTION 9, SUBSECTION 6 - In lieu of making the improvements as specifie~ of the parties thereto. Ifthe P~nning Board shall decide at any time during the term of the performance bond, Cupon inspection by its construction inspector,) that the extent'of building development that has taken place in the sub- division is not sufficient to warrant ........... ~of'such proceeds. The Planning Board has had conferences with the Town Board and all of the proposed amendments to the Rules and Regulations for the Subdivision of land are generallyagreeable to both parties. The Planning Board would like to pointout that~Section 9, Subsection 3, All man-made water'ways will be bulkhead, is taken directly from the Town of'Southampton, rulesand regulations for the subdivision of land. The Southold TownPlanning Board has added to-this the t~pe and extent of~bulkheading shall~be ~eterminedbythe construction inspector or an engineer designated by the Planning Board. All such water ways must have the approval of the Planning Board as regards the fresh water~resourses of the Town. The Planning Board believes that'this amendmentis vital to ~e health and welfare of~Southdd Townl Vote of the Board: Ayes:- Mr. Wickham, Mr. Moisa, Mr. grebe, Mr. Young, and Mr. Unkelbach. The Planning Board agreedthat the following amendments to the Budding Zone Ordinance be recommended to the Southold Town Board again for their consideration and adoption. I. By-amending~Article IIIA, Section 350~ Subsection 4, by adding thereto a new part to be ARTICLE II~A,~ SECTION 350, SUBSECTION 4a - Apartment houses of any type, i(garden, apartments, regular'renting-apartments, cooperative apartments, condominium apartments~ etc.) by special exception of the Board of'Appeals as hereinafter provided. Such apartment houses shall not be: Plannbing Southold~Town/Board~ ~J -6- June 22, 19~ 1. Over tw.o and one-half (2%) stories or thirty-five (35) feet in height. 2. No residential occupancy other than main first floor units and second floor units. 3. Not more than ten (10~ families or apartment units per building. 4. Each building housing more than four(4) families, or apartment units, must be set on a lot having a mininum frontage of 200 feet on a 50 foot~mininum width road. Side yards of at least 25 feet on each side, a mininum setback of 35 feet~or the average setback of principle buildings on that side of the street or block, a mininum rear yard of 100 feet, 50 feet mininum between theproject buildings, if there are more than ene building. 5. Maximum building.area, including accessory buildings twenty percent ~(20%) of lot area. 6. Mininum dwelling unit area, six hundred (600) square feet-within wall of each single apartment u~-~t. 7. Not withstanding any other provision of this Ordinance each apartment house of over four'(4) living units shall have once and one'half (1½) parking spaces per unit for off street parking of tenants. Such parking 'spa~es shall be properly drained and maintained, dust free at all times. For this purpose each parking space shall be three hundred thirty ~our ~(334) square feet of area, mininum per vehicle. 8. Ail accessory buddings must be in the zear y~rd not-closer than five (5) feet to side of rear property lines, and the area of such shall be included in computing the total building area of each lot. 9. SIGNS - One sign not larger than 4' high by 6' long, single or doubled faced, at.ieast 3 feet-tO bottom edge~and not more than 12' to top edge, setback at least 10 feet from all property line, permit-required. 10. No building permit shall be issued until approval of Board of Appeals received in writing by the Building Inspector. Such approval shall cover all items on the plot plan, buildings parking ~rea, accessory buildings, access roads, drainage, plantings, lighting, fencing, etc., and written appr6val of the health department of water supply, sewage'disposal,g~rbage and refuse disposal, etc. Southold Town Planning Bo<~d -7- June 22, 19~ /-I~y repealingArticle IV, Section 407 ARTICLE IVy SECTION 407 - "B"DENSITY.OF'POPULATION - In the "B" Business District, no building shall hereafter be erected or altered to accommodate or make provisions for more than twent~ ~0~ families on one ~) acre of groundX or more than a pr©po~tional number of families on a fractional part of any acre of land,' based on the requirments as out-line above. III. By amendingArticle IV, Section 400,.Subsection 1, by adding thereto a new part to be la. la. To read the same as Article ILIA, Section 350, Subsection IV. By amendingArticle IV, by.add/ng thereto a new part to be Section 411. ARTICLE IV,' SECTION 411 --Any building or combination of buildings erected for retail business, offices, merchantile establishments, professional buildings, etc., erected or altered on a lot-]~x~ or'one acre or larger shall meet the following requirements: 1.. At least twenty-five percent (25%) of the area of the lot-shall be landscaped with grass and plantings. 2. Parking shall be provided in paved areas at-the rate of one parkingspace three hundred thir.ty four (334) square feet for each one hundred (100) square feet of floor-sales area or office space in each' building. -3. All rainfall and.storm ~water accumulated on eachand every lot shall be returned to the ground Within the bounds of said lot~ 4.~ SETBACKS - Sideyards of '25~feet,.rea~ yard setback~of 25 feet,' front~yard setback as in Section 404~ and 405, mininum. V. Byamending~Article VII, Section 703, to read as follows: ARTICLE VII-,'.SECTION 703~- A permitwill be required prior to the.commencing of work for the erection ~or additio~ to all buildings. By 'amending' Article VII, Section 705, to read as follows: ARTICLE VII',' SECTION 705, For each application or appeal to the Board of Appeals as hereinafterp=o~ided, there shall be a fee of fifteen doilars ($15.00) accompanying the application or'appeal.
