First, What.about the water? Do you want to submit to the Town Board a contract with the village of Greesport? Also there is the park and Playground provision. If you recall, when you gqt-approv~l of!SectiOn II, you gave us a letter of intent and the time is getting closer when we feel that the property should be dedicated to the Town..Now, I am not sure just how to go about this, but something should be donel ~(Lefferts P. Edson, Esq. advised the Board that he would provide the documents for the installation of the water'mains. He further~ advised the Board that after'Eastern~shore, Inc. held a meeting and decided upon the definite land to be dedicated to the Town~ he would prepare the necessary papers for said dedication of land tothe ~own of~Southold.) I have property on the other side or,New Suffolk'Avenue, next to land ofRussell Tuthill. I belisve that there is a culvet that drains under'New Suffolk Avenue. This culvet allows the water to drain by my property. I am here to ask questions. What is 'the intention of the real estate developer in reference to this culvet? I realize that~they have already made improvements on this land. There is one house already constructed and there is another house under construction. What I would like to know, is there going 'to ~e any change in the present arrangement for drainage? MR,~ UNKELBACH: Do you face on Deep Hole'Creek~ south or north of'New Suffolk~Avenue2 EDWARD ~ELSON: South, nextto Russell Tuthill. MR.' UNKELBACH: You are aware that we demand that all surface water be returned to the ground. C,' EDWARD NELSON: There are constructed basins that are~ on the road. Now, on thenorth side of the road, this ~ water runs under'a culvet, adjoining land where I am. ~'want~to know if there is going to be any change in the water pattern when this development is opened. ~mother thing I~ish to state, it was.-necessary for me to leave my job at 1:00 this afternoon to attend this meeting. Now, I would like to know what'the intentions are as far'as the water drainage is concerned. THE CHAIRMAN: We cannot advise you what their intentions are. I am launching a formal complaint-on the negligence on the part of-these developers to show up and answer questions of adjoining property owners. THECHAIRMAN: Anyone elsewish to be heard, in opposition to this application for a subdivision? (There was no response.) THE CHAIRMAN: Is there anyone present-who wishes to be heard in favor of this subdivision to be known as "Mattituck Estates"? '~There was no responsel) THE.CHAIRMAN: Hearing none, I will recess this hearing until the next'meeting of the'Southold Town Planning Board. :(C. Edson appeared before the Board with Vitaliano Caroleo to discuss his proposed change of zone from "A" Residential and Agricultural District to "B~2" Business District~on p~operty located at~Cutchogue~ This property is bounded and described as follows: All that~ certain plot, piece or parcel of land situate lying and being in the Town of'Southold, at~Cutchogue~ County of'Suffolk'and State of New York, bounded and described as follows: BEGINNING at a monument on the southerly line of Middle Road marking the division of lands or,the applicants herein and L. Glover; running thence along lands of the said L. June 29, 196b~ The Chairman again advised Mrl Edson and Mr. CarOleo that the Planning Board was not-willing to go along with this change of zone, in view of the fact' that it was planned to maintain County Route 27A as a high spDed highway, with a limited number of businesses and access onto the highway. Wiiliam'Wickham, Esq. appeared before the Board to inquire if anyfurther action had been taken on the property or,Martin Nelson for a.change of zone in GreenPort. Mr..~ Wickham was advised that no formal action was taken on this proposition, it had only been generally.approved by'the Planning Board. William Wickham~Esq. also wished to discuss the property of Anna Hansen~ located at~Mattituck. Mr. Wickhamwanted to know if the Planning Board would looknDre favorably upon changing to business a smaIler parcel of land than'was previously requested. The Chairman advised Mr. Wickham that the Board would like to see some kind of plan as to what-would be done with .the property. However,-Mr. Wickham advised the Board that' Mrs. Hansen requested the proPerty.changed to business property~ in order 'to sell it. Mr. Wickham said that he would file another ~application for'the land of~nna Hansen, however, he would request-a smaller parcel of land to be zoned to business district. On motion by Mr. Moisa, seconded by'Mr. Young, it was RESOLVED that the Southold Town Planning Board recommend to the Southold Town Board a performance bond of~$12,000.00 for the~comPletion of the roads and the watermains in the subdivision to be known asEastern Shores at Greenpert, Section ~II, Greenport~ New York, Owned and developed by'H."JJS%' Land and.Develo~ment~C0rp., and J~M.'S~ Landand Development~Corp. Land &~-DevekPment~Corp'., and j~M.-S~ Land and DeveloPment~Corp~, haspetitionedthe'~S°uth~d Town Planning Board .for final approval of~their~platknown as "Eastern~Shores at Greenport, Section III", atGreenport, New York, and W~M. A copy of a contract'~ with the Village of Greenport for the installation of the water mains. 2. A copy of the permit from the'County for'permission 'to connect the road in the subdivision to the County'Road. 3. The presentation of a legal document dedicating land to the Town of'Southold for park and playground area as required in the rules and regulations for the subdivis&on or'land. 4. The posting of a performance bond for the installation of the roads and watermains in the subdivision, and its acceptance by the Southold Town Board,- Vote of the Board: Ayes:-Mr. Wickham, FL~.i Moisa, Mr. Grebe, Mr. Young, and Mr~ Unkelbach. The Planning Board received from the Town Board the original petition of ~Katherine J. Schafer, for 'a change of zone from "A" Residential and Agriculturai District to "B'2" Business Distmict with the instructions to prepare an official report defining the conditions described therein. This change of zone is for certain real property situated a~' East Marion, in the Town of'Southold,. Suffolk. Coutny, New York, and more particularly bounded and described as follows: Southold Town.Planning Boa~ -8- June 29, 1965 Beginning'ata monument on the northerly line of Main Road at the southwest corner oflandnow or formerly of~Cowan; thence N. 9°~ 27' 00" W~-124.'20 feet; thence N. On motion by'Mr. Moisa, seconded by Mr. Grebe, it was 'RESOLVED that the Southold Town Planning Board does not favorablyrecommend to the Town Board the change of zone from "A" Residential andAgricultural District to"B--2" Business'District on the property of-Katherine J% Schafer, as described above. The Planning Board points out thatthe proposed changeof zone would constitute spot'zoning, since there are no other business districts in the immediate vicinity. The Planning Board further points outthattheproperty in question is directional across from a church. Vot~6f the Board~Ayes:-Mr' Wickham, Mr. Moisa~ Mr. Grebe, Mr, Young,. and Mr. Unkelbach. The Planning Board briefly discussed the change of zone application of'Hl'R.' Reeve &~SON, for a change of zone from "A" Residentialand'AgriculturaI District to '~-2" Business District on property situated, at Mattituck on the~Westerly side of'Wickham Avenue. The Rlanning Board agreed to write Mr' Reeve a letter~'requesting his presence at the next planning Board meeting so that theymay discuss the propoSed change of zone with him.
