SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's 5,980 sq. ft. parcel has 100.62 feet along Bayberry Road to the west, 50 ff. along Sun Lane, and 54.60 feet along the mean high water of Goose Creek (a/k/a West Creek). The property is shown as Lot 4 on the Map of West Creek Development filed 7/6/1937 in the Suffolk County Clerk's Office. BASIS OF APPLICATION: Building Department's Apdl 8, 2004, Notice of Disapproval, citing Code Section 100-239.4B in its denial of a building permit application conceming an as-buiit deck addition situated closer than 75 f~et from the bulkhead. FINDINGS OF FACT The Zoning Board of Appeals held a public headng on this application on June 22, 2004, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTI=I'): The applicants request a vadance for the as-built setback location of their one-story open, unroofed deck on the north side of the dwelling. The deck is shown on the 9128/99 survey, revised 1-4-00 by Peconic Surveyors, P.C. to be 31+- feet from closest edge of bulkhead, as angled. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the relief requested will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicants indicated that the property was purchased in October 1999, with the 15' x 20' deck already in place for at least six years. The bulkhead structure consists of two wooden returns, the closest at +/-31 feet from the existing deck. The further outer edge of the bulkhead scales on the. survey map at 43+- feet to the deck. ZBA No. 5534 - David and Jane Sta~:)~l CTM 76-1-13 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an ama variance. The deck has existed in its present location for more than 10 years. This is the maximum relief that the board would approve based upon the size of this lot and size of the lots in the area. 3. The variance granted heroin is substantial, placing the deck in a location +/-31 feet from the closest bulkhead return, rather than landward of the bulkhead-setback line of the dwelling that exists. 4. The difficulty is self-created, in that the as-built deck does not conform to the zoning requirements on this lot. 5. No evidence has been submitted to suggest that a variance in this community of single-family residences will have an adverse impact on the physical or environmental conditions in the neighborhood. Information shows that a previous owner had obtained a waiver dated September 29, 1994 from the Board of Town Trustees concerning this 15' x 20' deck. 6. Grant of this relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of the as-built open deck addition, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Goehdnger, seconded by Member Oliva, and duly carried, to GRANT the variance as applied for, as shown on the 9/28/99 survey, revised 1-4-00 by Peconic Surveyors, P.C. with the condition that the deck remain open to the sky. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action.
