Southold Town Planning Board
December 12, 1967
A regular meeting of the· Southold Town Planning board was
held at the Town Office, Main Road, $outhold, New York, on
Tuesday~ December 12, 1967, at'7:30 p.m.
There were present: Messrs: John Wickham, Chairman;
Henry Moisa, Vice Chairman;William Unkelbach, and Frank
Coyle.
Absent: Mr. Alfred Grebe weather conditions did not
permit flying from Fishers Island.
Also present: Otto W. Van Tuyl, P.E., Consultant; Howard
Terry, Building Inspectorl Lawrence Tuthill, P.E., Construction
Engineer; RaymondDean, Superintendent of Highways.
Mr. Dominic'Auriuhio appeared before the PlanningBoard
with a sketch plan for a subdivision on property located south
side $oundvliew Av,enue andln-orth side Middle Road. Mr, Aurichip
plans to subdivide approximately four acres of land into 1i lots
with a 30-33 foot private road providing access. The lots will
be minimum Size and some will be 15,000 square feet. Mr..Aurichio
felt this plan was in keeping with the lot size in the immediate
area. Mr. Aurichio also stated that he planned to put in a
fire hydrant, thus relieving surrounding property of any further
hazard.

The Chairman advisedMr. Aurichio that the Planning Board
is very reluctant to approve much more than two lots per acre
for subdivisions. Mr. Aurichio stated he plans to install city
water. The Chairman also advisedMr. Aurichio that the Planning
Board requires a 50 foot road and 100 foot frontage on all lots;
and informed him of the park and playgroundrequirements. Mr.
Aurichio pointed out that no other lots in theimmediately
surrounding area have 20,000 square feet. The Chairman advised
Mr. Aurichio that if he wanted the minimum size lots the Planning
Board could require a 50 foot road and a park and playground area.
The Chairman suggested that Mr.- Aurichio have Mr. Van Tuyl
make a new map. It was also pointed out that approVal of the
highway layout must be obtained from the Superintendent of
Highways and that <~e usuallydoes not go along with odd-shaped
turn-arounds. Mr. Aurichio stated they wanted the turn-around
to discourage through traffic. TheChairman also pointed out
that the road shouldbe made 50 feet wide because invariably
in 10 or 15 years the people want to dedicate the road to the Town
and have theTown Maintain them.
The water supply and drainage in the area was discussed
at some lenght~. Mr.'Aurichio felt he would be aiding the
drainage problems in the area. The water table in the area was
also discussed.
Mr.- Aurichio was finally advised that' the should have
a new map drawn. Each lot must have 100 foot frontage or more;
there must be a 50 foot road; and the small lots will have ~O
be approved by the Suffolk-County Board of Health.
Mr. Rene Gendron and James Olsen appeared before the Board
in regard to the subdivision to be known as Vista Bluff. Mr.
Samuel Grimes, Esq., attorney for "Birch Hills at Cutchogue" was
also present. The chairman advised that a letterer approval of
the highway layoutwas needed. Fir. Grimes stated that the
layout of Vista Bluff had created two corner lots in Birch Hills
at Cutchogue, and he felt this lowered the value of these lots.
TheChairman advised that corner lots are considered to be 25%
more Valuable, however Mr. Grimes did not feel this held true
in Birch Hills at~Cutchogue. Mr. Grimes stated that the map
of Birch Hills at Cutchogue showed a park and playground area
as their lots did not go down to the highwaSer mark. He was
concerned with the 15 foot right of way shown on the map of Vista
Bluff. He felt this might appear to some people as a sidewalk
to the park and playground area in Birch Hills. The Chairman
felt there should not be too much difficulty.

Mr. Leander Glover was also present and the Chairman asked
him how near the plan the roads were done in Birch Hills at
Cutchogue. He stated the road is about 8 feet from the boundary
line. Mr. Dean Stated he wa~ed the two roads to connect unless
one wants to have a private road, but if they are going to be
Town roads they must be connected. Mr. Grimes stated theymay
want to keep the roads in Birch Hills at Cutchogue private for
awhile. The Chairman advised this is okay. All Mr. Grimes
needs to do is put a wall across at the end of the road and
there should be no problem.
The ChaPman advised Mr. Olsen and Mr. Gendron that he wanted
to know what the problems would be in moving the 15 foot right
of way to the other side. Mr. Van Tuyl stated it would mean a
new deed and the title company may take new action. Itwas also
pointed Qut thatMr. Vincent already has his foundation for his
house in. The Chairman stated he wants to know all the problems
involved .in changing the right of way, before taking any further
action.
Walter Kapp, Esq., and George Barzac, Jrt, appe~ed before
the Planning Board in regard to the subdivision to be known as
Redwood Park, Boisseau Avenue, Southold, New York. Mr. Barzac
requested permission to build houses on the lots facing on
Boisseau Avenue in order to finance the building or, the road.
He would like to build on lots number 2,' 17, and 18. The
Chairman advised Mr. Barzac that the Board would discuss this
proposal and write him a letter. He was also advised that the
Planning Board needs a letter stating the test holes are
Satisfactory. Mr. Kapp su30mitted the covenants and restrictions
for thelots to be sold in Redwood Park.
Mr. Robert'McCarthy appeared before the Board with a
proposal to set-aside one lot on a 1.08 par.cel of land. The
property is known as theOld School property, located in
Bayview. The Chairman advised that Mr. McCarthy could get
four lots out of this area~nd for him to mark it out any way
he wanted to. The Planning Board wants to see what the future
plans for the property are. It is not necessary to file or
record a map, but the Planning Board will ha-ve in their files
an overall plan for the remaining property.

Mr. WilIiam~Wickham, Esq, appeared before the Board with
Mr. Warren and Mr. Hallock with a sketch plan for a minor sub-
division on property presently owned by Mr. R. B. Grady. The
property is located on the south side Peconic Bay Blvd., Laurel.
The property is being purchased subject to the necessary
approval of the Board to subdivide it. Mr, Wickham stated
there would be two lots with 100 foot frontage and ~ne lotwith
85 foot frontage. They wish to preserve the driveway just as it
is without changing any lines. There wiI1 be a total of five
lots, all of which will be at least~20,000 square feet in area.
It was determined that the driveway will be 28. The possibility
of increasing this to 50 feet was discussed. The Chairman advised
the applicants to file a formal survey of the property and
this will be handled as a minor subdivision.
Mr. Robert MCCarthy appeared before the Board a~n width lots
sketched on the survey. However, he showd five lots instead of
four lots and the Planning Board stated they wanted only four
lots from this parcel.
The Planning Board received the following letter from
Lawrence M. Tuthill:

"Gentlemen:
'ii ha~e inspected the roads of B~rch Hills, Cutcho~ue and
found the roads to meet the requirements of the'Southold Town
Planning Board except to note that the road has not been
connected to'Vista Bluff as requested by the Planning Beard.

The Southold Town Planning Board received from theSouthold
Town Board the original resolution of the Southold Town Board
in regard to a change of zone on the Town Board's own motion
from "B" Business District-to "A" Residential District, with the
instructions to prepare an official report thereon pursuantto
the provisions of Article IX~ ~e~ of'the Building Zone
Ordinance of the Town of;Sou%hid.
This property is located at'Southold, in the T~wn of
Southold, Suffolk'County~and.State of New York, and more
particularly bounded and described as follows:
Beginning at the intersection of'the easterly line of
Kenney's Road, with the southerly line of North Sea Drive;
from said point ofbeginning running easterly along said
southerly.line of North Sea D~ive, 183 feet more or less;
thence southerly 550 feet more or less, to the northerly
line of Dogwood Lane; thence westerly along said northerly
line of Dogwood Lane, 285 feet more or less, to said easterly
line of'Kenney's Road; thence northerly along said easterly
line, 580 feet more or less to the point of beginning.
On motion by Mr. Moisa, seconded by Mr. Coyle, it was
RESOLVED that'the Southold Town Planning Board favorably
recommends to the Southold Town Board the change ofzone from
"B" Business District to "A"Residential and Agricu~lral district
on the above described property.
The Board finds there is no other business zone in this
immediate vicinity and the parcel in question was zoned businees
by error in the original zoning plan.
Vote of the Board: Ayes:- ALL
The Planning Board received from the Town Board the legal
papers for the dedication of the road known as Beebe Drive
Extension, located at East'Cutchogue, New York. The following
letter was written to the Southold Town Board:

"We 'received fromyour BOard the papers for the dedication
of Beebe Drive Extension, East-Cutchogue, New York. We are
holding, this up pending the filing of a sketch plan of this
property by.the subdivider. This has never-come before use
before because approval of access was granted by the Board of
Appeals under Section 280A of the New York' StateTown Law~ and
~this has short-circuited our Board. We feel it is important
with the new subdivision regulations that we are informed of
the subdivider's intentions".
The Planning Board received from Lefferts P. Edson, Esq.,
a letter in'regard to the right of way at. Peconic Homes,
Section II. The follow~g letter was written to,Lt. Edson.
"Lefferts P.. Edson, Esq., Main Street, Southold, New York.
"Re: Peconic Homes, Section II - Right of way
"Dear' Mr. Edson:
"We have your letter of November 22, 1967. As far as the
right of way is concerned you assured us at our last meeting
you would have in our hands a statement that you would ~ovide
for-the right ofwayfor the property owners immediately to the
north. On the strenght of your statement we released yourmap
for' filing. As it turns out your letter states "will make every
effort to obtain an easement', and this is not'satisfactory.
We are expecting a letter from you stating that you~ WI~.L obtain
an easement. We would prefer to have a recordable instrument/
for our files. In fact, our minutes of November 22, 1967, s~ow
that you stated that you will supply us with a legal i~hrument."
Mr. Otto Van Tuyl presented a preliminary subdivision map
of Gardiners Bay Estates, Section III, East Marion, New York.
The map showed a parce~ of land still in the name of Gardners
Bay~Co., Inc. This property was suppose to have been sold to
another party. The Chairman advisedthat-the' Planning Board is
not willing to allow a narrow s~rip of unuseable property.
The following letter was written to Gardners Bay'Co., Inc.:

"Dear M_rs. Thorp:
"In reviewing your preliminary map of Gardiners Bay'Estates
Section III, at our regular meeting of the Planning Board on
December .12, 1967, we find there is a parcel of land to the
northwest still in the name of Gardners Bay-Company. When you
met with the Board you informed us that this property was going
to be sold to another owner. In fact, we advised you to do just
that. In view of the fact that the present_map is not in accord
with what we have understood, we would like a catrification
before proceeding any further. It is probable that~aletter of
intentwill be acceptable, but-obviously if there is some change
from our agreed upon lay-out, the Planning Board needs to know
it and the reasons behind it. "
On motion by Mr. Moisa, seconded by Mr. Unkelbach, it was
RESO~ED that the minutes of the Sou~hold Town Planning
Board, dated November 21, 1967, be approved as submitted.
Vote of the Board: Ayes:-ALL
A letter was written to George Barzac, Jr., stating-he
could build on lots 2, 17, and 18, in Redwood Park, Boisseau
Avenue, Southold, New York. However, it waspointed out-to
Mr. Barzac that-title to any of the three lots could not-be
conveyed until such time ans the map of Redwood Park was filed
in the Office of the Suffolk~County"Clerk.
On motion by Mr. Unkelbad% seconded by'Mr. Moisa, it was
RESOLVED'that the Southold Town BuildingInspector be
authorized to issue building permits for lots numbered 2, 17,
and 18, as shown on the map of the subdivision to be known as
Redwood Park, locatedon Boisseau Avenue, Southold, New York, and
as shown on the map by ~Otto W, Van Tuyl & Son, map dated October
26, 1967.

The next regular meeting of the'Southold Town Planning
Board will be held at 7:30 P.'M.~, Tuesday, January 16, 1967,
at the Town Office~ Main Road, Southold, New York.
The Planning Board will meet with the Southold Town Board
at 8:00 p.m., on Tuesday, December 19, 1967, at the Supervisor's
Office, 16 South Street, Greenport, New York~ to discuss a
proposed dredging ordinance.
The Chairman signed the final subdivision maps on Sunset
~nolls, located at Mattituck, Town of' South~ld, County of
Suffolk and State of New York, owned and developed by Stanley
Sledzieski.
The Chairman signed a special exception~to go before
the Board of Appeals for permission to obtain a permanent
permit for the sign located at Cliff Tylers Garage, Cutchogue,
New York, in view of the fact the Planning Board has been trying
for 10 years to widen Griffin Street, School Street Extension
and North Street to a 60 foot highway.
The meeting was adjourned at 10'-'30 p.m.

The Southold Town Planning Board received from the Southold
Town Board a proposal for amending the Building Zone Ordinance
of the Town of Sou thold, Suffolk County, New York, by adding
thereto a new article to be Article XI, to read as follows:
ARTICLE XI - SECTION 1180 - Every application to the town
board, the board ~f appeals and the planning board for a change
of zone, variance, exception, permission, approval of subdivision
plats or other relief under the provisions of this ordinance
or any law, rule .or regulation pertaining to zoning and planning
shall be accompanied by an affidavit executed by the applicant
and all owners, contract vendees and holders of any beneficial
interest in the property described in such application and~setting
forth the follows:
(~) then a me and address of the applicant.
(b) The name and address of the owner of the property described
in the application.
(c) the Name and address of every individual, partnership
and corporation having any interest direct or indirect in the
property described in the application and the nature of such
interest. Without limitation by the enumeration thereof, such
interest shall include a contract vendor, contract vendee, lessor,
l~ssee, mortgagor, mortgagee~ lienor, lienee, guarantor, assignee,
agent, broker or the holder of any beneficial interest in such
property.
(d) If any such interest in the property is held by a partner-
ship, the name, address and interest of every partner in the partner-
ship for the last two years.
(e) If any such interest in the property is held by a
corporation the name and address of the officers, directors
and stockholders of such corporation for the past two years.
The provisions of this paragraph shall not however apply to banking
corporations, public corporations, corporations listed on a
stock exchange or corporations having more than 1,O00Ostockholders.
(f) The relationship, if any, of any person named in said
affidavit to any officer or employee of the Town of Southold.
(g) In the event that there is any change in any of the
facts set forth in the affidavit submitted with any application
prior to a final determination of such application, a supplemental
affidavit containing such changes shall be filed with the
appropriate board prior to such final determination.

SECTION 1101- If any member of the Town Board, planning
Board or board of appeals shall have an interest, direct or
indirect, in the property which is the subject of anyapplication
on file with the board of which he is a member, such member
shall, prior to any determination by said board with respect to
such application, publicly disclose the nature and extent of
such interest by executing an affidavit setting forth in detail
the nature and extent of such interest and fileing the same with
the Town Clerk.
It was RESOLVED that the Southold Town Planning Board favor-
ably recommends to the Southold Town Board the amendment to the
Southold Town Building Zone Ordinance as set forth above. The
Planning Board is in full agreement with theTown Board as to the
reasons why such an act should be passed.
