TERMS AND CONDITIONS The Permittee, William H. Lieblein, P.O. Box 767, Shelter Island, NY, as part of the consideration for the issuance of the Permit does understand and prescribe to the following: That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold. That this Permit is valid for a period of 24 months, which is considered to be the estimated time required to complete the work involved, but should cimumstances warrant, request for an extension may be made to the Board at a later date. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved, to provide evidence to anyone concerned that authorization was originally obtained. That the work involved will be subject to the inspection and approval of the Board or its agents, and non~compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. That there will be no unreasonable interference with navigation as a result of the work herein authorized. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation, the said Pcrmittee will be required, upon due notice, to remove or alter this work project herein stated without expenses to the Town of Southold: That the said Board will be notified by the Pcrmittee of the completion of the work authorized. Reach 6 (as a whole) contains the highest concentration of marina-related uses in the Town of Southold. The water-dependent uses include marinas, boat-launching ramps, and beach access at public road ends. (LWRP 2004). Suffolk Environmental Consulting, Inc. on behalf of PORT OF EGYPT, INC. requests a Wetland Permit to maintenance dredge (10-year maintenance) various underwater areas within the marina, to a navigable depth of -6.0'+~- (at Iow tide). SCTM#56-6-3.4,4&6.1 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP provided the following best management practice is required pursuant to: 10.3 Allow for continuation and development of water-dependent uses within the existing concentration of maritime activity in harbors, inlets and creeks. In addition to Mattituck Inlet and Creek and the Village of Greenport, important concentrations of water-dependent uses are located at Orient Point, Orient hamlet, Gull Pond, Mill Creek/Budds Pond~ Town/Jockey Creek, New Suffolk, James Creek and West Harbor. Individual marinas and other water-dependent uses are located outside of the concentrations of maritime activity. Ensure that public actions enable these harbors, inlets and creeks to continue to function as concentrations of water-dependent uses. It is unclear which floating docks will be extended seaward. It is recommended that the Board clarify which docks will be extended and assess the navi.qability between the end of the floating docks and opposite floatin.q docks and the barrier island located south of the marina facilities (see figure) 10.4 Figure 1. Subject site in relation to barrier island. B. Protect and enhance the economic, physical, cultural, and environmental attributes which make up the character of these harbors, inlets and creeks. Minimize adverse impacts of new and expanding water-dependent uses and provide for their safe operation. C. Site marinas, yacht clubs, boat yards, and other boating facilities in suitable locations. The Town of Southold has identified the traditional concentrations of maritime activity located in the harbors, creeks and inlets, as the most appropriate locations for the development and expansion of marinas, yacht clubs, boat yards, and other boating facilities. These sites are zoned for these uses: either Marine I or II. In general, the necessary infrastructure and services to support these uses already exists in these areas, and due to the general level of previous development of these areas, the potential for significant adverse impact on the remaining natural resources is likely to be less than in other locations. Siting maritime uses outside of MI and Mil zoning districts increases the potential for adverse impacts on coastal resources. seek to minimize adverse impacts on coastal resources by siting new marinas, yacht clubs, boat yards, and other boating facilities only in areas identified as appropriate for water-dependent uses; avoid siting new marinas, yacht clubs, boat yards, and other boating facilities outside of the areas identified as appropriate for water- dependent uses. The proposed action complies with the above sub-policies. It is recommended that the Board assess whether pump out facilities are adequate and available to vessels. In the event that the action is approved, the installation of a silt boom during dredging operations is strongly recommended pursuant to § 275-11. Construction and operation standards of the Southold Town Code. § 275-11. Construction and operation standards. A. General. The following standards are required for all operations within the jurisdiction of the Trustees: (2) Erosion control. Installation of an erosion control structure is necessary during any building, grading, landscaping or site work activity within Trustee jurisdiction. This structure may include, but is not limited to, installation of a silt fence, hay bales, wood chip berm and silt booms. The placement of the erosion control structure(s) shall be determined by the Trustees or their designee. All intertidal construction and excavation requires the installation of a silt boom that will retain all suspended sediments within the immediate proiect area. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
